TO ALL INTERESTED PERSONS
Notice is hereby given of a REGULAR SESSION of the CITY COUNCIL of the City of The Colony,
Texas to be held at 6:30 PM o n TUESDAY, FEBRUARY 3, 2026 at CITY HALL, 6053 MAIN
STREET, at which time the following items will be addressed:
This portion of the meeting is to allow up to five (5) minutes per speaker with a maximum of
thirty (30) minutes for items not posted on the current agenda. The council may not discuss these
items, but may respond with factual data or policy information, or place the item on a future
agenda. Those wishing to speak shall submit a Request Form to the City Secretary.
The Work Session is for the purpose of exchanging information regarding public business or
policy. No action is taken on Work Session items. Citizen input will not be heard during this
portion of the agenda.
The Consent Agenda contains items which are routine in nature and will be acted upon in one
motion. Items may be removed from this agenda for separate discussion by a Council member.

4.2 Consider approving an ordinance abandoning an existing 152 square foot Right-of-Way known
as Southern Near High in the T.D. Luckett Survey, Abstract No. 752 in the City of The Colony.

4.3 Consider approving a resolution authorizing the City Manager to award a purchase to Holiday
Chevrolet to purchase two marked police patrol vehicles in the amount not to exceed
$106,928.00 utilizing the Sheriff's Association of Texas Cooperative Contract #25-06-1010.

5.1 Conduct a public hearing, discuss and consider an ordinance regarding amendments to Planned
Development 18 District, aka The Tribute, modifying "Development Regulations for PD-18 and
PD-23," updating the plan illustration, and providing development standards for the "Chelsea
Green Phase II" development, consisting of 14 residential lots and 1 common area. The subject
site is located west of Lebanon Road and south of Southern Lane within Planned Development

5.2 Discuss and consider approving a resolution authorizing the City Manager to execute a contract
with Jurgensen Pump, LLC to replace and install a water well pump for well number 3 in the
estimated amount of $266,733.00, utilizing BuyBoard Contract #770-25. (Whitt/Arthur)
5.3 Discuss and consider approving a resolution authorizing the City Manager to execute a
Construction Services Contract in the amount of $1,296,599.39 with Birdieworks Construction,
LLC for the Sutton Branch Streambank Stabilization Project. (Khan)
6.0 EXECUTIVE SESSION
6.1 A. Council shall convene into a closed executive session pursuant to Sections 551.072 and
551.087 of the Texas Government Code to deliberate regarding purchase, exchange, lease or
value of real property and commercial or financial information the city has received from a
business prospect(s), and to deliberate the offer of a financial or other incentive to a business
prospect(s).

(Chicago, Illinois)—Government Finance Officers Association is pleased to announce that City of The
Colony, Texas received GFOA's Distinguished Budget Presentation Award for its budget.
The award represents a significant achievement by the entity. It reflects the commitment of the governing
body and staff to meeting the highest principles of governmental budgeting. In order to receive the budget
award, the entity had to satisfy nationally recognized guidelines for effective budget presentation. These
guidelines are designed to assess how well an entity's budget serves as:
▪a policy document
▪a financial plan
▪an operations guide
▪a communications device
Budget documents must be rated "proficient" in all four categories, and in the fourteen mandatory criteria
within those categories, to receive the award.
There are over 1,900 participants in the Budget Awards Program. The most recent Budget Award recipients,
along with their corresponding budget documents, are posted quarterly on GFOA's website. Award
recipients have pioneered efforts to improve the quality of budgeting and provide an excellent example for
other governments throughout North America.
Government Finance Officers Association (GFOA) advances excellence in government finance by providing best
practices, professional development, resources, and practical research for more than 25,000 members and the
communities they serve.

