(Stewart) TO ALL INTERESTED PERSONS Notice is hereby given of a REGULAR SESSION of the CITY COUNCIL of the City of The Colony, Texas to be held at 6:30 PM o n TUESDAY, JUNE 2, 2026 at CITY HALL, 6053 MAIN STREET , at which time the following items will be addressed: This portion of the meeting is to allow up to five (5) minutes per speaker with a maximum of thirty (30) minutes for items not posted on the current agenda. The council may not discuss these items, but may respond with factual data or policy information, or place the item on a future agenda. Those wishing to speak shall submit a Request Form to the City Secretary. The Work Session is for the purpose of exchanging information regarding public business or policy. No action is taken on Work Session items. Citizen input will not be heard during this portion of the agenda. The Consent Agenda contains items which are routine in nature and will be acted upon in one motion. Items may be removed from this agenda for separate discussion by a Council member. 1 4.2 Consider approving an ordinance budget amendment to supplement the approved Fiscal Year 2025-26 Community Development Corporation (CDC) Fund and Parks Improvement Fund budgets in the amount of $80,000.00 for the repair of the water well at the Athletic Club. (Lehmann) 5.0 REGULAR AGENDA ITEMS 5.1 Conduct a public hearing discuss and consider an ordinance regarding amendments to Planned Development 30 (PD-30) to modify Exhibit B "PD-30 Development Regulations" for the mixed commercial development "Gateway Centre North." The subject site contains approximately 6.5 acres and is located at the southeast intersection of Standridge Drive and Memorial Drive within Planned Development 30 (PD-30). (Williams) 5.2 Discuss and consider approving a resolution authorizing the City Manager to execute a Construction Services Contract in the amount of $505,287.21 with DFW Concrete Pros LLC for the Carr Street Concrete Pavement Repair project. (Hartline) 5.3 Discuss and consider approving an ordinance authorizing an exception to the Code of Ordinances Section, 6-192, (a) & (b) to allow fireworks at 10:40 p.m. on July 3, 2026 at Grandscape Lifestyle Center, 5752 Grandscape Boulevard. Mayor Richard Boyer recognized Fire Chief Scott Thompson for his years of service. Fire Chief Scott Thompson accepted the proclamation. 1.6 Recognition of retiring Fire Chief Scott Thompson by Texas State Representative Jared Patterson. RESOLUTION NO. 2026-032 5.0 REGULAR AGENDA ITEMS 5.1 Conduct a public hearing, discuss and consider an ordinance adopting the Standards of Care Policy for day camp programs. ORDINANCE NO. 2026-2647 10 City Council – Regular Meeting Agenda May 19, 2026 Page| 3 5.2 Discuss and consider approving a resolution authorizing the City Manager to execute a Professional Services Agreement with Parkhill for design services for the Police Department and Court Facilities Renovation in an amount not to exceed $159,500.00. RESOLUTION NO. 2026-033 5.3 Discuss and consider an ordinance amending the Code of Ordinances Article V related to motor-assisted scooters, electronic bicycles and pocket-bikes. Police Chief Phillip Foxall presented the proposed ordinance to council. Steve Carpenter, 8204 Lindsey Gardens, spoke in favor of the adoption of the ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. INCORPORATION OF PREMISES. That the above and foregoing premises are incorporated into the body of this Ordinance as if copied herein in their entirety. SECTION 2. AMENDMENT AND ADOPTION. That the General Administration Fund budget for the fiscal year ending September 30, 2026, heretofore previously adopted by Ordinance No. 2025-2619 duly enacted by the City Council of the City of The Colony, Texas, on September 2, 2025, be and is hereby amended as set forth herein, which amendment is hereby, in all respects, finally approved and adopted as so changed; and the same shall be hereby filed with the City Secretary of the City of The Colony. 15 2 SECTION 3. BUDGET AMENDMENT. That the City Council of the City of The Colony, Texas, finds and determines that $80,000.00 shall be transferred from the 605 Fund to Fund 825 for CIP project funding for the repair of the water well at the Athletic Club. SECTION 4. