JANUARY 7, 2014
MEETING MINUTES
The Joint Special Session of the City Council and the Planning and Zoning Commission of the
City of The Colony, Texas, was called to order at 6:33 p.m. on the 7th day of January, 2014, at
City Hall, 6800 Main Street, The Colony, Texas, with the following roll call:

A quorum was established and the following items were addressed:
1. Call to Order
a. City Council- 6:33 p.m.
b. Planning and Zoning Commission- 6:34 p.m.
2. Conduct a joint public hearing, discuss and consider text amendments to the Zoning
Ordinance by revising Section 10-100, entitled "Schedule of Uses" to require a Specific
Use Permit for hotels in certain zoning districts and to prohibit motels in any district;
by eliminating, revising or adding definitions to Section 10-300, "Definitions Applicable

to the Schedule of Uses", and by establishing a new Section 10-2400, "Hotels" (SI13-
0017, Planning, Joyce)
Planning Director Mike Joyce stated that this item is to separately define motels and hotels
(limited service hotels and full service hotels) in the zoning ordinance, and to require a
specific use permit for hotels in certain zoning districts and prohibit motels in any district.
This change will also be reflected in the Schedule of Uses. Mayor McCourry opened and
closed the public hearing at 6:40 p.m. with no one wishing to speak.
a. Planning and Zoning Commission to discuss and consider making a
recommendation to the City Council regarding this item. Commissioner Molina
asked about the very detailed description for full service hotel restaurants and stated
he felt the wording may exclude some nice restaurants from being located in a full
service hotel.
Motion to approve- Molina; second by Hebb; motion passed with all ayes.
b. City Council to discuss and consider approving an ordinance amending the
Code of Ordinances regarding this item.
Motion to approve- Boyer; second by Marks; motion passed with all ayes.
3. Conduct a joint public hearing, discuss and consider a text amendment to the Zoning
Ordinance by revising Section 10A, "Gateway Overlay District Regulations" by adding
a new Section 10A-400(c) establishing certain prohibited land uses (SI13-0018,
Planning, Joyce)
Item not discussed. Mike Joyce stated that since Item 2 above was approved this one no
longer needs to be addressed.
a. Planning and Zoning Commission to discuss and consider making a
recommendation to the City Council regarding this item.
b. City Council to discuss and consider approving an ordinance amending the
Code of Ordinances regarding this item.
4. Conduct a joint public hearing, discuss and consider text amendments to remove
Section 13-169, entitled "Location of Credit Access Businesses" from Chapter 13 of the
Code of Ordinances; to revise Section 10-100, "Schedule of Uses"; to add definitions to
Section 10-300, "Def"initions Applicable to the Schedule of Uses" and to add Section 10-
2300, entitled "Regulations for Credit Access Businesses" to Appendix A, Zoning, of the
Code of Ordinances (SI13-0016, Planning, Joyce)
Mike Joyce reviewed that council recently approved a new ordinance regarding Credit
Access Businesses and this item adds the information to the zoning ordinance for

enforcement purposes. It also adds distance requirements for these types of businesses. City
Attorney Jeff Moore advised that there is one change from the packet material on the
ordinance. The ordinance was presented to also include distance requirements from
businesses selling alcoholic beverages but that has since been removed since the Texas
Alcoholic Beverage Code addresses distance requirements for such businesses. Mayor
McCourry opened and closed the public hearing at 6:46 p.m. with no one wishing to speak.

Motion to approve as corrected- Hall; second by Hebb; motion passed with all ayes.
b. City Council to discuss and consider approving an ordinance amending the
Code of Ordinances regarding this item.
COLmeilmember Boyer thanked the staff and the Commission for getting these regulations
established.

5. Conduct a joint public hearing, discuss and consider text amendments to Section 24,
"Amendments" of Appendix A, Zoning, regarding public notification and public
hearings (SI13-0019, Planning, Joyce)
Mike Joyce advised the requirement for the public hearings was established in the city's
Code of Ordinances in the 1980's however if a site plan meets all the written criteria in the
zoning ordinance, then the P&Z and City Council are compelled to approve the site plan. He
explained that this item removes the requirement for public hearings and public notification
for site plans to be consistent with state law. This applies to plats also, with the exception of
residential replats that will still require a public hearing. Mayor McCourry opened and
closed the public hearing at 6:59 p.m. with no one wishing to speak.

Motion to approve- Molina; second by Hebb; motion passed with all ayes.
b. City Council to discuss and consider approving an ordinance amending the
Code of Ordinances regarding this item.
Councihnember Terre thanked the staff and the P&Z for this change.