The Regular Session of the City Council of the City of The Colony, Texas, was called to
order at 6:30 p.m. on the 20th day of January 2026, at City Hall, 6053 Main Street, The
Colony, Texas, with the following roll call:

1.5 Receive a presentation from the Library announcing the James W. Althaus Volunteer of
the Year Award.
Library Director Megan Charters and Access Services Lead Tammy Beauchamp presented
the Volunteer of the Year Award to Akhil Tumati.
1.6 Items of Community Interest
1.) Mayor Richard Boyer congratulated Councilmember Wade and Jacqueline Egert for
being the winners of the United Way Dancing with Our Stars. This marks the third time the
City of The Colony has won this event.
2.) Assistant City Manager Tim Miller announced to the public bad weather coming in and
that the City is prepared with a response team to address any outages and road conditions
in the community.

purchase to Delta Fire & Safety in the amount of $135,367.75 for the purchase of firefighter
protective gear, utilizing BuyBoard contract #698-23.
Fire Chief Scott Thompson presented the proposed resolution to council.
Council provided discussion on the item.
Motion to approve - Judy Ensweiler, Councilmember; second by Dan Rainey, Councilmember,
motion carried with all ayes.

Background:
To complete the development of PDA25-0001 - Planned Development 18 - Amendment - Chelsea Green
Phase II at The Tribute - a small parcel of Right-of-Way needs to be abandoned by the city. The
abandonment of this ROW will allow the developer complete an additional 14 residential lots and 1
common area for Chelsea Green Phase II and allow all city standards to be met. The subject site is
located west of Lebanon Road and South of Southern Lane within Planned Development 18 (PD-18).

ORDINANCE NO. 2026 - _____
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
ABANDONING AN EXISTING APPROXIMATE 152 SQUARE FEET OR
0.003± ACRE RIGHT-OF-WAY IN THE T.D. LUCKETT SURVEY IN THE
CITY OF THE COLONY, DENTON COUNTY, TEXAS, AND BEING
MORE PARTICULARLY DESCRIBED IN EXHIBITS "A" AND
DEPICTED IN PAGE 2 EXHIBIT "B", WHICH ARE ATTACHED
HERETO AND INCORPORATED HEREIN; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of The Colony desires to abandon an existing
right-of-way located in the T.D. LUCKETT Survey, Abstract No. 752 in the City of The
Colony, Texas and more particularly described in Exhibit "A" and depicted in Exhibit "B",
attached hereto and incorporated herein; and
WHEREAS, after discussion and consideration, the City Council finds that the
described Right-of-way serves no public purpose and is no longer needed by the city; and
WHEREAS, the City Council has determined that abandoning the Right-of-way, as
described in Exhibit "A" and as depicted in Exhibit "B", which are attached hereto and
incorporated herein by reference, would be in the best interest of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OFTHECOLONY, TEXAS:
SECTION 1. That the City Council of the City of The Colony, Texas finds and has
determined that the existing approximate 152 square feet or 0.003± acre right-of-way in the T.D.
Luckett Survey, Abstract No. 752, and being more particularly described in Exhibits ''A" and
depicted in Exhibit "B", which are attached hereto and incorporated herein, is no longer needed
or necessary for public purposes and should be, and is hereby, abandoned by the City of The
Colony in favor of the property owner.
SECTION 2. That the passage of this ordinance shall constitute acceptance in favor of the
property owner of the property, and a certified copy of the same may be filed in the Deed
Records of Denton County, Texas, to indicate such abandonment.
SECTION 3. That the abandonment provided for herein shall extend only to the public
right, title and interest which the City of The Colony, Texas, may have in and to said Right-of-
way, and shall be construed to extend only to such interests that the governing body of the City
of The Colony, Texas, may legally and lawfully abandon.

SECTION 4. That this ordinance shall take effect immediately from and after its passage
as the law and charter in such cases provide.

Background:
This purchase was not a budget item and will be utilized to replace two wrecked marked police vehicles.
The purchase will be through account #100-635-6820. A portion of the purchase will be supplemented by
insurance payments once received. In addition to the vehicles, we will have to upfit each vehicle at
Defender Supply and the cost to upfit will be approximately $63,848.00 and will be paid from the same
general fund account.

