HomeMy WebLinkAboutMinutes - City Council - 05/19/2026 - RegularMINUTES OF THE CITY COUNCIL REGULAR SESSION HELD ON MAY 19, 2026 The Regular Session of the City Council of the City of The Colony, Texas, was called to order at 6:31 p.m. on the 191h day of May 2026, at City Hall, 6053 Main Street, The Colony, Texas, with the following roll call: Richard Boyer, Mayor Present Judy Ensweiler, Councilmember Present Robyn Holtz, Deputy Mayor Pro Tem Present Brian Wade, Councilmember Present Dan Rainey, Councilmember Present Perry Schrag, Councilmember Present Joel Marks, Mayor Pro Tem Present And with 7 council members present a quorum was established and the following items were addressed: 1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS and PROCLAMATIONS 1.1 Call to Order Mayor Richard Boyer called the meeting to order at 6:31 p. m. 1.2 Invocation Councilmember Judy Ensweiler delivered the invocation. 1.3 Pledge of Allegiance to the United States Flag The Pledge of Allegiance to the United States Flag was recited. 1.4 Salute to the Texas Flag The Salute to the Texas Flag was recited. 1.5 Proclamation recognizing retiring Fire Chief Scott Thompson for his 17 years of exemplary service to the City of The Colony and his 40th year career in the American fire service. Mayor Richard Boyer recognized Fire Chief Scott Thompson for his years of service. Fire Chief Scott Thompson accepted the proclamation. 1.6 Recognition of retiring Fire Chief Scott Thompson by Texas State Representative Jared Patterson. State Representative Jared Patterson recognized Fire Chief Scott Thompson and Assistant Fire Chief Jason Bonds for their years of service. 1.7 Items of Community Interest 1. Councilmember Judy Ensweiler provided an update on the food drive from Saturday, May 16th. 1 These items are strictly public service announcements. Expressions of thanks, congratulations or condolences; information regarding holiday schedules; honorary recognition of city officials, employees or other citizens; reminders about upcoming events sponsored by the City or other entity that are scheduled to be attended by a city official or city employee. No action will be taken and no direction will be given regarding these items. City Council — Regular Meeting Agenda May 19, 2026 Pagel 2 2. Mayor Richard Boyer announced Congressman Brandon Gills Academy Appointee event will occur on Friday, May 29th at 10 a.m. at City Hall Council Chambers. 1.8 Receive presentation from the Library regarding upcoming events and activities. Library Director Megan Charters provided upcoming events and activities to the council. 2.0 CITIZEN INPUT None 3.0 WORK SESSION 3.1 Council to provide direction to staff regarding future agenda items. None 4.0 CONSENT AGENDA Motion to approve all items on the Consent Agenda- Judy Ensweiler, Councilmember; second by Dan Rainey, Councilmember; motion carried with all ayes. 4.1 Consider approving City Council Regular Session meeting minutes from May 5, 2026. 4.2 Consider approving Council expenditures for March 2026. 4.3 Consider approving a resolution authorizing the City Manager to award a contract to Rexel USA Wholesale Electrical Supply in the amount of $382,000.00 for the repair and replacement of various median lighting along FM 423 from SH 121 to the city's northern city limit, utilizing TIPS contract #24060301. RESOL UTION NO. 2026-032 5.0 REGULAR AGENDA ITEMS 5.1 Conduct a public hearing, discuss and consider an ordinance adopting the Standards of Care Policy for day camp programs. Recreation Administrative Manager Lindsey Stansell presented the proposed ordinance to council. The public hearing was opened and closed at 6:48 p.m. Council provided discussion on the item. Motion to approve— Judy Ensweiler, Councilmember; second by Brian Wade, Councilmember; motion carried with all ayes. ORDINANCE NO. 2026-2647 City Council — Regular Meeting Agenda May 19, 2026 Pagel 3 5.2 Discuss and consider approving a resolution authorizing the City Manager to execute a Professional Services Agreement with Parkhill for design services for the Police Department and Court Facilities Renovation in an amount not to exceed $159,500.00. Parks Development Manager Calvin Lehmann presented the proposed resolution to council. Council provided discussion on the item. Motion to approve— Brian Wade, Councilmember; second by Dan Rainey, Councilmember; motion carried with all ayes. RESOL UTION NO. 2026-033 5.3 Discuss and consider an ordinance amending the Code of Ordinances Article V related to motor -assisted scooters, electronic bicycles and pocket -bikes. Police Chief Phillip Foxall presented the proposed ordinance to council. Steve Carpenter, 8204 Lindsey Gardens, spoke in favor of the adoption of the ordinance. Council provided discussion on the item. Councilmember Schrag arrived at 7:18 p. m. Motion to approve— Judy Ensweiler, Councilmember; second by Brian Wade, Councilmember; motion carried with all ayes. ORDINANCE NO. 2026-2648 5.4 Discuss and consider approving a resolution casting the city's vote for a nominee to serve as a member of the Board of Managers for the Denco Area 9-1-1 District. Motion to approve the nomination of Jim Carter- Judy Ensweiler, Councilmember; second by Brian Wade, Councilmember; motion carried with all ayes. Executive Session was convened at 7:42 p. m. 6.0 EXECUTIVE SESSION 6.1 Council shall convene into a closed executive session pursuant to Sections 551.072 and 551.087 of the Texas Government Code to deliberate regarding purchase, exchange, lease or value of real property and commercial or financial information the city has received from a business prospect(s), and to deliberate the offer of a financial or other incentive to a business prospect(s). City Council — Regular Meeting Agenda May 19, 2026 Pagel 4 6.2 Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to receive legal advice from its attorney regarding pending litigation: TOCA Colony, LLC v. Blue Sky Sports Center, LP, and the City of The Colony, Texas. 6.3 Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to receive legal advice from its attorney regarding pending litigation: Preston Tighe's property located at 3805 Overlook Court, and the City of The Colony, Texas. Regular Session was reconvened at 8:17 p. m. 7.0 EXECUTIVE SESSIONACTION 7.1 Any action as a result of executive session regarding purchase, exchange, lease or value of real property and commercial or financial information the city has received from a business prospect(s), and the offer of a financial or other incentive to a business prospect(s). No Action 7.2 Any action as a result of executive session regarding pending litigation: TOCA Colony, LLC v. Blue Sky Sports Center, LP, and the City of The Colony, Texas.
