February 18, 2014 Work Session
MINUTES OF COUNCIL WORK SESSION
HELD ON
FEBRUARY 18, 2014
The Work Session of the City Council of the City of The Colony, Texas, was called to order
at 6:03 p.m. on the 18th day of February, 2014, at City Hall, 6800 Main Street, The Colony,
Texas, with the following roll call:
Joe McCourry Mayor Present

Perry Schrag Councilmember Present
Joel Marks Councilmember Present (6:47 p.m.)
And with five council members present a quorum was established and the following items were
addressed:
A. Call to Order
B. Discuss e-cigarettes and vapor smoking devices to include restrictions and use in
buildings, and a draft ordinance (Miller) Tim Miller told the council that this is a
continuation of the discussion from last meeting. He told the council that the draft
ordinance that was prepared does not including anything that would prevent people from
using electronic cigarettes within city buildings. City Attou°nev Ieff Moore told the
council that the draft ordinance includes some definition changes, and adds prohibition
of possession of e-cigarettes for minors as well as for minors to present a false
identification in order to purchase e-cigarettes. Councilinembcr Terre said he would
have to think about the aspect of usage in buildings. Coumcihnenuber Connelly stated he
thinks the ordinance should target the sale of such products to minors and not the
possession. Manor AlfcCourrv told the attorney to bring forward the draft ordinance for
o vote without the provision of usage in buildings.
C. Discuss a possible consultant agreement with RB Government Solutions, LLC for
an assessment of the Managed Competition data for the Parks and Recreation
Maintenance Department (Miller) Trov Powell told the council that the Parks
department has compiled data for a managed competition analvsis and wants to have a
professional review it. He said the fimds will come firom his budget.
D. Discuss accelerated schedule for Memorial - Spring Creels Connector (Scruggs)
Gordon Scruggs discussed several options that could accelerate this project With some
previously implemented changes the current completion date is June 2015. If Frisco
approves a closure of Spring Creels f for an estimated 5 months] there is an additional
cost of $87,000 but that vvould allow for a May 2015 completion date. [Weather delavs

could impact anticipated completion dates.] Gordon advised of tlvo additional options
that could reduce the schedule by a couple of extra months though funding sources lvould
need to be identified.
E. Discuss Roberts Drive traffic issue (Perez) Joe Perez updated the coaincil on the
previously discussed parking issue around Peters Colon)) Elemental y. He visited the
Roberts location during the peak traffic time, which lasted approximately 15 minutes. He
niet with the assistant principal tivho has attempted to relay the concerns to the parents
but without much success. Given that the school year will be over in a few months, the
principal will discuss with city staff solutions for the follotiving school year. Police Chief
Joe Clark and City Engineer Gordon Scruggs will be included in such meetings.
F. Council to receive supplemental information from staff or answers to questions
regarding the February 18, 2014 regular agenda items as follows: No questions.
2.1 Consider approving minutes of council meetings held February 4, 2014 [Marks
WS, Schrag] (City Secretary)
2.2 Consider accepting Audra Preston's resignation from the Library Board (Council)
2.3 Consider approving a resolution authorizing the city manager to execute an
agreement modifying the interlocal agreement with the cities of Plano and Allen for the
Police Department radio system by increasing the number of talk groups to add Fire
Department (Police, Plemons)
2.4 Consider approving a resolution authorizing the city manager to execute an
interlocal agreement with the cities of Plano and Allen to provide on-site radio support
and service for Police dispatch center (Police, Plemons)
3.1 Discuss and consider approving a resolution authorizing the city manager to
execute an amendment to the Agreement for Professional Services with Halff Associates,
Inc. for continued review of development construction plans (Engineering, Scruggs)
Mayor McCourry confirined with the city attorney that 4.1 could be discussed nouw rather
than waiting until the regular meeting due to it be posted on both agendas cis a work
session item.
4.1 Discuss H.B. 259 regarding regulating political signs/electioneering on public
property and the city's current political sign ordinance, and provide direction to staff
(Attorney/Wilson) Jeff Moore advised the council that H.B. 259 states that cities cannot
prohibit electioneering daring voting at city owned facilities but that the city can
implement regulations about it. It was noted that electioneering can only be done outside
the 100' distance marker.
G. Council to provide direction to staff regarding future agenda items. Councilmember
Boyer asked for a report of complaints, code violations or police incidents at the STEM
Academy building site. Councilmember Marks asked for information as to recvcling
procedures inside city buildings.