Background:
The original resolution was approved during the November 5, 2025 City Council meeting and the grant
application was submitted. The Texas Public Safety Office requested we amend the resolution to add the
name of the Authorized Official (Katelyn Wight) and not just her title. This amended resolution adds Mrs.
Wight's name to the resolution and will be resubmitted with our application. This grant is to purchase and
install ballistic windshields on patrol vehicles. The grant is a reimbursement grant with no city match
required.

Background:
This grant is funded through the Texas General Appropriations Act, Article I for Trusteed Programs within
the Office of the Governor and available to local governments to assist with peace officer mental health
resources and training. The grant will be utilized to fund two projects. The first project is SWORN.AI
which is a proactive tool for our staff to monitor their physiological responses to events and receive tools
and resources proactively to help mitigate the stress and effects of law enforcement work. The second
program is called Checkpoints which is another proactive program to help provide preventive mental
health resources to law enforcement. The grant is a reimbursement grant, so the City would pay for the
product/training up front and then receive reimbursement from the Public Safety Office. There is no city
required match.

EXISTING CONDITION OF PROPERTY
Planned Development 18 and 23 aka The Tribute and The Tribute West PD is predominately
developed as a traditional residential single-family detached community, with accompanying
golf course and other common area amenities.
PRIOR ACTION/REVIEW
On January 13, 2026 the Planning and Zoning Commission recommended (5-0) to approve
Amendments to Planned Development 18 (PD-18) District, aka The Tribute, modifying
“Development Regulations for PD-18 and PD-23,” updating the Plan illustration, and providing
development standards for the “Chelsea Green Phase II” development. The requests consists of
14 residential lots and 1 common area. The subject site is located west of Lebanon Road and
South of Southern Lane within Planned Development 18 (PD-18).
PROPOSED REQUEST
Mathews Southwest (the master developer) has proposed an amendment to establish a residential
area known as Chelsea Green Phase II. The Tribute Planned Development will be modified by
replacing the projected condominium use area to an area of front-loaded single-family detached
residential. Chelsea Green Phase II contains approximately 4.926 acres and is dedicated to the
development of 14 single-family detached homes. Chelsea Green Phase II is the final
development of Chelsea Green which includes a mix of single-family detached homes and
townhomes.
The proposed single-family detached phase II is to be developed with the same development
standards as the existing Chelsea Green single-family of PDA21-0001. The aesthetic
presentation shall follow the masonry requirements applicable to The Lochs and Tullamore
Meadows within the context of the architectural requirements within the Tribute’s overall Design
Review Guidelines. The conceptual layout and delineation of the proposed uses, landscape and
architectural elements are reflected in this amendment.

CHELSEA GREEN – PHASE 2 PD AMENDMENT NARRATIVE
Chelsea Green is a 29.69-acre neighborhood located at the southwest corner of Lebanon Road and
Bridge Lane in The Tribute. Phase 1 of the neighborhood is being developed for 147 townhomes and 17
single family homes. Phase 1 encompasses the north 24.76 acres of the neighborhood. Specific
development standards were created for both home types of as part of the previous rezoning request.
The over-arching zoning for this neighborhood is PD-18.
When the zoning was approved in 2024, the approximate 4.9 acres on the south side of the
neighborhood was intended to be developed with multi-storied condominiums with specific
development standards which were to be determined at a later date. The vision for this phase of the
Chelsea Green neighborhood has changed, resulting in the rezoning request.
This request is to amend the Concept Plan for the approximate 4.9 acres of land on the south side of the
neighborhood to allow 14 single-family homes to be built versus the condominiums. The development
standards established for the single-family homes in Phase 1 will be used for these single-family homes
as well.

