RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE REVENUE BONDS WHEREAS, this City Council deems it advisable to give notice of intention to issue revenue bonds of the City of The Colony, Texas, as hereinat~er provided; and WHEREAS, it is officially found and determined that the meeting at which this resolution has been considered and acted upon was open to the public and public notice of the time, place and subject of said meeting was given, all as required by Chap. 551, Texas Government Code; Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: Section 1. FORM OF NOTICE. Attached hereto is a form of Notice of Intention to Issue Revenue Bonds, the form and substance of which are hereby adopted and approved. Section 2. PUBLICATION OF NOTICE. Said Notice shall be published, in substantially the form attached hereto, in a newspaper, as defined in Section 2051.044, Texas Government Code, of general circulation in the area said City, once a week for two consecutive weeks, the date of the first publication thereof to be at least fourteen (14) days prior to the date tentatively set for passage of the ordinance authorizing the issuance of such bonds. I~F:",FllqAN~C OL812\COLO~S 09/06/96:(2:55pm) NOTICE OF INTENTION TO ISSUE REVENUE BONDS NOTICE IS HEREBY GIVEN that the City Council of the City of The Colony, Texas, at its meeting to commence at 7:30 P.M. on October 7, 1996, at the regular meeting place of said City Council at the City Hall, 5151 North Colony Boulevard, The Colony, Texas, intends to adopt an ordinance authorizing the issuance of a series of interest bearing revenue bonds of said City in the maximum principal amount of $1,700,000 for the construction, acquisition and installation of additions, improvements and extensions to the City's existing waterworks and sewer system, including the construction of an elevated water storage tank and improvements of existing water lines. The bonds will be secured by and payable from a lien on and pledge of the net revenues to be derived from the operation of the City's combined waterworks and sewer system, will mature serially or otherwise not more than 40 years from their date, and will bear interest at such rate or rates not to exceed 15% per annum, as shall be set forth in the ordinance authorizing the issuance of such bonds. THIS NOTICE is given in accordance with law and as directed by the City Council of the City of The Colony, Texas. 6. The City Council of said City convened in Regular Session on September 16, 1996, at the regular meeting place thereof, and the roll was called of the duly constituted officers and members of said City Council, to-wit: William W. Manning, Mayor John Dillard, Mayor Pro Tem Mary Blair Watts, Deputy Mayor Pro Tern William Longo, Council Member David Stanwick, Council Member Wilma Avey, Council Member Dave Kovatch, Council Member and all of said persons were present, except for the following: ~ ; thus constituting a quorum. Whereupon, among other business, the following was transacted at said meeting: a written Resolution entitled RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENT TO ISSUE REVENUE BONDS was duly inu'oduced for consideration of said City Council and read in full. It was then duly moved and seconded that said Resolution be passed; and, after due discussion, said motion, carrying with it the passage of said Resolution, prevailed and carried by the following vote: AV S: '7 SO S: A STES'rIOSS: 2. A true, full and correct copy of the aforesaid Resolution passed at the meeting described in the above and foregoing paragraph is attached to and follows this Certificate; said Resolution has been duly recorded in the official minutes of said City Council; the above and foregoing paragraph is a true and correct excerpt l~om said minutes of said meeting pertaining to the passage of said Resolution; the persons named in the above and foregoing paragraph, at the time of said meeting and the passage of said Resolution, were the duly chosen, qualified and acting officers and members of said City Council as indicated therein; each of said officers and members was duly and sufficiently notified officially and personally in advance, of the time, place and purpose of the aforesaid meeting and that said Resolution would be introduced and considered for passage at said meeting, and each of said officers and members consented in advance to the holding of said meeting for such purpose; and said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chap. 55 l, Texas Government Code. 6.
