HomeMy WebLinkAbout02/13/2014 City Council February 13, 2014 Special Session MINUTES OF JOINT SPECIAL SESSION CITY COUNCIL & COMMUNITY DEVELOPMENT CORPORATION HELD ON FEBRUARY 13, 2014 The Special Session of the City Council of the City of The Colony, Texas, was called to order at 6:35 p.m. on the 13th day of February, 2014, at City Hall, 6800 Main Street, The Colony, Texas, with the following roll call: Joe McCourry Mayor Present Kirk Mlkulec Councilmember Absent Richard Boyer Councilmember Present Jeff Connelly COUncllmember Absent David Terre Mayor Pro-Tem Present Perry Schrag Councilmember Arrived 6:50 p.m. Joel Marks Councihnernber Present And with four council members present a quorum was established and the following items were addressed: 1. Call to Order- City Council 2. Council to discuss and consider approving an ordinance amending the Code of Ordinances, Section 6-192 entitled, "Noise", by authorizing the city council to approve special exceptions to the noise ordinance for use of construction equipment between 10:00 p.m. and 7:00 a.m. (Development Services, Joyce) Planning Director Mike Joyce reviewed the current ordinance regarding "Noise", stating that radios and loudspeakers are the only instances when a specific timefi-ame is included that could be waived by the City Council. This proposed ordinance adds a timeframe to the construction category and a provision for a waiver. It was clarified that if a special exception/waiver is requested, it will he for specific dates and times. Motion to approve- Boyer; second by Terre; motion passed with all ayes. 3. Council to discuss and consider granting an exception to the city's noise ordinance Section 6-192 (c) 5 as requested by Pogue Construction for four (4) extended work days in February and March for construction of the STEM Academy located at 3101 Stonelield Drive in the Tribute Subdivision (Development Services, Joyce) Mike Joyce advised this is a Little Elm School District request due to the construction of the new school being 51 days behind schedule. The school is scheduled to open in the Fall of 2014. He stated the contractor has added a second work crew. The request is for four February 13, 2011 Special Session extended work days over a seven week period which would need council's approval. Citizen Janece Pool told the council that about six weeks ago late hours construction became an issue. Also, the construction trucks have been using Stonefield to access the site when they are supposed to be using Lebanon. She said she is not opposed to the four days of extended work but the construction company needs to abide by the rules. She noted damage to the street could occur due to the concrete trucks. Citizen Paul Brueninsen also described late hours work occurring (including construction lighting being shown on the homes) and the 17 police being called on a few occasions. He has personally spoken with the construction manager to try and resolve the matter. He believes that crushed stone could be put on the Lebanon access for the construction trucks to use that entrance and stay off of Stonefield. He said he is okay with the four days requested but they should try to do this on the weekends, and he said a stronger police presence is needed. Mr. Howman, engineer for the school district, said that the cement trucks are too heavy and the crushed stone would not be sufficient. There was considerable discussion as to whose responsibility it is for the construction company to follow the rules set out for the project and be accountable for any issues. Linda Engle, Assistant Superintendent for Finance and Operations for Little Elm Independent School District, stated she is responsible. Mike Joyce said the city can have extra inspectors on site for these four days. Assistant City Manager Tim Miller told the council that the city could write citations to the construction company on the site. Ms. Engle also said that they need four warm days to pour the concrete, two for the first floor and two for the second floor. She submitted the request based on information received from Pogue Construction, and if these four days are not enough she will submit another request for long days in March. Motion to approve- Marks; motion failed for lack of a second. Mayor McCourry requested the motion include specifically two days in February and two days in March [rather than the date ranges as requested]. Motion to approve for two days in February and two days in March- Marks; motion failed for lack of a second. Motion to approve for two days in February and two days in March, with every effort to have those days being on Fridays and Saturdays; second by Marks. Councilmember Boyer stressed communication with the residents. Councilmember Schrag stated that he believes it is a school district and contractor problem if the school doesn't open on time, and that he is not in favor [of this request]. Motion passed with all ayes except for Schrag who voted no. February 13, 20 14 Special Session 4. Call to Order- Vice President Steve Sohn called the Community Development Corporation to order at 7:42.p.m. All members were present. 5. City Council and the Community Development Corporation Board of Directors to conduct a JOINT WORK SESSION to discuss upcoming/current CDC projects as follows and provide direction to staff. Subject matter will include project planning and development, budgets/funding, locations, scope of projects, and timelines (Council) a. Dog Park- Pros and cons of possible locations were discussed; two sites were presented as options. Eve Morgan reviewed some of the results of the survey, i.e. no parks charged user fees, and all used the honor about vaccinations. What staff is asking for is a final determination about a location. Once that is decided, they can move forward with determining cost, funding sources and timing. Mayor McCourry requested this be discussed again in another month or so. The city council is holding a retreat at the end of this month and they will know more about location preferences after that. b. Veteran's Memorial- Several planning questions were posed to the council rcgardinQ who will be involved in the planning meetings, funding sources, timeframes and phases. c. Stewart Creek Park Master Plan - Staff reviewed improvements that have been completed at the park. What is planned for this year is a playground and trash receptacles. Next year a halfbasketball court will be installed. Pam Nelson stated that there are some Lake Parks funds available to assist with some projects. cl. Sundial Project - Eve Morgan presented the final plan for the Sundial. The final cost will be S 12,071 which is considerably less than earlier estimates. 6.
