HomeMy WebLinkAbout09/02/2014 City Council-WS September 2,2014 Work Session MINUTES OF COUNCIL WORK SESSION HELD ON SEPTEMBER 2,2014 The Work Session of the City Council of the City of The Colony, Texas,was called to order at 6:15 p.m. on the 2nd day of September, 2014, at City Hall, 6800 Main Street, The Colony, Texas,with the following roll call: Joe McCourry Mayor Present Kirk Mikulec Councilmember Present Richard Boyer Councilmember Present Jeff Connelly Councilmember Present (6:25 p.m.) David Terre Mayor Pro-Tem Present Perry Schrag Councilmember Present (6:18 p.m.) Joel Marks Councilmember Absent And with four council members present a quorum was established and the following items were addressed: A. Call to Order B. Discuss work zone speed limits (Scruggs/Marks) City Engineer Gordon Scruggs advised that speeds in work zones are for 24 hours a day, 7 days a week. A traffic engineer determines where the zones should be and what the reduced speed should be; along with determining what other traffic controls are needed. He said the speed is reduced by 10—20 miles per hour depending on the type of roadway. Temporary speed reductions are set by order of the city engineer. City Attorney Jeff Moore added that work zone speed reductions require specific signage and when workers are present, the fines can be doubled. There is no deferred adjudication or driving safety course options for this level of fine. C. Discuss sidewalk location proposal for Cascades (Scruggs) Gordon Scruggs showed council a depiction of the area in the Cascades that is along the S.H. 121 access road. He said rather than placing sidewalks along the highway, Jackson-Shaw is suggesting they be installed on Stone Creek Dr. which is an interior roadway. Mayor McCourry voiced concern that changing the sidewalks would not offer access to Grandscape in that area. The matter was briefly discussed with Pam Nelson, Community Development Director, who indicated she and Gordon would discuss the matter to find a solution. D. Discuss City of The Colony Code of Ordinances Section 5-21. Keeping of livestock, fowl and rabbits and Sec. 5-1. Definitions (City Attorney) City Attorney Jeff Moore provided council a summary of two other cities' ordinances allowing potbellied pigs. The animals are not considered therapy animals. Service animals are defined as being dogs by the American with Disabilities Act. Councilmember Schrag expressed that perhaps potbellied pigs should be considered pets, under specific criteria. Several 1 September 2,2014 Work Session councilmembers expressed what they believed should be included in an ordinance and Jeff Moore will prepare a sample to bring back to council. Councilmember Connelly suggested that if a resident has a potbellied pig, it should be included in the total number of pets allowable. E. Discuss audio/visual equipment use for high school football games (Powell) City Manager Troy Powell told the council that volunteers use city equipment for recording high school football games. Originally they were to do more events, such as parades. They have requested equipment purchases so he requested the council meet with them to discuss this. It was decided that Mayor McCourry, and council members Mikulec and Schrag will meet with the volunteers. F. Discuss amending City of The Colony Code of Ordinances Section 19-12(m) regarding trailers parked on public streets (Schrag) Councilmember Schrag stated that the current ordinances do not allow trailers to be parked on the street, though there are some exceptions for cleaning, loading, etc. of boats and travel trailers on a short term basis. For contractors performing work on residential properties there are no provisions that allow them to park their trailers there. He thought perhaps the city could implement some sort of sticker for trailers that would authorize them to be parked in front of a resident's home for a few days. Mayor McCourry noted that already a building permit must be posted; it would not apply however to work inside such as flooring replacement. After some discussion, Councilmember Schrag said he would bring back some ideas for procedures. G. Council to receive supplemental information from staff or answers to questions regarding the September 2, 2014 regular agenda items as follows: None 2.1 Consider approving minutes of council meetings held August 14th (McCourry, Mikulec) and 19th, 2014 (City Secretary) 2.2 Consider approving Council expenditures for the month of July 2014 (Council) 2.3 Consider approving a resolution authorizing the city manager to enter into an agreement with CoSery Electric for construction, maintenance, power, and installation of LED street lighting in the public right of way at the Grandscape Development(Maurina) 3.1 Conduct the second of two public hearings and discuss the proposed 2014-2015 tax rate not to exceed $.675 cents per $100 valuation for the taxable value of all property, real and personal, located within the City of The Colony, and announce that the tax rate will be voted on September 16, 2014 at 7 p.m. at The Colony City Hall, 6800 Main St. (Finance) 2 September 2,2014 Work Session 3.2 Discuss and consider approving an ordinance canceling the November 4, 2014 city council election for single-member district Place 5 and declaring the unopposed candidate elected (City Secretary) 4.1 Discuss a proposed policy for selecting volunteers and independent contract instructors (Swain) H. Council to provide direction to staff regarding future agenda items. Councilmember Boyer asked to see a list of user fees for Hidden Cove Park and to discuss the rules for fee changes. I.