SECTION 2. That should any sentence, paragraph, subdivision, clause, phrase, or section
of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not

affect the validity of this ordinance as a whole, or any part or provision thereof other than the part
so decided to be unconstitutional, illegal, or invalid, and shall not affect the validity of the
Comprehensive Zoning Ordinance as a whole.
SECTION 3. That this Planned Development shall be developed and used only in
accordance with the Comprehensive Zoning Ordinance and Ordinance No. 00-1245, PD-18, as
amended.
SECTION 4. That the Zoning Ordinance of the City of The Colony, Texas, as amended,
and all ordinances establishing and amended PD 18, shall remain in full force and effect, save and
except as amended by this ordinance.
SECTION 5. That any person, firm, or corporation violating any of the provisions or
terms of this ordinance shall be subject to the same penalty as provided for in the code of
Ordinances of the City of The Colony, Texas, as heretofore amended, and upon conviction shall
be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense;
and each and every day such violation shall continue shall be deemed to constitute a separate
offense.
SECTION 6. That this ordinance shall take effect immediately from and after its passage
and the publication of its caption, as the law and charter in such cases provide.

Notes to Tables above:
1. Height shall mean the vertical distance of a building measured from the average established grade
at the street line or from the front building line, whichever is higher, to the highest point of the
roof.
2. Lots designed as a 40-foot alley product shall have a minimum garage setback of 18 feet and a
minimum front setback of 14 feet, with porches permitted to encroach into the front yard setback
a maximum of five feet. Temporary visitor parking shall also be accommodated as parallel parking
on the street in front of the home. All other standards for the 40-foot alley product shall be as noted
for Somerset and Westbury above.
3. Chimney and bay window encroachments will be allowed a maximum of two feet into the front
and side yards. Where a minimum five-foot side yard setback is required, side yard encroachments
on common property lines must be separated by a minimum 20-foot clearance between combustible
overhangs and/or walls. The measurement will be parallel to the common property line.

b. All lots shall provide landscape in accordance with the most current Tribute DRG's, as
amended. Required landscaping shall be maintained, inspected, and enforced in accordance
with the current Tribute DRG's, as amended.
i. Yards adjacent to streets shall be turfed with hydromulch or sod.
ii. An acceptable means of soil erosion in the rear and side yards shall be provided.
iii. Landscaping throughout the development shall include the use of similar materials and
products to create a consistent image and level of quality. This will be reflected in
primary entry areas, secondary entry points, amenity centers, and throughout the
development with special identifiers and signage.
14. The following apply for Chelsea Green.
a, The exterior facade of each single-family detached home shall follow the masonry requirements
applicable to The Lochs and Tullamore Meadows.
b. Street trees may be located either within the townhome platted lot or within the adjacent right
of-way, and either location shall satisfy landscape requirements.
c. A single-family detached lot on a curve or a cul-de-sac may be 55 feet in width as long as the lot
area meets the minimum area square footage. A single-family detached lot on a curve or cul-
de-sac may be 95 feet in depth as long as the lot area meets the minimum square footage.
d. Outdoor living areas, whether the area is covered by a roof which is integrated into the house or
not, shall not count towards lot coverage.
e. For a townhome use, there shall be a minimum of one 4-inch caliper tree for every two townhome
lots.
f. For a single family detached use, landscaping shall be provided in accordance with the current

Subject: Paluxy Water Well at 5033 Clover Valley, Pump Station # 1
Funding was approved in October 2025 for the inspection of the well pump, well head, well
casing and screens for the Trinity Well #3, located at 5572 North Colony, Pump Station #3. This
equipment was replaced in 2016 which included the well-head, vertical turbine pump, line shaft
drive and 600 horsepower motor. The motor was again replaced in 2024; at this time no service
is needed on the 2024 motor. The estimated service life for pump equipment is 8 to 10 years.
Since we have reached the 10-year mark, the pump, column pipe, oil tube, well head and
bearings were pulled for inspection in December 2025 and determined to need replacement and
or refurbishment. The labor to rebuild, service and reuse the equipment was higher than the
cost of replacement. It is recommended that new equipment be purchased and installed except
for the wellhead which will be refurbished. The well-casing and screens were inspected and
determined to be in good condition; these can have a lifespan of up to 50 years as they are only
housing the equipment and are not moving parts.
Replacing the pump will bring the well back into peak production and will provide an estimated
150,000,000 gallons of water per year for our system for the next 10 years.

