HomeMy WebLinkAbout09/30/2014 City Council September 30,2014 Special Session MEETING MINUTES CITY COUNCIL& COMMUNITY DEVELOPMENT CORPORATION JOINT SPECIAL SESSION HELD ON SEPTEMBER 30,2014 The Joint Special Session of the City Council and the Community Development Corporation of the City of The Colony,Texas,was called to order at 7:01 p.m. on the 30th day of September, 2014, at City Hall, 6800 Main Street, The Colony, Texas,with the following roll call: Joe McCourry Mayor Present Kirk Mikulec Councilmember Absent Richard Boyer Councilmember Present Jeff Connelly Councilmember Present David Terre Mayor Pro-Tern Present Perry Schrag Councilmember Present Joel Marks Councilmember Present Susana Perez Community Development Corporation Present Steve Sohn, Vice President Community Development Corporation Present Kathy Braby, Treasurer Community Development Corporation Present Lisa Leary, Secretary Community Development Corporation Present Donna Cole Community Development Corporation Present Don Beckel Community Development Corporation Present Allen Harris Community Development Corporation Present And with six council members and seven CDC members present a quorum was established and the following items were addressed: 1. Call to Order-7:01 p.m. City Council Community Development Corporation 2. City Council and the Community Development Corporation Board of Directors to discuss awarding a bid for construction of the Perryman Park Overflow Parking. Eve Morgan, Parks and Recreation, reviewed the specifics of this project including the location and size(22 parking spaces),and added that an alternate is requested for a sidewalk. The low bidder for the project is Cam-Crete Contracting,Inc.in the amount of$72,000 with a completion date of November 15,2014. Councilmember Connelly inquired as to why the proposal does not include expanding it further toward South Colony Boulevard. Eve responded by saying that there is a Master Plan for this corner that includes other features and they want to keep that in place. • September 30,2014 Special Session a. Community Development Corporation Board of Directors to consider awarding a bid and making a recommendation to the City Council for the_Perryman Park Overflow Parking. Motion to approve-Harris;second by Leary; motion passed with all ayes. b. City Council to consider approving a resolution awarding a bid and authorizing the city manager to execute a construction services contract for the Perryman Park Overflow Parking,with funding provided by the Community Development Corporation. Motion to approve- Connelly;second by Terre; motion passed with all ayes. 3. Adjourn- Community Development Corporation- 7:07 p.m. 4. Council to discuss and consider approving a change order to the construction contract with Austin Bridge & Road for the South Colony Boulevard Grade Separation at the Sam Rayburn Tollway (S.H. 121) (Maurina) Assistant City Manager Tod Maurina told the council there is an incentive package for the contractor included in the budget however this item is to restructure the incentive package. There is no additional cost. The plan is for the roadway to be open by March 1St and March 23rd is the all complete date. Tod also advised that there are some date inaccuracies in the document as presented and those will be corrected. Motion to approve with date changes-Connelly;second by Marks;motion passed with all ayes. 5. Council to discuss the November 4, 2014 city council election as it pertains to the contractual agreement with Denton County Elections, including ballot arrangement and possible alternatives, and provide direction to staff(Council) Mayor McCourry reviewed with the council that Denton County Elections has notified the city that local election items must be at the end of the November 4th ballot,rather than at the beginning as they originally had stated. The problem is a programming and software issue that the county became aware of recently. City Attorney Jeff Moore advised that the contract with the county does state that legal action can be taken for breach of contract,however,he added that the county's defense would be impossibility of performance. Attorney Ed Voss added that State statute dictates ballot order so there limitations as to what the county can do. Councilmember Boyer stated he has spoken to several agencies for a solution with no solution available. City Secretary Christie Wilson showed the council a sample sign prepared for posting at the polling sites as one means of informing the voters of the ballot September 30,2014 Special Session line-up. Council requested the signs be placed at each voting booth,that the election workers advise the voters that local elections are at the end of the ballot, and that the new Denton County Elections Administrator Lannie Noble be present at the next regular council meeting to discuss the problem and possible solutions for future elections. The local newspapers and other means of notifying the public about the ballot will be used. 6.
