TO ALL INTERESTED PERSONS
Notice is hereby given of a REGULAR SESSION of the CITY COUNCIL of the City of The Colony,
Texas to be held at 6:30 PM on WEDNESDAY, MARCH 4, 2026 at CITY HALL, 6053 MAIN
STREET, at which time the following items will be addressed:
This portion of the meeting is to allow up to five (5) minutes per speaker with a maximum of
thirty (30) minutes for items not posted on the current agenda. The council may not discuss these
items, but may respond with factual data or policy information, or place the item on a future
agenda. Those wishing to speak shall submit a Request Form to the City Secretary.
The Work Session is for the purpose of exchanging information regarding public business or
policy. No action is taken on Work Session items. Citizen input will not be heard during this
portion of the agenda.
The Consent Agenda contains items which are routine in nature and will be acted upon in one
motion. Items may be removed from this agenda for separate discussion by a Council member.

EXECUTIVE SESSION NOTICE
Pursuant to the Texas Open Meeting Act, Government Code Chapter 551 one or more of the
above items may be considered in executive session closed to the public, including but not
limited to consultation with attorney pursuant to Texas Government Code Section 551.071
arising out of the attorney's ethical duty to advise the city concerning legal issues arising from
an agenda item. Any decision held on such matter will be taken or conducted in open session
following the conclusion of the executive session.

If you wish to address the City Council in person, you can do so by attending the meeting at City
Hall. If you wish to have comments added to the council minutes about issues on the Agenda,
you may submit those comments to the City Secretary Office via email or on the city website.

3.0 WORK SESSION
3.1 Receive presentation, discuss and provide direction to staff on a proposal from
Schneider Electric to perform an energy audit on the city's facilities and the use of
potential savings to fund energy improvements.
Assistant City Manager Tim Miller provided an introduction of Brain and Charlie
Davis and Paige Bleakley with Schneider Electric.
Council provided direction to staff to move forward and advised council to contact
Assistant City Manager Tim Miller with additional questions.
3.2 Receive a presentation from the Police Department regarding a community survey
to be utilized to prepare a 5-Year Strategic Plan.
Police Chief Phillip Foxall presented the item to council.
3.3 Receive a presentation from the Police Department regarding the 2025 Annual
Report.

4.4 Consider accepting the 2025 Racial Profiling Report and 2025 Racial Profiling
Analysis submitted to the Texas Commission on Law Enforcement (TCOLE).
4.5 Consider approving a resolution authorizing the City Manager to execute a
construction services contract in the amount of $350,000.00 with Kaitlin Kent
Enterprises, Inc. utilizing TIPS cooperative contract #23010401 for roadway lifting
services at various locations throughout the city.

5.0 REGULAR AGENDA ITEMS
5.1 Discuss and consider an ordinance regarding the Site Plan application of
"Jefferson Grandscape II", an approximately 277-unit multi-family development on
approximately 3.804 acres. The subject site is located on Lot 2R, Block A, being
south of Nebraska Furniture Mart Drive approximately 700 feet east of Bargain
Way in the NFM-Grandscape Planned Development (PD-25).
Planning Director Isaac Williams presented the proposed ordinance to council.

5.2 Discuss and consider an ordinance regarding the Site Plan application of "White
Castle," an approximately 3,430 sq. ft. restaurant with drive -thru service. The
subject site contains approximately 1.64 acres, located at the intersection of
Destination Drive and Grandscape Boulevard in the NFM-Grandscape Planned
Development (PD-25).

Main Street Parking Lot", for the development of a 35 space parking lot to serve
an existing 4,800 sq.ft Medical Office Building at 7204 Main Street, The subject
site contains .60 acres (26,019 sq.ft) and is located at 7204 Main Street within the
General Retail (GR) Zoning District and Gateway Overlay District.

5.5 Discuss and consider approving a resolution authorizing publication of notice of

Finance Director Ryan Bredehoeft presented the proposed resolution to council.

Councilmember, motion carried with all ayes with the exception of Robyn Holtz,
Deputy Mayor Pro Tem abstaining on the vote.

Consider approving a resolution authorizing the City Manager to execute a Network Node Installation
and Pole Attachment Agreement in Commercial Areas with SQF, LLC. (Hartline)
Background:
Background: The Texas Legislature approved Senate Bill 1004 in 2017 relating to the installation of
wireless network nodes and node supporting poles within city right-of-way. The Bill established the fees
that the city can charge for the deployment of network nodes and poles in the city right-of-way in
commercial areas. The Bill also regulates design criteria, physical use and maintenance requirements for
wireless network providers to locate in city right-of-ways. Following approval of this Senate Bill, the city
changed Chapter 18 of the Code of Ordinance by adding Section VI, Sections 18-100 to 18-123 to allow
the city to comply with Texas Senate Bill 1004 and set standards, fees and design criteria for companies
that plan to install wireless nodes in our city right-of-way. This ordinance change was implemented to
facilitate regulating design criteria, physical use, occupancy, and maintenance requirements for network
providers in the city. The Ordinance also requires that service providers comply with the City of The
Colony Small Cell Node Design Manual and also provides city procedures for the application of permits
and provides applicable fees and annual public right-of-way rental rates. Purpose: To provide better T-
Mobile cellular service to our citizens, SQF, LLC is requesting permission to install three (3) Network
Node Poles within our city right-of-way at the locations shown on the attached Location Maps. These
Network Node poles will provide service for T-Mobile at each location. Engineering has reviewed these
locations and has worked with SQF, LLC to locate the Cell Node Poles in the areas shown to help
minimize pole visibility and facilitate better cellular service in these areas.

