HomeMy WebLinkAboutOrdinance No. 2026-2639CITY OF THE COLONY, TEXAS ORDINANCE NO. 2026 - ZLa39 SITE PLAN -WHITE CASTLE AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING A SITE PLAN APPLICATION FOR WHITE CASTLE AN APPDXIMATELY 3,430 SQUARE FOOT RESTAURANT WITH DRIVE-THRU SERVICE DEVELOPMENT ON APPROXIMATELY 1.64 ACRES, LOCATED AT THE INTERSECTION OF DESTINATION DRIVE AND GRANDSCAPE BOULEVARD IN THE NFM-GRANDSCAPE PLANNED DEVELOPMENT (PD25); PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the City Council of the City of The Colony, Texas, in compliance with the laws of the State of Texas, and the Code of Ordinances of the City of The Colony, Texas, have given requisite notices and consideration of the site plan application and related plans, and the City Council of the City of The Colony, Texas, is of the opinion and finds that Site Plan Application No. SP25-0005 for "White Castle," an approximately 3,430 square foot restaurant with drive-thru service development on approximately 1.64 acres, located at the intersection of Destination Drive and Grandscape Boulevard in the NFM-Grandscape Planned Development (PD25) should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the City Council of the City of The Colony, Texas, does hereby approve the Site Plan, Landscape Plan, building elevations and photometric plan applicable to the subject area, copies of which are attached hereto as ExhibitA of this Ordinance. SECTION 3. That it is hereby declared to be the intention of the City Council of the City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation of this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That any provision of any prior ordinance of the City whether codified or uncodified, which are in conflict with any provision of this Ordinance, are hereby repealed to the extent of the conflict, but all other provisions of the ordinances of the City whether codified or uncodified, which are not in conflict with the provisions of this Ordinance, shall remain in full force and effect. The site is located on Lot 4, Block E of the Grandscape Addition Phase II to The City of The Colony, Texas. The address is 4520 Destination Drive, The Colony, Texas 75056. The project will also consist of the construction of a ± 3,430 SF Quick Serve Restaurant with a ±464 SF patio within PD -25. The proposed structure is a new one-story new Quick Serve Restaurant with a double drive-thru. There will also be a Dumpster Enclosure in order to comply with the jurisdiction's screening requirements. The construction type is to be VB, fully sprinklered, A-2 use with a total of 98 occupants. The building will contain hood suppression as well as being fully suppressed in accordance with the fire marshal. The proposed structure will be pedestrian, user, and staff friendly and has an occupancy of 98. The site includes external pedestrian connection on both the North and South sides of the property that will connect patrons from Grandscape Boulevard and the alley to the North. The ground floor of the building will include glass doors and windows, with openings that face pedestrian connection paths that stem from the existing public pedestrian path on Grandscape Boulevard and the alley to the North. This design technique is intended to invite pedestrians in to the indoor and outdoor dining areas from the street. The outdoor dining area extends off of the East side of the building and is covered, providing a comfortable dining experience for guests. The mechanical equipment on the roof is screened by a raised parapet which mimics crenellations of a castle. This both shields the equipment from patrons and provides stimulating visual interest to the structure. The castle crenellations are also included on the dumpster enclosure to provide a design language consistent with the White Castle branding and visual interest that departs from a four-sided box. The materials proposed are considerate of PD -25 and The Colony Comprehensive Plan with Dryvit EIFS painted white being the primary building material, accented with painted stripes in the White Castle Branding colors to provide further visual interest. Each fagade is also grounded by a Provia stone veneer watertable. The raised parapet crenellations are capped with white stone caps and metal coping. Signage is shown for reference only and is to be permitted separately. The project scope includes Architecture, Civil Engineering, Landscape Design, Mechanical Engineering, Electrical Engineering, Structural Engineering, and fire suppression.
