HomeMy WebLinkAbout05/02/2017 City CouncilMINUTES OF CITY COUNCIL REGULAR SESSION HELD ON MAY 2, 2017 The Regular Session of the City Council of the City of The Colony, Texas, was called to order at 6:36 p.m. on the 2nd day of May, 2017 at City Hall, 6800 Main Street, The Colony, Texas, with the following roll call: Joe McCourry, Mayor Present Kirk Mikulec, Councilmember Present Richard Boyer, Councilmember Present Brian Wade, Councilmember Present David Terre, Councilmember Present Perry Schrag, Mayor Pro -Tem Present Joel Marks, Councilmember Present And with 7 council members present a quorum was established and the following items were addressed: 1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS and PROCLAMATIONS 1.1 Call to Order Mayor McCourry called the meeting to order at 6:36 p.m. 1.2 Invocation Councilman Boyer provided the invocation. 1.3 Pledge of Allegiance to the United States Flag The Pledge of Allegiance to the United States Flag was recited. 1.4 Salute to the Texas Flag Salute to the Texas Flag was recited. 1.5 Proclamation: Motorcycle Safety and Awareness Month Mayor McCourry proclaimed the month of May 2017 as "Motorcycle Safety and Awareness Month. The proclamation was accepted by members of the Six Skulls Motorcycle Group. 1.6 Proclamation: National Bike :Month Mayor McCourry recognized the month of May 2017 as "National Bike Month, the week of May 15-19 as Bike to Work Week, May 19th as Bike to Work Day, and May 10, 2017 as Bike to School Day. The proclamation was accepted by members of the Shawnee Trails Cycling Club. Director of Park and Recreation Department Pam Nelson announced the new Biking Organization in the community. She stated the Senior Center has implemented a Health & Fun in The These items are strictly public service announcements Expressions of thanks, congratulations or condolences, information regarding holiday schedules, honorary recognition of city officials, employees or other citizens, reminders about upcoming events sponsored by the City or other entity that are scheduled to be attended by a city official or city employee. No action will be taken and no direction will be given regarding these items City Council - Regular Meeting Agenda Meeting Date May 2, 2017 - Colony with other events scheduled throughout the month of May and announced upcoming projects the committee will be working on in the future. 1.7 Proclamation: National Police Week 2017 Mayor McCourry proclaimed the week of May 14-20, 2017 as "National Police Week 2017 ". The proclamation was accepted by employees of The Colony Police Department. 1.8 Presentation from the Convention and Visitors Bureau of the new :Mobile Visitor Information Center Director of Communication Diane Baxter presented to Council the new marketing mobile visitor information vehicle. Council recessed at 6:52 p.m. and reconvened back into Regular Session at 6:58 p.m. 1.9 Proclamation: National Travel and Tourism Week May 7-13, 2017 Mayor McCourry proclaimed May 7-13, 2017 as "National Travel and Tourism Week ". The proclamation was accepted by Communications and Tourism Director Diane Baxter and Tourism Specialist Mariko Lanicek. 1.10 Items of Community Interest — - - 1.10.1 Presentation from the Library Director regarding current and upcoming programs, events, and service improvements Library Director Joan Sveinsson presented the upcoming programs, events and service improvements for the Library. Mayor announced early voting has ended for the Lewisville Independent School District. He advised the community to get out and vote on Flection Day set for Saturday May 6, 2017 from 7 a. m. to 7 p.m. 2.0. WORK SESSION 2.1 SI17-0001, Sign Ordinance Revision - Feather Signs: Receive a presentation from staff, discuss, and provide direction on amending the Code of Ordinances, Chapter 6, Article XI entitled "Signs" related to "Feather Signs" Director of Economic Development Keri Samford recommended this item to Council. She stated due to the construction winding down, staff proposes to remove the feather sign revisions from the Code of Ordinance. Mrs. Samford explained the move could begin after May 16th to allow businesses to continue to display signage through the end of December. City Council — Regular Meeting Agenda Meeting Date May 2, 2017 Council provided discussion on this item and advised staff to move forward with the amendments to the ordinance. Staff will present to the Sign Board Committee prior to bringing before City Council at a later date. 2.2 Council to provide direction to staff regarding future agenda items None 3.0 CITIZEN INPUT 1. Gary Rowen spoke on behalf of the Children's Advocacy Center of Denton County. He shared the work of the center and thanked council for their ongoing support. 