RESOLUTION NO. 2026- _____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE
A NETWORK NODES INSTALLATION AND POLE ATTACHMENT
AGREEMENT IN COMMERCIAL AREAS WITH SQF, LLC, AND
PROVIDING AN IMMEDIATE EFFECTIVE DATE
WHEREAS, the City of The Colony, Texas, a Texas home-rule municipality
(hereinafter referred to as the “City”) owns certain public rights-of-way with service and or
utility poles within its municipal territorial limits; and
WHEREAS, the SQF, LLC, is a wireless telecommunications network provider as
that term is defined in Section 284.002 of the Texas Local Government Code (the “Code”);
and
WHEREAS, the SQF, LLC, desires to install new network nodes, network support
poles in the City right of way or attach certain network nodes, as that term is defined in
Section 284.002 of the Texas Local Government Code, on City -owned service poles
and/or utility poles within the City; and
WHEREAS, the SQF, LLC, and the City desire to enter into this Agreement to
secure authority from the City for the network provider to install network nodes, node
support poles in the right of way of the City, and certain network nodes on such City poles,
subject to the City’s wireless services (small cell) design manual for the installation of
network nodes and node support poles (“the Design Manual”) and the City’s Right -of-Way
Management Ordinance; and
WHEREAS, this Agreement is entered into pursuant to Chapter 284 of the Texas
Local Government Code, in order to address the desires of the network provider and the
procedures of the City of The Colony, Texas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1. The findings set forth above are incorporated into the body of this
Resolution as if fully set forth herein.
Section 2. The City Manager of the City of The Colony, Texas, is hereby
authorized a nd empowered to execute the Network Nodes Installation and Pole
Attachment Agreement by and between the City of The Colony, Texas, and SQF, LLC,
a copy of which is attached hereto as Exhibit A, and is incorporated herein for all
purposes.
Section 3. This Resolution shall take effect immediately from and after its
adoption and it is so resolved.

INTERLOCAL AGREEMENT BY AND BETWEEN
THE CITY OF PLANO, TEXAS AND THE CITY OF THE COLONY, TEXAS
FOR RECIPROCAL LENDING OF LIBRARY MATERIALS
THIS AGREEMENT (“Agreement”) is made and entered by and between the CITY OF
PLANO (“Plano”), a Texas home-rule municipal corporation, and the CITY OF THE COLONY
(“The Colony”) together with Plano referred to as the “Parties” and individually as “Party”, a Texas
home rule municipal corporation, as follows:
RECITALS
WHEREAS, this agreement is made under the authority of the Interlocal Cooperation Act,
Texas Government Code, Chapter 791, as amended (the “Act”); and
WHEREAS, Plano and The Colony are both local governments, as defined by Section
791.003(a) of the Act, engaged in the provision of governmental functions and services to their
citizens; and
WHEREAS, the Plano Public Library System and The Colony Public Library System
desire to cooperate in a program involving the reciprocal lending of library materials for mutual
advantage in the best interest of their patrons; and
WHEREAS, Plano and The Colony have current revenues available to satisfy the fees
and expenses incurred pursuant to this Agreement; and
NOW THEREFORE, the Parties in consideration of the recitals set forth above and terms
and conditions below, agree as follows:
I.
TERM
The term of this Agreement is for a period of one (1) year beginning April 1, 2026, and
ending April 1, 2027. After the initial term, this Agreement shall automatically renew for successive
five (5) one-year terms unless otherwise terminated by either party as provided in Section IV.
TERMINATION herein.
II.
OBLIGATIONS OF THE PARTIES
1. The terms of this Agreement are as follows:
a. The term RECIPROCAL LENDING as used herein means and refers to the privileges
which both parties mutually agree to extend to individuals who are residents or
taxpayers (“taxpayer”) of the other party’s municipality. Said RECIPROCAL LENDING
privileges result in the issuance of a library card by either party to an individual
taxpayer of the other party’s municipality upon application by such person. The cards
thus issued shall be subject to the general rules and regulations of the issuing party
with respect to its borrowers, it being the intention of the parties that qualified patrons
of each district during the term of the Agreement may have the same borrowing
privileges afforded to the other municipality’s taxpayers, wherever practical.

b. The term TRANSACTION as used herein means and refers to each and every
separate library item which is loaned by one party to a patron of the other party’s
municipality at such patron’s personal request in accordance with the RECIPROCAL
LENDING privileges as defined in paragraph 1(a) of this Agreement.
2. The Plano Public Library and The Colony Public Library shall mutually accord to individual
taxpayers of each party RECIPROCAL LENDING privileges as defined in paragraph 1(a) with
the following exceptions:
a. The Colony residents would not be entitled to Interlibrary Loan (ILL) services by Plano
and Plano residents outside of Denton Co would not be provided ILL service from The
Colony.
b. Reciprocal cards will not entitle a Plano cardholder outside of Denton County to check
out Library of Things equipment, including mobile hotspots, or to apply for a TexShare
card.
3. In order to provide RECIPROCAL LENDING privileges, each party shall cause a library card
to be issued to an individual taxpayer of the other party’s municipality upon application by
such person, providing such person agrees to abide by and adhere to the rules and
regulations of the issuing party.
III.
FEES AND PAYMENTS DUE
Each library system will bear its own cost of performing under this Agreement. All
payments for expenses incurred as a result of the performance of this Agreement shall be made
only from current revenues legally available to each respective party. Any renewal will be subject
to the revenues available for that Agreement term.
IV.
TERMINATION
Either party to this Agreement may, without stating any cause or justification, terminate
this Agreement by giving written notice to the other party sixty (60) days in advance of the
termination date selected. In such case, a final report and reconciliation called for by this
Agreement shall be rendered notwithstanding any termination under this paragraph.
Upon termination pursuant to Section IV. TERMINATION or by reason of the expiration of
the Agreement without renewal, the cards to nonresident patrons issues pursuant to this
Agreement shall expire.
V.
RELEASE AND HOLD HARMLESS
Each party agrees to waive all claims against, to release, and to hold harmless the other
party and its respective officials, officers, agents, employees, in both their public and private
capacities, from any and all liability, claims, suits, demands, losses, damages, attorneys fees,
including all expenses of litigation or settlement, or causes of action which may arise by reason
or injury to death of any person or for loss of, damage to, or loss of use of property arising out of
or in connection with this Agreement. In the event that a claim is filed, each party shall be
responsible for its proportionate share of liability.

