CITY OF THE COLONY
BOARD OF ADJUSTMENT MEETING
WEDNESDAY, MAY 21, 2025
After determining that a quorum was present, the Board of Adjustment of the City of The Colony,
Texas convened into Regular Session, which was held on Wednesday, May 21, 2025 at 6:30 p.m.
in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at
which time the following items were addressed:
Board Members Present: Constance Yahwak, Michelle Potts, Dean Byers, Angel DeLory,
Victor Williams, and Melissa Werner (nonvoting member)
Board Members Absent: None
Staff Present: Allisen Ducay, Planner; Alan Lathrom, Attorney; Ana Alvarado, Deputy City

1.0 1 CALL REGULAR SESSION TO ORDER I
Chair Yahwak called the Regular Session of the Board of Adjustment meeting to order at 6:30
p.m.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of February 19, 2025 Regular Session.
Chair Yahwak read Consent Agenda Item 2.1 into record.
Member Williams made a motion to approve Consent Agenda Item 2.1 with the corrections
specified by Chair Yahwak, seconded by Member Byers. The motion carried (5-0).

PUBLIC HEARING ITEMS
3.1
BOA25-0003 — 4921 Walker Drive — Garage Requirement
Conduct a public hearing, discuss and consider a variance to Section 13-101(f) [Vehicle
Parking -Generally] to allow conversion of a garage where an enclosed, attached or
detached garage of not less than 440 square feet in floor area and with a minimum width
of 20 feet shall be required for all single-family dwelling uses. The subject site is located
at 4921 Walker Drive within the Sin a-Famil -4 Zoning District.
Chair Yahwak read Public Hearing Item 3.1 mto record.
Ms. Ducay presented the staff report.
Chair Yahwak asked how many of the homes on Walker Drive have converted their garages.
Staff responded that from a street view staff observed about five homes.
Chair Yahwak asked how many homes there are on Walker Drive.
Staff responded that the exact number of homes on Walker Drive was not counted, staff observed
the radius of homes surrounding Walker Drive.
Member Byers asked what percentage of homes have converted garages on Walker Drive.

Staff responded that they are unable to give an exact percentage as their observation was based
on prima facie evidence.
Chair Yahwak opened the public hearing at 6:37 pm.
Ms. Diana Bangan, resident at 4816 Graham Court, stated that her parents live next door to the
subject site at 4917 Walker Drive. She stated that they have no objection to the garage
conversion but were wondering how many additional cars there will be and if it would affect the
front street parking.
Staff responded that two site visits were conducted, and they observed adequate parking in the
morning and evening hours. Staff added that the subject site has a widened driveway allowing
additional parking but will let the applicant address the parking at the site in greater detail.
Mr. Collin Clark, resident at 4921 Walker Drive, responded that they have three vehicles that
will be parked in the driveway and one compact car that they would park on the street. He added
that the concrete addition on the driveway allows space for a fourth car and if necessary, they
will push back the fence to allow the fourth car to be parked in the driveway.
Chair Yahwak asked for a further explanation for the garage conversion based on the information
provided in the applicant's narrative.
Mr. Clark responded that the garage being converted into a living space is to ensure that his
family has the support they need for his ankle surgery recovery in Dallas. He added that he was
selected to attend the advanced civil schooling program for Army Officers at UTD. He stated
that the additional living space will allow proper support from his family for his wife and
children as he recovers.
Member Delory asked if the garage is being converted into a living space so family can move in
to help with the children and surgery recovery.
Mr. Clark confirmed that the reason for the conversion is for assistance in caring for his two
children and pointed out his father-in-law is present.
Member Williams asked who the property own is.
Mr. Clark responded that the owner of the property is his father-in-law Apolinar Ramirez.
Chair Yahwak asked if they had a contractor lined up to do the conversion.
Mr. Clark confirmed that they do and added that they had the contractor ready to begin months
ago as they were unaware of the ordinance. He stated that after being made aware of the
ordinance they began the process to request a variance.

Chair Yahwak closed the public hearing at 6:42 pm.
Member Williams made a motion to approve Public Hearing Item 3.1, seconded by
Member Potts. The motion carried (5-0).
There being no further business to come before the Board, Chair Yahwak adjourned the Regular
Session of the Board of Adjustment at 6:43 p.m.
