ORDINANCE NO. 2026 - 210
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
ABANDONING AN EXISTING APPROXIMATE 152 SQUARE FEET OR
0.003± ACRE RIGHT-OF-WAY IN THE T.D. LUCKETT SURVEY IN THE
CITY OF THE COLONY, DENTON COUNTY, TEXAS, AND BEING
MORE PARTICULARLY DESCRIBED IN EXHIBITS "A" AND
DEPICTED IN PAGE 2 EXHIBIT "B", WHICH ARE ATTACHED
HERETO AND INCORPORATED HEREIN; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of The Colony desires to abandon an existing
right-of-way located in the T.D. LUCKETT Survey, Abstract No. 752 in the City of The
Colony, Texas and more particularly described in Exhibit "A" and depicted in Exhibit "B",
attached hereto and incorporated herein; and
WHEREAS, after discussion and consideration, the City Council finds that the
described Right-of-way serves no public purpose and is no longer needed by the city; and
WHEREAS, the City Council has determined that abandoning the Right-of-way, as
described in Exhibit "A" and as depicted in Exhibit "B", which are attached hereto and
incorporated herein by reference, would be in the best interest of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OFTHECOLONY, TEXAS:
SECTION 1. That the City Council of the City of The Colony, Texas finds and has
determined that the existing approximate 152 square feet or 0.003± acre right-of-way in the T.D.
Luckett Survey, Abstract No. 752, and being more particularly described in Exhibits "A" and
depicted in Exhibit "B", which are attached hereto and incorporated herein, is no longer needed
or necessary for public purposes and should be, and is hereby, abandoned by the City of The
Colony in favor of the property owner.
SECTION 2. That the passage of this ordinance shall constitute acceptance in favor of the
property owner of the property, and a certified copy of the same may be filed in the Deed
Records of Denton County, Texas, to indicate such abandonment.
SECTION 3. That the abandonment provided for herein shall extend only to the public
right, title and interest which the City of The Colony, Texas, may have in and to said Right-of-
way, and shall be construed to extend only to such interests that the governing body of the City
of The Colony, Texas, may legally and lawfully abandon.
SECTION 4. That this ordinance shall take effect immediately from and after its passage
as the law and charter in such cases provide.

LEGAL DESCRIPTION
LEGAL DESCRIPTION
BEING a parcel of land located in the City of the Colony, Denton County, Texas, a part of the T.D.
Luckett Survey, Abstract No.752, and being a portion of the right—of—way of Southern, a fifty foot
wide right--of—way as dedicated by the plat of Chelsea Green at The Tribute, recorded as Document
No. 2024-58, Official Public Records of Denton County, Texas, and being more particularly described as
follows:
COMMENCING at a one—half inch iron rod with yellow cap stamped 'JBI" found at the south corner of
Lot 17, Block A, said Chelsea Green at The Tribute, said point being in the north line of that called
Tract 2-4.241 acre tract of land described in deed to MSW CHELSEA GREEN, L.P., as recorded in
Document Number 2023-12483, Official Public Records of Denton County, Texas, said point also being
in the west right—of—way line of High, a fifty foot wide right—of—way as dedicated by said Chelsea
Green at the Tribute;
THENCE along the north line of said Tract 2-4.241 acre tract and along the south line of said Chelsea
Green at The Tribute, Southeasterly, 62.57 feet following a curve to the left, having a central angle of
71 degrees 41 minutes 59 seconds, a radius of 50.00 feet, a tangent of 36.13 feet, and whose chord
bears South 29 degrees 00 minutes 08 seconds East, 58.57 feet to the POINT OF BEGINNING;
THENCE North 89 degrees 18 minutes 15 seconds East, 27.29 feet to a point for corner;
THENCE Northeasterly, 12.21 feet along a curve to the left, having a central angle of 04 degrees 23
minutes 05 seconds, a radius of 159.50 feet, a tangent of 6.11 feet and whose chord bears North 87
degrees 06 minutes 42 seconds East, 12.20 feet to a point for corner;
THENCE North 84 degrees 55 minutes 09 seconds East, 5.93 feet to a point for comer in the south
right—of—way line of said Southern, said point being in the north line of said Tract 2-4.241 acre tract,
from which said point bears Northeasterly, along the south right—of—way line of said Southern and
along the north line of said Tract 2-4.241 acre tract, 7.59 feet following a curve to the left, having a
central angle of 08 degrees 42 minutes 10 seconds, a radius of 50.00 feet, a tangent of 3.80 feet
and whose chord bears North 56 degrees 47 minutes 08 seconds East, 7.59 feet to a one—half inch
iron rod with yellow cap stamped "JBI" found for comer;
THENCE along the South right—of—way line of said Southern and along the north line of said Tract
2-4.241 acre tract, Southwesterly, 47.13 feet following a curve to the right, having a central angle of
54 degrees 00 minutes 39 seconds, a radius of 50.00 feet, a tangent of 25.48 feet and whose chord
bears South 88 degrees 08 minutes 33 seconds West, 45.41 feet to the POINT OF BEGINNING and
containing 152 square feet or 0.003 acres of land.