VI.
IMMUNITY
In the execution of this Agreement, none of the parties waive, nor shall be deemed hereby
to have waived any immunity or any legal or equitable defense otherwise available against claims
arising in the exercise of governmental powers and functions. By entering this Agreement, the
parties do not create any obligations, express or implied, other than those set forth herein, and
this Agreement does not create any rights in parties who are not signatories to this Agreement.
VII.
ENTIRE AGREEMENT
This Agreement represents the entire an integrated agreement between the City of Plano
and the City of The Colony and supersedes all prior negotiations, representations, or agreements,
wither written or oral. This Agreement may be amended only by written instruments signed by the
City of Plano and the City of The Colony.

AUTHORITY TO SIGN
The undersigned officer and/or agents of the parties hereto are the properly authorized
officials and have the necessary authority to execute this Agreement on behalf of the parties
hereto. The Colony has executed this Agreement pursuant to the authority granted by its
governing body. Plano has executed this Agreement pursuant to duly authorized action of the
Plano City Council.
IX.
SEVERABILITY
The provisions of this Agreement are severable. If any paragraph, section, subdivision,
sentence, clause, or phrase of this Agreement is for any reason held to be contrary to the law or
contrary to any rule or regulation having the force and effect of the law, such decisions shall not
affect the remaining portions of the Agreement. However, upon the occurrence of such an event,
either party may terminate this Agreement by giving the other party thirty (30) days written notice.

X.
VENUE
This Agreement and any of its terms or provisions, as well as the rights and duties of the
parties hereto, shall be governed by the laws of the State of Texas. The parties agree that this
Agreement shall be enforceable in Collin County, Texas, and, if legal action is necessary,
exclusive venue shall lie in Collin County, Texas.
XI.
INTERPRETATION OF AGREEMENT
Although this Agreement is drafted by Plano, this is a negotiated document. Should any
part of this Agreement be in dispute, the parties agree that the Agreement shall not be construed
more favorably for either party.
XII. REMEDIES
No right or remedy granted herein or reserved to the parties is exclusive of any right or
remedy granted by law or equity; but each shall be cumulative of every right or remedy given
hereunder. No covenant or condition of this Agreement may be waived without the express written
consent of the parties. It is further agreed that one (1) or more instances of forbearance by either
party in the exercise of its respected rights under this Agreement shall in no way constitute a
waiver thereof.
XIII. SUCCESSORS AND ASSIGNS
The parties each bind themselves, their respective successors, executors, administrators
and assigns to the other party to this Agreement. Neither party will assign, sublet, subcontract or
transfer any interest in this Agreement without the prior written consent of the other party. No
assignment, delegation of duties or subcontract under this Agreement will be effective without the
written consent of both parties.
XIV.
EFFECTIVE DATE
This Agreement shall be effective from and after the date of execution by the last signatory
hereto as evidenced below.

Background:
The parks and recreation mowing contract, which includes facilities such as City Hall, PD, and
the Recreation Center, as well as streets and parks, expires on April 06, 2026. Issuing a new
contract with Nova Landscape Group would continue these services with no interruption.
Budget:
In the FY 25–26 Parks budget, $279,174.05 was approved for contractual mowing services,
based on the previous contractor pricing. Through the interlocal agreement, we are able to
retain the current scope of work with a reduction in price.

PROPOSAL SPECIFICATIONS
FINISH CUT MOWING - The Colony, Texas

A. GENERAL INFORMATION
Proposal Requirements
1. Proposal to be quoted on a per mowing basis and a contract for a minimum of 24
cycles and a maximum of 36 cycles. The actual number of cycles will be adjusted
based on seasonal environment conditions. Contract payments will be made based
on actual work/cycles completed.
2.The following information shall also be included with the proposal:
-Number of employees: Full time and part time
-Length of time in business
-Physical location of business
-Company telephone number
-A list including contact names and phone numbers of current or past municipal and/or
commercial accounts for which the Contractor has provided landscape maintenance
services that are similar in service level and size as the City’s park and roadway
landscaping.
-Copies of licenses of certified chemical applicators assigned to work under this contract.
3.A complete list of machinery and equipment available in order to determine whether
or not the contractor can adequately perform the necessary work. All equipment the
contractor anticipates committing to this contract, if awarded, should be included in
the listing. Past experience has shown that it is absolutely essential to have
adequate back-up equipment in reserve to allow for breakdowns.
Contractor Requirements
1.Contractor and his/her subcontractors must provide City with proof of insurance and a
W-9.
2.Contractor shall provide a written schedule outlining dates and days of maintenance and
mowing to the City’s representative.

