HomeMy WebLinkAboutResolution No. 99-29 ORIGINAL CITY OF THE COLONY, TEXAS RESOLUTION NO. qq-~,-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPOINTING A CAPITAL IMPROVEMENTS ADVISORY COMMITTEE TO ASSIST THE CITY COUNCIL IN THE DEVELOPMENT OF LAND USE ASSUMPTIONS, A CAPITAL IMPROVEMENTS PLAN AND THE ADOPTION OF IMPACT FEES FOR STORM WATER, DRAINAGE, AND FLOOD CONTROL FACILITIES IN ACCORDANCE WITH CHAPTER 395, TEX. LOC. GOV. CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of The Colony, Texas (the "City"), in accordance with Chapter 395, Tex. Loc. Gov. Code (the "Code"), desires to initiate the process to develop land use assumptions and a capital improvements plan for certain storm water, drainage, and flood control facilities within the City, including the City's extraterritorial jurisdiction, with a view toward adopting impact fees to be charged against new development in order to generate revenue for funding or recouping the costs of such capital improvements or facility expansions necessitated by and attributable to the new development; and WHEREAS, the appointment of a capital improvements advisory committee, as described in Section 395.058 of the Code, is one of the initial steps toward the development of such a capital improvements plan and the adoption of impact fees; and WHEREAS, Section 395.058 of the Code provides that the City Council may appoint, as the capital improvements advisory committee, the following persons: (i) the City Planning and Zoning Commission, (ii) a representative of the real estate, development, or building industry, and (iii) to the extent an impact fee is to be applied in the City's extraterritorial jurisdiction, a representative from the City's extraterritorial jurisdiction. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. Appointment of Capital Improvements Advisory_ CommittecJ A. The City Planning and Zoning Commission is hereby appointed as the Capital Improvements Advisory Committee ("Committee") for purposes of Chapter 395, Tex. Loc. Gov. Code in connection with the adoption by the City of land use assumptions, a capital improvements plan and impact fees for certain storm water, drainage, and flood control facilities. The Planning and Zoning Commission includes an architect who is a member of the building industry. Section 2. Duties of Committee. The Committee shall serve in an advisory capacity to the City Council and shall exercise those powers and perform those duties and obligations set forth in Chapter 395 of the Local Government Code. In connection with its appointment, the Committee is established to: A. Advise and assist the City in adopting land use assumptions; B. Review the capital improvements plan and file written comments; C. Monitor and evaluate implementation of the capital improvements plan; D. File semiannual reports with respect to the progress of the capital improvements plan and report to the City Council any perceived inequities in implementing the plan or imposing a capital impact fee; and E. Advise the City Council of the need to update or revise the land use assumptions, capital improvements plan, and impact fees. Section 3. Procedural Rules. The Committee shall follow the same rules of procedure in the conduct of its meetings as are used by the City's Planning and Zoning Commission. Section 4. .F;ff&Cdi.gp~21~.
