CITY OF THE COLONY
BOARD OF ADJUSTMENT MEETING
WEDNESDAY, OCTOBER 15, 2025
After determining that a quorum was present, the Board of Adjustment of the City of The Colony, Texas
convened into Regular Session, which was held on Wednesday, October 15, 2025, at 6:30 p.m. in the City
Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following
items were addressed:
Board Members Present: Constance Yahwak, Dean Byers, Christopher Patterson, Kimberly Stillwagon,
Georgiana Bustos,
Board Members Absent: None
Staff Present: Isaac Williams, Planning Director; Keyl Groff, Senior Planner and Alan Lathrom,

1.0 1 CALL REGULAR SESSION TO ORDER
Chair Byers called the Regular Session of the Board of Adjustment meeting to order at 6:30 p.m.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of May 21, 2025 and Se temper 17, 2025 Re alar Session.
Attorney Lathrom advised the chair there must be a motion and a second to approve the minutes.
Member Bustos made a motion to approve the minutes, (Item 2.1) with the, seconded by Member
Paterson. The motion carried (5-0).
3.0
PUBLIC HEARING ITEMS
3.1
SE25-0001— 4710 Lemon Ct —Carport
Conduct a public hearing, discuss, and consider a request for 1) a variance to section IOB-300 (b)
[Standards for carports to residential use] to allow a carport to be located in the side yard where
no carport shall occupy space in the front or side yard and; 2) a Special Exception from Section
l OB -100 (d) [Definitions] to allow a proposed carport containing dimensions of 28 feet by 25
feet, where 24 feet is the longest dimension permitted for a carport The subject site is located at
4701 Lemmon Court within the Single Family 1 SF -4) Zoning District.
Chair Byers read Public Hearing Item 3.1 into record.
Mr. Groff handed out amended exhibits reflecting the carport moved south to a total of five (5) feet. The
new location was presented by the applicant after printing of the packet.
Mr. Groff read the staff report.
Member Paterson had a question regarding item 3.1
He asked if the carport had walls or was enclosed and the height of the structure.
Ms. Ducay responded that the carport is an open structure of 12.5 feet in height.
Member Bustos asked if the only person who could see the new structure was the one neighbor. Staff
indicated that anyone driving the alley would have view of the carport above the fence, as well as people
on Main looking southeast. Staff couldn't find the height of the wall in city files but appears to be either a
sixteen (16) or eighteen (18) feet in height.
Attorney Lathrom stated the carport was 12.5 feet in height.
Member Yahwak asked if the applicant had provided justification for the request.
Staff answered, the applicant had only submitted a financial need for the request.
Chair Byers opened the public hearing at 6:41 pm.
Mary Ruthkowski, resident of 4701 Lemmon Court approached the mic.
She stated the carport was requested to protect her new RV as the vehicle was being damaged in the open
air.
Member Yahwak asked if the RV could be protected by storing the vehicle offsite. Mrs. Ruthkowski
said she could store the RV, but the cost of storing would pay for the structure. She also liked the
convenience of loading the RV at home.
Chair Byers closed the public hearing at 6:45.
Member Bustos made a motion to approve Public Hearing Item 3.1, seconded by Member
Patterson. The motion carried (5-0). The motion was clarified approving the special exception and
variance for item 3.1.
Member Yahwak commented the minutes were approved for September 17th, 2025, however there was
approval for the minutes for May 21St, 2025.
Attorney Lathrom indicated he thought the minutes were approved.
There being no further business to come before the Board, Chair Byers adjourned the Regular Session of
the Board of Adjustment at 6:46 p.m.