3.Contractor shall assign a qualified supervisor to oversee work performed at the work site
and act as the Contractors liaison with the City’s representative. The supervisor shall
have at least three (3) years of commercial landscape maintenance experience (municipal
experience preferred) and must be able to speak, read, write and understand English.
4.Contractor shall provide sufficient qualified (minimum one (1) year of experience) and
trained personnel capable of meeting these terms and specifications.
5.Since Contractor’s employees will be performing work in a public environment,
employees shall relate to the public in a courteous and professional manner.
6.The Contractor will adhere to the highest quality standards of the landscape profession.
The specifications and standards shall be met by the Contractor at all times regardless of
the Contractor’s employees’ absence or established staffing patterns and levels
7.Contractor must provide the appropriate size and type of maintenance equipment to
perform the activities below. All mowers shall be finish mowers. No rough-cut or brush
hog type mowers will be allowed.
8.The City reserves the right to approve/disapprove maintenance equipment at the site.
B.MOWING, TRIMMING, AND LITTER REMOVAL
9.Scheduled mowing and maintenance shall be performed Monday through Friday of each
work week, unless inclement weather or holidays alter this schedule. All medians and
parkways must be mowed once every seven (7) days with each mowing being completed
on or before the date mowed the previous week. Mowing schedules must be coordinated
and approved in advance with the City’s representative. Any alternate frequency caused
by periods of dry or inclement weather shall be approved by the City’s representative. If
weather prevents mowing (excessive rain or extremely hot and dry conditions),
payment will not be made for that period or the Contractor may be asked to
perform other tasks, including but not limited to: mulching, trimming, planting, or
plant removal.
10.The mowing of specified medians, parkways and other specified landscape areas shall
include the mowing, trimming and stick edging of all landscape and turf within each area
to maintain a well manicured appearance. Poles, signposts, and any other obstacles shall
be trimmed at the same time mowing is performed. Mowing and trimming of areas
adjacent to lakes, creeks ponds and drainage channels shall be mowed or trimmed to the
water’s edge. Clippings created from mowing, weed-eating and stick edging shall be
blown into the turf areas and not left on the curbs, sidewalks, or streets. Generally,
clippings need not be collected and removed from the site after each mowing;
however, excessive clippings resulting from growth rates exceeding the contracted
frequency shall be removed from the site after each mowing and properly disposed of.
Clippings must not be blown into the street when mowing.

3.Vegetation growing in pavement joints at the top and bottom of curbs, gravel ground
cover areas containing decomposed granite or in cracks or seams along other designated
hardscape elements shall be removed manually or trimmed mechanically. If treated
chemically, all resulting dead plant material shall be manually or mechanically removed.
Chemical applications shall be made by a certified chemical applicator. A copy of a
current applicator’s license shall be provided prior to any applications performed to be
kept on file with the City. Herbicide/pesticide application shall be recorded using Texas
Dept. of Agriculture form TDA Q527 and copies of each application forwarded to the
City on a monthly basis, attached to the invoice.
4.All turf grasses shall be cut to a height of 2”. Uneven or rough cutting of grass will not
be permitted. The Contractor must insure that mower blades are kept sharp at all times.
Mowers will also be adjusted and operated so that the grass is cut at a uniform height. At
no time shall it be permissible to raise mowing height unless authorized by the City’s
representative. Contractor shall vary the mowing pattern to avoid creating ruts. The
contractor shall also coordinate the mowing schedule with the irrigation schedule to avoid
ruts or other damage to landscape areas. Mowing of wet, saturated areas during or after
rain and resulting in ruts and turf damage will not be permitted. Contractors personnel
shall notify the City’s representative of wet areas possibly caused by irrigation leaks or
overwatering.
5.All curbs and sidewalks shall be neatly edged after each cutting or as necessary. This
trimming shall include crisp edging of all sidewalks and curbs adjacent to turf and bed
areas in medians, landscaped beds, along retaining walls and fences. All trimming shall
be performed following mowing to ensure complete coverage of all areas.
6.All litter and waste material shall be removed from all maintenance areas by the
contractor prior to mowing leaving the area free of chopped paper and debris.
1.AREAS INCLUDED UNDER THIS CONTRACT
A series of maps are provided with this specification that reflects the general location of areas to
be maintained under this contract. Areages are approximate and should be verified.
Descriptions of the areas included in the plans are to be used as a guideline. The
contractor shall be responsible for verifying all areas to be mowed with the City’s
representative, prior to submitting a proposal. Any questions regarding the areas required

1.Mowing and landscape maintenance services conducted in the roadway center medians
must be performed in a safe manner. This is for the benefit and safety of the Contractor
and the vehicles sharing the road. Whenever maintenance requires additional space,
Contractor will be required to perform traffic-diverting lane closures prior to beginning
any maintenance or repairs in the center median.
2.All lane closures shall comply with TxDot guidelines.
3.All medians and rights-of-way are located on main arterials that experience definite
commute patterns in the morning and afternoon. Lane closures must not interfere with
commute-hour traffic patterns.
4.All lane closures shall be called in first to Chase Townley at 469-263-6570, followed
by The Colony Police Department at 972-625-1887 with the following information:
a.On which road work is being performed.
b.The direction of travel of the lane closure.
c.Provide cross streets at each end of the lane closure for reference.
d.An estimate of how long the lane will be closed.
e.Will the closed lane be open to emergency vehicles.
5.When work is completed and lane closure is removed, the Contractor shall notify
Chase Townley and the Police Dept. that the road has been re-opened to all through
traffic.
6.Contractor shall adhere to all state, federal and local requirements related to the safe
completion of all work. Contractor safety includes the use of TxDot approved safety
vests, signage and other safety related equipment.
7.Contractor shall not park service vehicles in left turn lanes unless done so in a lane
closure situation.

shall be mowed twice per month. A twelve foot (12’) strip adjacent to each side of the
walkway and around the entire amphitheatre and the perimeter shall be mowed and
trimmed on a weekly basis with the regular mowing schedule.
Areas adjacent to creeks, ponds, and drainage channels shall be mowed or trimmed to the
water’s edge wherever possible.
Hawaiian Waters
Includes all islands and medians in parking lot, as well as the top of the drainage
channels, as indicated in the aerial. This will also include Worley drive. Beginning at
Paige Road continuing east to intersection of Worley Dr. and Memorial Drive. A
twelve foot (12’) width along the south right of way. 3.74 acres.
Stewart Creek Park
Beginning at the intersection of Pecan Crossing and North Colony Boulevard, continue
along side of the park entrance road (Sparks Rd.) on each side to the intersection of the
boat ramp access road, and all other areas within the park boundary that are not covered
with heavy brush or trees for an approximately total area of 32.18 acres.
Weather permitting, Stewart Creek Park shall be mowed on Thursdays only;
however, due to special events held at the park and/or holidays, the City’s representative
will coordinate with the Contractor to re-schedule mowing and maintenance operations
for that week accordingly.

