A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE PURCHASE OF SEWER EQUIPMENT; DECLARING AN EMERGENCY; PROVIDING AN EFFECTIVE DATE WHEREAS, the City's sewer equipment is need of extensive repairs or is no longer functional; and WHEREAS, the sewer equipment is used to assist in keeping the sewer lines flushed out, etc. which if not done could result in sewer backups in the residences of the citizens of the City; and WHEREAS, the Council deems the public interest and health to be best served by keeping the sewer lines flushed out; and WHEREAS, an immediate appropriation of money is needed to preserve the property of the city and to protect the public health of the residents of the City pursuant to Section 252.022 (a)(2) of the Texas Local Government Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Council hereby authorizes the City Manager or his designee to proceed with the purchase of a new sewer equipment, at a cost not to exceed $ 27,000.00. SECTION 2. Declaring an Emergency; Effective Date. Failure to keep the sewer lines flushed in order to property safeguard the health and safety and general welfare to the inhabitants of the City of The Colony, Texas creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this resolution become effective from and after the date of its passage and it is accordingly so resolved.