WHEREAS, with this contract, the City of The Colony agrees to the services not to
exceed the amount of $266,733.00.

Services Contract in the amount of $1,296,599.39 with Birdieworks Construction, LLC for the Sutton
Branch Streambank Stabilization Project. (Khan)
Background:
Background: City Council approved funding for the Sutton Branch Streambank Stabilization Project in the
2023-2024 Capital Improvement Project (CIP) budget. Due to heavy rainfall events over the past several
years, streambank erosion has developed on both sides of the channel along Sutton Branch, from the
crossing at Blair Oaks Drive upstream to a point approximately 675 linear feet downstream of Blair Oaks
Drive, within the City's existing variable-width floodway and drainage easement. Some erosion areas
along the stream are very close to adjacent residential properties that could be impacted if the channel is
not stabilized. This project consists of the installation of Armormax matting, Redi-Rock Block wall, tree
protection, tree/shrub removal services, erosion control services, fence installation, hydro mulching
services and remove, haul and dispose of existing rock riprap. The project was designed by Shield
Engineering Group, Inc. and advertised for competitive bidding. Bids were opened on December 15,
2025 and the lowest responsible bidder was Birdieworks Construction, LLC at a cost of $1,296,599.39.
Shield Engineering Group, Inc. analyzed the bid tabulations and checked the references for this
company and recommend approval of the contract with Birdieworks Construction, LLC. Please refer to
the attached Engineering Recommendation Letter for further details. City staff recommends awarding the
construction services contract to Birdieworks Construction, LLC. Pending approval, the project is
anticipated to start construction in March 2026 with an estimated completion in October 2026.

Dear Mr. Khan,
The bid opening for the Sutton Branch Streambank Stabilization project was held at City Hall,
located at 6053 Main Street, The Colony, Texas 75056, on Monday, December 15, 2025. A total
of six bids were received, all of which were complete and accepted as formal bids. The apparent
low bidder is Birdieworks Construction, LLC, with a base bid of $1,296,599.39.
Following a thorough analysis of the project, Shield Engineering recommends awarding the
construction contract for the base bid to the apparent low bidder, Birdieworks Construction, LLC.
Birdieworks Construction, LLC has extensive experience in retaining wall construction and is
recognized as a reputable contractor. Their work includes retaining walls, landscaping,
screening walls, sidewalks, and concrete structures.
In addition, references including RPM xConstruction, LLC, BARTOO Ready Mix, and Club Corp
provided positive feedback regarding both previous and ongoing projects completed with
Birdieworks Construction, LLC.

CITY OF THE COLONY, TEXAS
RESOLUTION NO. 2026 – _______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE
A CONSTRUCTION SERVICES CONTRACT BY AND BETWEEN THE
CITY OF THE COLONY AND BIRDIEWORKS CONSTRUCTION, LLC
FOR THE SUTTON BRANCH STREAMBANK STABILIZATION
PROJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City and Consultant have entered into a Construction Services Contract
for the Sutton Branch Streambank Stabilization Project; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the contract with BIRDIEWORKS CONSTRUCTION, LLC; and
WHEREAS, with this contract, the City of The Colony is agreeing to the services not to
exceed the amount of $1,296,599.39 for such work.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS, THAT:
Section 1. The Construction Services Contract, having been reviewed by the City Council
of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and
its citizens, be, and the same is hereby, in all things approved.
Section 2. The City Manager is hereby authorized to execute the contract on behalf of the
City of The Colony, Texas.
Section 3. This Resolution shall take effect immediately from and after its adoption and
it is so resolved.

COLONY, TEXAS THIS THE 3RD DAY OF FEBRUARY, 2026.