Kids Colony Park
Located at 5151 N. Colony Blvd. south of the PD/Recreation Center/Senior Center
parking lot. 5.94 acres.
Mowing and trimming of all areas around and between the playground, splash park,
skate park and basketball court as indicated on the aerial photos.
Aquatic Park
Mowing, edging and trimming of all turf in all turf areas west of the pool building and
area directly east of building between parking lot, drainage channel and building. Also
includes area between fence line and street (N. Colony Blvd) on south side of property.
Also includes one mower width pass on the outside of the chain link fence at the
west property line. 1.86 acres.
Additional Notes:
-Weather permitting, mowing and trimming of turf shall be performed on Thursday
mornings only beginning at 7:00am and completed by 9:00am.
-Any alternate schedule shall be coordinated with and approved by the Aquatic Park
Manager.
-Areas directly in contact with pool decks shall be mowed with equipment that has a
grass catching attachment.
-Areas containing Tif grass shall be mowed with push type mowers at a height of
2", unless otherwise instructed.
- A key is required for entry, and will be supplied at the beginning of the season, to be
returned after the final mow of the season.

1.Fire Station #5 - located at 3985 Lebanon Road.
To include mowing and trimming of areas along the perimeter of the facility,
driveway south of the station, the right of way, and medians in front of the station.

2.Police Department and Recreation Center - located at 5151 N. Colony Blvd.
Mowing, edging, and trimming of all turf areas surrounding the Police Dept and
Recreation Center, . Includes mowing and trimming of the enclosed courtyard at
the northeast side of the Recreation Center, and area surrounding the perimeter of
the entire parking lot adjacent to the Jail. The east side of the police department is
gated access and will require a card, to be provided at the beginning of the season
and returned after the final mow of the season. Acreage included in Kids Colony

Mowing, edging, and trimming of all turf areas surrounding City
Hall. Includes mowing and trimming of the full perimeter of the
facility including frontage areas on 423. Area should be mowed,
trimmed, and free of debris.
8.Government Center - located at 6301 Main Street. 1.81 acres.
Includes mowing and trimming of the full perimeter of
the facility, including secondary building located in the east end
of the parking lot and all frontage areas on 423 (as
notated on map). Area should be mowed, trimmed, and free
of debris. 1.5 acres.
2.GENERAL MAINTENANCE AND CLEAN-UP
1.Clippings and trimmings shall be blown from paved surfaces back onto the
adjacent turf areas. Excessive debris, clippings, and trimmings shall be removed
from the site.
2.Contract shall include removing all litter and debris in all landscaped areas of the
project during weekly maintenance operations.
3.Regular communication with “City Representative” to advise of any problems
related to overall maintenance of landscape areas is required.
3. REPAIRS TO EXISTING FACILITIES
1. All portions of existing structures or facilities, including irrigation systems, which
are damaged or altered as a result of the performance of work under this
specification during the term of the contract, shall be repaired or replaced in kind in
an approved manner. All work of this kind shall be performed at the expense of the
contractor as directed by the Parks & Recreation Department. Any repairs necessary
shall be made immediately after the damage occurs. A comprehensive check of all

structures and irrigation systems shall be made approximately thirty (30) days prior
to the end of the contract period and any repairs deemed the responsibility of the
contractor, shall be made by the contractor prior to the end of the contract. Any
repairs not made by the contractor to the satisfaction of the Parks & Recreation
Department shall be deducted from the contractor’s final payment in the amount to
cover the cost of repairs.
2.Damage to trees, landscaping, irrigation systems, structures and other components as
a result of vehicular traffic, vandalism, weather or any other means not related to
work performed by the contractor as well as unusually wet areas possibly caused by
leaking irrigation systems shall be reported immediately upon discovery to the City’s
Representative.
4.INVOICING FOR WORK PERFORMED
1.All invoices shall show the contractor’s full name and billing address, the beginning and
ending date of the invoicing period, the project name, the description of worked performed
and the PO number. Work will be inspected on a weekly basis, to insure proper
invoicing. Invoices shall be delivered monthly to the following email addresses:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS, AUTHORIZING THE CITY MANAGER TO AWARD A CONTRACT TO
NOVA LANDSCAPE GROUP FOR MOWING SERVICES; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, That the City Council of the City of The Colony, Texas hereby
authorizes the City Manager to execute a contract with Nova Landscape Group for annual
mowing services; and
WHEREAS, with this contract, the City of The Colony is agreeing to the
services not to exceed the amount of $241,718.40.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1. The Contract, having been reviewed by the City Council of the City
of The Colony, Texas, and found to be acceptable and in the best interest of the City and its
citizens, be, and the same is hereby, in all things approved.
Section 2. The City Manager is hereby authorized to execute the contract on
behalf of the City of The Colony, Texas, with the terms and conditions stated therein.
Section 3. This Resolution shall take effect immediately from and after its
adoption and it is so resolved.