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of The City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance, since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5. SAVINGS CLAUSE. All rights and remedies of the City of The Colony, Texas, are expressly saved as to any and all violations of the provisions of any Ordinances affecting budgets, budget approval or adoption, which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 6. EFFECTIVE DATE This Ordinance shall be in full force and effect from and after its date of passage. The subject site contains approximately 6.5 acres and is located at the southeast intersection of Standridge Drive and Memorial Drive within Planned Development 30 (PD-30). OWNER/APPLICANT Owner: Addison Wilson Dallas, TX Standridge 121 LTD Applicant: Dayton Macatee Dallas, TX Macatee Engineering LLC EXISTING CONDITION OF PROPERTY Planned Development 30 is an approximately 6.5-acre zoning district bound by SH 121 to the South, Memorial Drive to the North, Standridge Drive to the West and Market Street to the East. The Planned Development is divided into Tracts A and B, with land uses permitted within the Light Commercial (LC) zoning district. The area is undeveloped at this time. BACKGROUND Planned Development 30 (PD-30) was approved by the City Council in February of 2025. The established planned development curated the development standards to accommodate an auto painting and body shop within Tract A, The City Council approved the site plan for Stuart’s Paint and Body in February of 2025. Currently in review is a site plan regarding a mixed-use building to be located within Tract B. PROPOSED REQUEST The proposed amendment reflects an update to the Exhibit B Development Regulations regarding the design standards within Tracts A and B. Specifically, the applicant is proposing the addition of the following standards within Exhibit B: 1. Architectural: Overhead doors are allowed along the front façade or facing a public right- of-way provided they are required as an integral part of normal business operations. 2. Parking and Circulation: Cross access between tracts along Memorial Drive is not required. The allowance of overhead doors along the front façade is reflected in the established development regulations, however it is specified to only apply to Tract A and the proposed amendment intends to include Tract B. The existing Conformance and screening standards will remain unchanged and are applicable to all establishments within PD-30. PRIOR ACTION - On May 12, 2026 The Colony's Planning and Zoning Commission approved [4-2] the request of the Planned Development Amendment to modify Exhibit B “PD-30 Development Regulations” for the mixed commercial development “Gateway Centre North”. 19 NOTIFICATION The Zoning Ordinance requires newspaper notification a minimum of fifteen days prior to the City Council meeting for text amendments. Notice for this Public Hearing was published in The Dallas Morning News on May 16th, 2026. In addition, Zoning Ordinance also requires notification of property owners located within 200 feet of the subject property a minimum of fifteen days prior to the public hearing. Public Hearing notices were mailed on May 16th, 2026 to adjacent property owners. No comments either for or against the Planned Development Amendment were received as of printing of this packet. WHEREAS, the property described on Exhibit "A" is currently zoned planned development 30 (PD-30); and WHEREAS, the City Council approved the Planned Development zoning for PD-30 on February 4, 2025 by adopting Ordinance No. 2025-2591, and WHEREAS, the applicant has made a request to amend PD-30 to apply development standards to the development plan as reflected on Exhibit "B" 6.5-acre tract of land described on the attached Exhibit "A" and known as Gateway Centre North; and WHEREAS, after discussion and consideration, the City Council has determined that the revised development standards on Exhibit "B" and updated conceptual development plan reflected on Exhibit “C” should be approved. The site layout representations in Exhibit “C” are conceptual; minor aspects of Exhibit “C” may be subject to change during the site plan review process. Major or substantial changes may require Concept Plan amendment. A site plan review shall be in accordance with Section 10, Section 13, Section 17, Section 21 and Section 24 of the Code of Ordinances. In conditions where the PD is silent the Gateway Overlay District standards shall be considered. The regulations described herein apply to the entirely of property described in Exhibit “A”. Robert Kotasek checked the references provided and indicated that he had spoken with Robby Wallace with the City of Roanoke who indicated that he had no hesitation in recommending DFW Concrete Pros, LLC for future projects. Based on the information provided and after speaking with management at DFW Concrete Pros, LLC., Mr. Kotasek recommends approval of the contract with this company.
