The Regular Session of the City Council of the City of The Colony, Texas, was called to
order at 6:52 p.m. on the 21st day of March, 2017 at City Hall, 6800 Main Street, The
Colony, Texas, with the following roll call:

were addressed:
1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS and PROCLAMATIONS
1.1 Call to Order - 6:52 p.m.

The Pledge of Allegiance to the United States Flag was recited.
1.4 Salute to the Texas Flag
The Salute to the Texas Flag was recited.
1.5 Recognize Lakeview Middle School students for their recent participation in
the Student Leadership Program.
Director of Community Relations and Programming Joe Perez
introduced students from Lakeview Middle School to Council. He recognized
them for their participation in the Student Leadership program held on February
9, 2017. Mayor McCourry presented the students with Certificates of
Appreciation for their recent participation.
1.6 Items of Community Interest
Special Events Coordinator Lindsey Stansell presented the upcoming events for
the Parks and Recreation Department.

regarding holiday schedules, honorary recognition of city officials, employees or other citizens, reminders about upcoming
events sponsored by the City or other entity that are scheduled to be attended by a city official or city employee. No action

2.0 WORK SESSION

3.0 CITIZEN INPUT
Angel Jones, 4049 Heron Cove Lane, 75056; spoke concerning Lovepacs, a North Texas
Chapter organization that provides free meals to school age children in need. Mrs. Jones
announced Lovepacs upcoming Annual Spring Gala, a "Black & White Banquet" April
7th at 7: 00 P. Mat the Westin Stonebriar Hotel.
4.0 CONSENT AGENDA
Motion to approve all items from the Consent Agenda - Mikulec; second by Wade;
motion passed with all ayes
4.1 Consider approving City Council Regular Session minutes for March 7,
2017.
4.2 Consider approving a resolution authorizing the City Manager to execute a
contract with Z -Floor Co., LTD, for replacement of the gymnasium flooring
at the Recreation Center.

5.0 REGULAR AGENDA ITEMS
5.1 Discuss and consider approving a resolution authorizing the City Manager to
enter into an agreement with Team One Integration, LLC for the design
phase, bidding phase, and SCADA system programming for the Well Site
Electric & PLC Improvements project in the amount of $250,517.
Project Management Analyst Evan Groeschel presented the overall project and
the design phase proposal for the Well Site Electric and PLC Improvements
Project to Council.
Motion to approve a resolution authorizing the City Manager to enter into an
agreement with Team One Integration, LLC for the design phase, bidding phase, and
SCADA system programming for the Well Site Electric and PLC Improvements project
in the amount of $250,517 - Mikulec; second by Wade; motion carried with all ayes

5.2 Discuss and consider approving a resolution authorizing the City Manager to
purchase a Vacuum Excavator from Vermeer- Texas/Louisiana using
BuyBoard #515-16 pricing in the amount of $105,493.00.
Project Management Analyst Evan Groeschel presented the information for the -
purchase of a vacuum trailer to Council.

Motion to approve a resolution authorizing the City Manager to purchase a vacuum
excavator from Vermeer Texas -Louisiana using BuyBoard #515-16 pricing in the
amount of $105,493.00 — Marks, second by Wade; motion carried with all ayes

6.0 EXECUTIVE SESSION
6.1 A. Council shall convene into a closed executive session pursuant to Section
551.071 of the Texas Government Code to seek legal advice from the City
Attorney regarding pending or contemplated litigation — City of The Colony,
Texas v. B.S.A. TX -342, Limited Partnership (Budget Suites of America, TX -
3472), Cause No. 16-09568-442.
B. Council shall convene into a closed executive session pursuant to Section
551.072 of the Texas Government Code to deliberate the purchase, exchange,
lease, or value of real property.
C. Council shall convene into a closed executive session pursuant to Section
551.071 of the Texas Government Code to seek legal advice from the city
attorney regarding pending or contemplated litigation — Atlantic Colony
Venture 1, LLC and Atlantic Colony Venture I1, LLC v. City of The Colony,
Texas, et al., Cause No. 16-02219-442.
D. Council shall convene into a closed executive session pursuant to Section
551.071 of the Texas Government Code to seek legal advice from the city
attorney regarding pending or contemplated litigation — Appeal of Brazos
Electric Power Cooperative, Inc., PUC Docket No. 45175 and City of The
Colony, Texas v. Brazos Electric Power Cooperative, Inc. matter, Cause No.
16-06424-16.
6.2 A. Any action as a result of executive session regarding the pending or
contemplated litigation - City of The Colony, Texas v. B.S.A. TX -342,