WHEREAS, That the City Council of the City of The Colony, Texas hereby
authorizes the City Manager to execute a contract with Whirlix Design Inc., for Perryman
Park playground replacement; and
WHEREAS, with this contract, the City of The Colony is agreeing to the
services not to exceed the amount of $482,727.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1. The Contract, having been reviewed by the City Council of the City

THIRD AMENDMENT
TO
LOBBYIST AGREEMENT
This THIRD AMENDMENT TO LOBBYIST AGREEMENT (hereinafter referred to
as the “First Amendment”) is made and entered into by and between the CITY OF THE
COLONY, TEXAS, a Texas home-rule municipality (hereinafter referred to as the “City”); and
DESK 138, LLC, a Texas limited liability company (hereinafter referred to as the “Desk 138”):
RECITALS:
WHEREAS, the City and Desk 138 previously entered into a Lobbyist Agreement which
has a term expiring on September 30, 2025 (hereinafter referred to as the “Original Agreement”);
and
WHEREAS, the City and Desk 138 entered into a First Amendment to Lobbyist
Agreement extending the term of the Original Agreement through December 31, 2025; and
WHEREAS, the City and Desk 138 entered into a Second Amendment to Lobbyist
Agreement extending the term of the Original Agreement through March 31, 2026; and
WHEREAS, the City and Desk 138 desire to extend the term of the agreement for another
six (6) months.
NOW, THEREFORE, for and in consideration of the agreements contained herein, and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the City and Desk 138 agree as follows:
SECTION 1. FINDINGS INCORPORATED.
The foregoing recitals are hereby incorporated into the body of this First Amendment and
shall be considered part of the mutual covenants, consideration and promises that bind the parties.
SECTION 2. AMENDMENT TO ORIGINAL AGREEMENT.
(a) Amendment to Original Agreement. That Section 3 of the Original Agreement is hereby
amended to read as follows:
“(3) TERM OF AGREEMENT
The term of this Agreement shall commence on October 1, 2024, and shall continue in full
force until September 30, 2026. This Agreement may be renewed by Client for an
additional period(s) upon the written mutual agreement of both parties. Either party may
terminate the Agreement for any reason, or for no reason, on 60-days’ notice to the other
party. Services shall be pro-rated through the date of termination.”

SECTION 3. MISCELLANEOUS PROVISIONS.
The following miscellaneous provisions are a part of this Third Amendment:
(a) Amendments. This Third Amendment constitutes the entire understanding and agreement
of the parties as to the matters set forth in this Third Amendment. No alteration of or
amendment to this Third Amendment shall be effective unless given in writing and signed
by the party or parties sought to be charged or bound by the alteration or amendment.
(b) Assignment. This Third Amendment may not be assigned without the express written
consent of the other party.
(c) Counterparts. This Third Amendment may be executed in one or more counterparts, each
of which shall be deemed an original and all of which shall constitute one and the same
document.
(d) Effective Date. The effective date (the “Effective Date”) of this Third Amendment shall
be the date of the latter to execute this Third Amendment by and between the City and
Desk 138.
(e) Original Agreement and any Amendments. All of the terms, conditions, and obligations
of the Original Agreement, and any amendments remain in full force and effect except
where specifically modified by this Third Amendment.
(f) Severability. The provisions of this Third Amendment are severable. If any paragraph,
section, subdivision, sentence, clause, or phrase of this Third Amendment is for any reason
held by a court of competent jurisdiction to be contrary to law or contrary to any rule or
regulation have the force and effect of the law, the remaining portions of the Third
Amendment shall be enforced as if the invalid provision had never been included.
(g) Time is of the Essence. Time is of the essence in the performance of this Third
Amendment.

Background:
This is a continuation of a previous work session item from the 2/18/26 council meeting. Schneider
electric has done a preliminary electrical efficiency analysis on a majority the city's facilities and believes
there could be savings with electric upgrades/improvements/replacements that would either wholly or
partially pay for themselves. Currently, the city is under no agreement with Schneider to continue but at
this point the next step of the process is to do a detailed analysis with operational and financial
recommendations. The cost of the study is $50k and the fee is waived if the city elects to do any portion
of the recommendations, it is only charged to recoup the costs of the analysis in the case the city elects
not to move forward with any of the recommendations. If approved, the study should start within 30 days
of document signing. The study is an unexpected but intriguing item so it was moved forward even
though there is no budget for it this year. If the Council elects to move forward, the project budget will
become a part of this process and could potentially be included in the recommended projects and
subsequent savings.

INVESTMENT GRADE AUDIT AGREEMENT
This Investment Grade Audit Agreement (“Agreement”), dated January 20, 2026 (“Effective Date”), is
entered into by and between Schneider Electric Buildings Americas, Inc. (“ESCO”) and City of The Colony,
TX (“Customer”).
WHEREAS, Customer wishes to engage ESCO to perform an Investment Grade Audit to (i) identify energy
conservation measures (“ECMs”) that are available to and appropriate for Customer’s facilities, (ii)
determine the guaranteed savings that would result from implementing such ECMs as part of a
comprehensive energy conservation improvement program, and (iii) propose a scope of work and project
price for ESCO’s implementation of such ECMs under and pursuant to an Energy and Construction
Services Contract.
NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, ESCO
and Customer hereby agree to the following terms and conditions:

SECTION A: GENERAL TERMS AND CONDITIONS
1. Entire Agreement
This Agreement constitutes the entire understanding between ESCO and Customer and supersedes
all prior oral or written understandings relating to the subject matter herein. This Agreement may not
be amended or modified except by written instrument signed by a duly authorized representative of
each party.
2. Services
As described more fully in Section B, ESCO will conduct an Investment Grade Audit of certain Customer
Facilities (defined below) in order to (i) identify ECMs that are available to and appropriate for such
Facilities, (ii) determine the guaranteed savings that would result from implementing such ECMs as
part of a comprehensive energy conservation improvement program, and (iii) propose a scope of work
and project price for ESCO’s implementation of such ECMs (the “IGA”). Upon conclusion of the IGA,
ESCO will provide Customer with a report describing the scope and results of such IGA (the “IGA
Report”). Customer acknowledges that the IGA is not intended to serve as a comprehensive inspection
of Customer’s Facilities and that, to facilitate the IGA and to assist ESCO in identifying and
recommending ECMs appropriate for Customer’s Facilities, Customer is responsible for providing
ESCO with all such access, knowledge and history as may be relevant to ESCO’s analysis, including,
without limitation, with respect to Customer’s Facilities, systems, and equipment, as well as its
accounting, maintenance, and operation practices.
3. Confidentiality
To the extent allowed by law, neither party shall disclose to others any Confidential Information.
“Confidential Information” shall mean all information or material, whether revealed orally, visually, or in
tangible or electronic form, that is competitively sensitive material not generally known to the public that
relates to the business of a party to this Agreement, or any of their respective interest holders, unless
such information: (i) was already rightfully known and in possession of the receiving party at the time
of disclosure by the disclosing party; or (ii) is in or has or will be entered into the public domain through
no breach of this Agreement or other wrongful act of the receiving party; or (iii) has been rightfully
received by the receiving party from a third party who is not known by the receiving party to be under
obligation of confidentiality to disclosing party and without breach of this Agreement; or (iv) is
independently developed by receiving party without reference to the Confidential Information; or (v) is
approved for release by written authorization from the disclosing party. This confidentiality obligation
shall terminate two (2) years from the date of this Agreement.
4. Insurance
ESCO and Customer shall each maintain insurance coverage, including without limitation, workers’
compensation and employer’s liability at statutory limits and commercial general liability insurance
covering public liability and property damage with limits generally required for its respec tive industry
with not less than $1,000,000 each occurrence, $2,000,000 general aggregate. Such insurance shall
be with reputable and financially responsible carriers authorized to transact business in the state in
which the Facilities are located and the services are being performed with an A.M. Best’s rating of at
least A- VII.
5. Governing Law
This Agreement will be governed, interpreted and construed by, under and in accordance with the laws,
statutes and decisions of the state in which the Facilities are located, without regard to its choice of law
provisions.

6. Ownership of Work Products
All drawings, specifications and other documents and electronic data furnished by ESCO to Customer
under this Agreement (“Work Products”) are deemed to be instruments of service and ESCO shall
retain all ownership and property interest therein, including any copyrights and other intellectual
property rights. Such Work Products are furnished solely for purposes of allowing Customer to evaluate
whether it wishes to execute an Energy and Construction Services Contract with ESCO and, in the
event Customer does enter into an Energy and Construction Services Contract with ESCO, for use in
connection with ESCO’s performance of the proposed Project (defined in Section B below). Work
Products are not intended to be, and shall not be, used or relied upon by Customer or any third party
for designing or performing any portion of the proposed Project, and Work Products may not be shared
with any third parties without the written permission of ESCO, except to the extent required by law.
7. Due Authority of Signatories
Each party represents and warrants that this Agreement constitutes the legal, valid, binding, and
enforceable obligation of such party, and that neither the execution nor performance of this Agreement
violates any law, rule, regulation, or legal duty applicable to such party. Each party further represents
and warrants that the execution of this Agreement is within such party’s legal powers, and that each
individual executing this Agreement on behalf of such party is duly authorized to do so by all necessary
and appropriate action and does so with full legal authority.

SECTION B: AUDIT SERVICES
1. ESCO agrees to provide Customer with the following:
A. An IGA of each of the facilities described under Section C (each, a “Facility”; collectively, the
“Facilities”);
B. An IGA Report setting forth:
i. a list of the ECMs recommended for each Facility;
ii. a description, based upon the information made available to ESCO during the IGA, of how
the recommended ECMs would interact with the existing equipment in the Facilities;
iii. a financial analysis calculating the impact the ECMs would have on annual cash flow;
iv. a utility analysis outlining the impact the ECMS would have on Customer’s utility expenses;
v. a proposed scope of work to be performed by ESCO (the “Project”); and
vi. proposed pricing for ESCO’s performance of the Project, which such pricing will be honored
by ESCO for sixty (60) days following delivery of ESCO’s IGA Report to Customer ; and
C. A draft Energy and Construction Services Contract to be entered into if Customer elects to move
forward with the Project.
2. Customer agrees to provide ESCO with the following:
A. A list of any requirements and/or specifications that Customer expects to be included in and/or
associated with the scope of work;
B. Complete access to the Facilities (including remote network access as appropriate) and to
information concerning the Facilities, including without limitation such Facility access and
information as will enable ESCO to accurately perform an energy efficiency analysis, measure
actual energy use, take equipment inventory, determine operating schedules, and id entify known
operational deficiencies;
C. Access to key personnel to discuss operating requirements;
D. Copies or loans of building plans and other such documents for the purpose of facilitating ESCO’s
understanding of the Facility characteristics and the current sequences of operation; and
E. All other insight, knowledge and history as may be relevant to ESCO’s analysis, particularly with
respect to the operation, maintenance and energy efficiency of the Facilities, as well as disclosure
of all known or suspected deficiencies, defects and malfunctions of or affecting the Facilities or the
systems, components and equipment therein.
3. Payment:
A. Within sixty (60) days of receiving the IGA Report, Customer shall either (i) execute an Energy and
Construction Services Contract with ESCO, or (ii) pay ESCO an exit fee in the amount of $50,000
(the “IGA Exit Fee”), provided, however, that no IGA Exit Fee shall be owed if ESCO is unable to
guarantee annual energy and/or other cost savings that meet or exceed the cost of th e proposed
Project over a term not to exceed 20 years.
B. If Customer does execute an Energy and Construction Services Contract with ESCO, the costs
and expenses incurred by ESCO in the performance of services under this IGA Agreement and in
the development, design and/or engineering of the Project will be included in the “Project Price” to
be paid by Customer under the Energy and Construction Services Contract.

