(~ [ - II A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO THE INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY AND DENTON COUNTY, PASSED JULY 17, 2000 FOR THE PROVISION OF ECONOMIC ASSISTANCE FOR INTERSECTION IMPROVEMENTS AS DEFINED IN THE AGREEMENT IN THE CITY OF THE COLONY; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the Mayor o£the City o£The Colony, Texas, is hereby authorized and empowered to execute an amendment to the Interlocal Cooperation Agreement with Denton County passed July 17, 2000 for the provision o£ economic assistance from Denton County for intersection improvements as defined in the Agreement. Section 2. That a true and correct copy of the Interlocal Cooperation Agreement is attached hereto and incorporated herein. Section 3. Hicks, TRMC, C~y Secretary t AMENDMENT TO THE INTERLOCAL COOPERATION AGREEMENT BETWEEN DENTON COUNTY, TEXAS AND THE CITY OF THE COLONY THIS AMENDMENT is made and entered upon into the date which all parties have signed this document, by and between Denton County, Texas, a political subdivision of the State of Texas. hereinafter referred to as the "COUNTY", and the City of The Colony. a political subdivision/entity of the State of Texas, located within Denton County, Texas, duly organized and authorized under the laws of the State of Texas, hereinafter referred to as the "CITY." This is an amendment of the Interlocal Cooperation Agreement entered into between the parties on October 10, 2000, ("ICA") for purposes of the completion of signal installation at SH 121 and Morningstar intersection, intersection improvements at FM 423 and North Colony Blvd., and intersection improvements at SH 121 and Paige Road, hereinafter collectively referred to as the "Project". WHEREAS, the COUNTY and the CITY entered into an ICA on October 10, 2000, to provide for the completion of traffic signal installation at SH 121 and Morningstar intersection, intersection improvements at FM 423 and North Colony Blvd., and intersection improvements at SH 121 and Paige Road; and WHEREAS, the City and the County wished to share the cost of the Prq}ect, which at the time of the execution of the ICA the County's share was estimated to be $75,000,; and WHEREAS, the City and the County wish to amend the ICA to correctly reflect the actual cost of the signal installation at SH 121 and Morningstar which will be $104,000.00, and ICA page WHEREAS, the County had set aside $75,000, as the amount of its participation in this Project; and WHEREAS, the County wishes to fund an additional $27,000 from Better Safer Road Bond Program Discretionary Funds of Precinct 2 to assist in the installation of the referenced traffic signal. NOW, THEREFORE. COUNTY AND CITY, for the mutual consideration hereinafter stated, agree and understand as follows: The following sections will be substituted for the same numbered sections in the ICA and will read as follows: IV. As required by V.T.C.A., Transportation Code Section 251.012 and as evidenced by the signature of the City's representative below, the governing body of the City by the execution of and approval of this Agreement approves of the expenditure of County money to participate in or provide funds not to exceed ONE HUNDRED AND TWO THOUSAND AND NO/00 ($102,000.00), of which TWENTY FIVE THOUSAND ($25,000.00) will be used for intersection improvements to FM 423 at North Colony Blvd., TWENTY FIVE THOUSAND ($25,000.00) for intersection improvements to SH 121 at Paige Road, and FIFTY TWO THOUSAND ($52,000.00) for installation of a signal at SH 121 and Morningstar Road. VI. As the City proceeds in the completion of the Project, it shall submit invoices on a monthly basis for reimbursement to the ICA page 2 Demon County Auditor, at 401 West Hickory, Suite 423, Denton, Texas 76201, and County shall reimburse the City for all expenditures related to this prqject within Thirty (30) days of receipt of these invoices. Attached to this Contract is a certification by the County Auditor that the County shall include the sum not to exceed ONE HUNDRED AND TWO THOUSAND AND NO/00 ($102,000.00), of which TWENTY FIVE THOUSAND ($25,000.00) will be used for intersection improvements to FM 423 at North Colony Blvd., TWENTY FIVE THOUSAND ($25,000.00) for intersection improvements to SH 121 at Paige Road, and FIFTY TWO THOUSAND ($52,000.00) tbr installation of a signal at SH 121 and Morningstar Road in its budget and that this amount shall be itemized, set aside and approved by the County Commissioners Court to be expended tbr the Project. All other terms and conditions of the ICA are hereby affirmed by the parties. EXECUTED in duplicate originals.