4) CONSENT AGENDA Motion to approve all items from Consent Agenda- Joel Marks; second by Brian Wade, motion carried with all ayes. 4.1 Consider approving the City Council Regular Session minutes for April 18, 2017 4.2 Consider approving Council expenditures for the month of :March 2017 4.3 Consider approving a resolution authorizing the City Manager to issue a purchase order to Utility Service Co., Inc. for the furnishing and installation of two PAX submersible active mixing system to the :North Colony water tower and The Legends water tower 4.4 Consider approving an ordinance authorizing the City Manager to amend the FY 2016-17 CDC Budget with an increase of $11,000.00 and approve a resolution to execute a contract with Weisinger Inc. in the amount of $56,076 for the Five Star Park Well Pump & Motor Replacement Project 5.0 REGULAR AGENDA ITEMS 5.1 Presentation by Weaver and Tidwell regarding the Comprehensive Annual Financial Report for the 2015-16 Fiscal Year Director of Finance David Cranford introduced John Deburro with Weaver and Tidwell to Council. Mr. Deburro presented the 2015-2016 Fiscal Year Comprehensive Annual Financial Report (CAFR). Councilmember Terre acknowledged Mr. Deburro and city staff for their hard work preparing the financial highlights of the general fund. 5.2 Discuss and consider approving a resolution authorizing the City :Manager to execute an agreement with F&F Concrete for the reconstruction of Sample alley in the amount of $148,079.34 City Council - Regular Meeting Agenda Meeting Date May 2, 2017 Project Management Analyst Evan Groeschel reviewed the proposed resolution to Council. He stated the alley reconstruction was approved for $500, 000 for alley repair as part of the 2016-2017Capital Outlay. Council provided discussion on this item. Motion to approve a resolution authorizing the City Manager to execute an agreement with F&F Concrete for the reconstruction of Sample alley in the amount of $148,079.34 - Perly Schrag; second by Kirk Mikulec, motion carried with all ayes. 5.3 Discuss and consider approving a resolution authorizing the City Manager to execute the purchase and installation of three (3) bay doors with Johnson Equipment Company for Fire Station #3 in the amount of $102,767.00 Environmental Facilities Manager Terry Gilman presented the proposed resolution to Council. Council provided discussion on this item. City Manager Troy Powell thanked Mr. Gilman for has hard work and dedication to the City. Motion to approve a resolution authorizing the City Manager to execute the purchase and installation of three (3) bay doors with Johnson Equipment Company for Fire Station #3 in the amount of $102,767.00- Joel Marks; second by Richard Boyer, motion carried with all ayes Executive Session was convened at 7:48 p.m. 6.0 EXECUTIVE SESSION 6.1 A. Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to seek legal advice from the city attorney regarding 7113 Northpointe Drive issues. B. Council shall convene into a closed executive session pursuant to Section 551.072 of the Texas Government Code to deliberate the purchase, exchange, lease, or value of real property. C. Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to seek legal advice from the city attorney regarding pending or contemplated litigation - Appeal of Brazos Electric Power Cooperative, Inc., PUC Docket No. 45175 and City of The Colony, Texas v. Brazos Electric Power Cooperative, Inc. matter, Cause No. 16-06424-16. D. Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to seek legal advice from the city attorney regarding pending or contemplated litigation - Atlantic Colony City Council — Regular Meeting Agenda Meeting Date May 2, 2017 Venture I, LLC and Atlantic Colony Venture II, LLC v. City of The Colony, Texas, et al., Cause No. 16-02219-442. Regular Session was reconvened at 9:56 p. m. 6.2 A. Any action as a result of executive session regarding 7113 Northpointe Drive. No Action B. Any action as a result of executive session regarding the purchase, exchange, lease, or value of real property. No Action C.