RESOLUTION NO. 2026 - ______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH SCHNEIDER ELECTRIC BUILDINGS AMERICANS INC., TO CONDUCT
AN INVESTMENT GRADE AUDIT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, That the City Council of the City of The Colony, Texas hereby
authorizes the City Manager to execute a contract with Schneider Electric Buildings
Americans Inc., to conduct an investment grade audit; and
WHEREAS, with this contract, the City of The Colony is agreeing to the
services not to exceed the amount of $50,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1. The Contract, having been reviewed by the City Council of the City
of The Colony, Texas, and found to be acceptable and in the best interest of the City and its
citizens, be, and the same is hereby, in all things approved.
Section 2. The City Manager is hereby authorized to execute the contract on
behalf of the City of The Colony, Texas, with the terms and conditions stated therein.
Section 3. This Resolution shall take effect immediately from and after its
adoption and it is so resolved.

183 Linear Feet Lemmon Court, 78 Linear Feet of Lemmons Court alley north of Mayes
Drive, 931 Linear Feet of Keys Drive; and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO AWARD A
CONTRACT TO CI PAVEMENT FOR THE RECONSTRUCTION OF 5,960
LINEAR FEET OF STREETS AND ALLEYS THROUGHOUT THE CITY;
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, That the City Council of the City of The Colony, Texas hereby
authorizes the City Manager to execute a contract with CI Pavement, for the
reconstruction of approximately 5,960 Linear Feet of street and alley as detailed
below: 976 Linear Feet of Sagers Blvd alley west of Squires Drive ending at Sagers
Blvd; 1,191 Linear Feet east of Squires Drive ending at Rice Drive; 1,250 Linear Feet
of Baker Drive alley east of Pettit Street ending at Perrin Street; 1,250 Linear Feet
west from Pettit Street ending at Baker Drive; and the 1 ,293 Linear Feet of the alley
south of Younger Drive from Augusta Street to Keys Drive ; and
WHEREAS, with this contract, the City of The Colony is agreeing to the
services not to exceed the amount of $1,889,781.05.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS, THAT:
Section 1. The Contract, having been reviewed by the City Council of the
City of The Colony, Texas, and found to be acceptable and in the best interest of the City
and its citizens, be, and the same is hereby, in all things approved.
Section 2. The City Manager is hereby authorized to execute the contract
on behalf of the City of The Colony, Texas, with the terms and conditions stated therein.
Section 3. This Resolution shall take effect immediately from and after its
adoption and it is so resolved.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS, AMENDING CHAPTER 6, ARTICLE IX, SECTION 6-205 OF THE CODE
OF ORDINANCES ENTITLED “PENALTY” BY AMENDING THE FINE RANGE
FOR MULITPLE NUISANCE OFFENSES COMMITTED WITHIN A TWELVE (12)
MONTH PERIOD; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of The Colony, Texas, has discussed and
considered such revisions and has determined that it is in the best interest of the City to repeal
the current Chapter 6, Article IX, Section 6-205 entitled “Penalty” to provided for a graduation
penalty provision for multiple offenses committed within any twelve (12) month period.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
SECTION 1. The findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2. That the Code of Ordinances of the City of The Colony, Texas, is hereby
amended by amending Chapter 6, Article IX, Section 6-205, entitled “Penalty,” which shall
read as follows:
“Sec. 6-205. - Penalty.
(a) Any person, firm, corporation or association violating any of the provisions of
this article shall be deemed guilty of a misdemeanor and upon conviction in
the municipal court of the city shall be subject to a fine not to exceed the sum
of $2,000.00 for each offense, and each and every day that the premises shall
remain in a condition in violation of the terms of this article shall constitute a
continuing and separate offense, subject to application of the full penalty
contained herein. This section shall be in addition to and cumulative of the
provisions for the abatement of the nuisance and the charging of the cost of
the same against the owner of the premises by the city.
(b) Notwithstanding the forgoing, the fine range for a third (3rd) or fourth (4th)
offense for violating any of the provisions of this article within a twelve month
period shall be deemed guilty of a misdemeanor and upon conviction in the
municipal court of the city shall be subject to a fine of $500 to $2,000.00 for
each offense.

(c) Notwithstanding the forgoing, the fine range for a fifth (5th) or sixth (6th) offense
for violating any of the provisions of this article within a twelve month period
shall be deemed guilty of a misdemeanor and upon conviction in the
municipal court of the city shall be subject to a fine of $750 to $2,000.00 for
each offense.
(d) Notwithstanding the forgoing, the fine range for a seventh (7th) or more offense
for violating any of the provisions of this article within a twelve month period
shall be deemed guilty of a misdemeanor and upon conviction in the
municipal court of the city shall be subject to a fine of $1000.00 to $2,000.00
for each offense.”
SECTION 3. If any section, article paragraph, sentence, clause, phrase or word in this
Ordinance, or application thereto any persons or circumstances is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity
of the remaining portions of this Ordinance; and the City Council hereby declares it would have
passed such remaining portions of this Ordinance despite such invalidity, which remaining
portions shall remain in full force and effect.
SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this Ordinance be, and the same are hereby amended, repealed,
and all other provisions of the Ordinances of the City not in conflict with the provisions of this
Ordinance shall remain in full force and effect.
SECTION 5. This Ordinance shall become effective immediately upon its passage
and publication as required by law.
