HomeMy WebLinkAboutOrdinance No. 2026-2640CITY OF THE COLONY, TEXAS ORDINANCE NO. 2026 - 2LO40 SITE PLAN - 7204 MAIN STREET PARKING EXPANSION AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING A SITE PLAN APPLICATION FOR "7204 MAIN STREET PARKING EXPANSION," PROVIDING PARKING IMPROVMENTS FOR AN EXSITING MEDICAL OFFICE BUILDING USE, CONTAINING APPROXIMATELY 0.60 ACRES, LOCATED ON LOT 86R, BLOCK A, THE SITE IS LOCATED AT 7204 MAIN STREET, WITHIN THE GENERAL RETAIL (GR) ZONING DISTRICT AND GATEWAY OVERLAY DISTRICT; PROVIDING A REPEALER CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the City Council of the City of The Colony, Texas, in compliance with the laws of the State of Texas, and the Code of Ordinances of the City of The Colony, Texas, have given requisite notices and consideration of the site plan application and related plans, and the City Council of the City of The Colony, Texas, is of the opinion and finds that Site Plan Application No. SP24-0006 for the development of "7204 Main Street Parking Expansion," providing parking improvements, located on an approximately 0.60 acres of land. The subject property is located on Lot 86R, Block A of the Garza Lake Estates addition, an addition to the City of The Colony, Denton County, Texas, and being located at 7204 Main Street, within the General Retail (GR) Zoning District and Gateway Overlay District, should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the City Council of the City of The Colony, Texas, does hereby approve the Site Plan, Landscape Plan, and applicable to the approximately 0.60 acres of Land located on Lot 86R, Block A, of the Garza Lake Estates addition, an addition to the City of The Colony, Denton County, Texas, and being generally located at 7204 Main Street, within the General Retail (GR) Zoning District and Gateway Overlay District, copies of which are attached hereto as ExhibitA of this Ordinance. SECTION 3. That it is hereby declared to be the intention of the City Council of the City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation of this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That any provision of any prior ordinance of the City whether codified or uncodified, which are in conflict with any provision of this Ordinance, are hereby repealed to the extent of the conflict, but all other provisions of the ordinances of the City whether codified or uncodified, which are not in conflict with the provisions of this Ordinance, shall remain in full force and effect. The business, Stonebridge Physical Therapy, has been a successful enterprise and part of the local community. Due to the historic layout of the properties, businesses and parking lots, there is insufficient space on the lot to comfortably accommodate staff and patrons. The business historically had 25 substandard and stacked parking spaces serving the 4,826 square foot building. The owner has explored all avenues to property serve the current operation. From these efforts, the owner was able to acquire the property to the north, 7228 Main Street, to provide room for expansion. Further acquisitions of adjacent lots were pursued but unsuccessful. The site is located in a General Retail zoning district as well as the Gateway Overlay District. This project includes the demolition of approximately 13,000 sf of pavement along with the demolition of an existing building on both tracts. New pavement will be placed for the updated parking lot and will be re -striped to provide 35 total parking spaces, 2 of which shall be ADA accessible. Project will also include the relocation of 2 existing light poles. The existing water meter serving the business was found at the rear of the property within the utility easement. A second water service and meter onsite, which served the building to be demolished, will be converted to an irrigation service and meter. There is an existing 6 -foot wood fence along the rear (east) side of the property. The fence resides on the adjoining property along the eastern face of the 10 -foot utility easement. No improvements are proposed behind the existing structure within the utility easement. Landscape screening is being proposed along the northern edge of the property to separate the businesses. The west side fronting Main Street will utilize landscaping to screen the vehicular parking lot. There is limited space and line of sight considerations limiting the amount of screening possible for the tract. The business utilizes a standard trash cart located at the rear of the property, enclosed in a wooden fenced area out of sight. This trash is serviced by city services on a regular basis without issues. The intent is to maintain this setup. 451 S. With the new parking lot configuration, an additional wall pack is being added along two light poles centered in the parking lot to provide lighting. A lighting plan has been provided illustrating compliance with the standards. The goal of this project is to be in compliance with City of The Colony Engineering Design Manual (2023), Gateway Overlay District Regulations (Code of Ordinances Section 10A), The Colony Comprehensive Plan Updated March 2025 & Subdivision Ordinance (Code of Ordinances Appendix B).
