September 17, 2013 Work Session
MINUTES OF PRE-COUNCIL WORK SESSION
HELD ON
SEPTEMBER 17, 2013
The Pre-Council Work Session of the City Council of the City of The Colony, Texas, was called
to order at 6:05 p.m. on the 17th day of September 2013, at City Hall, 6800 Main Street, The
Colony, Texas, with the following roll call:
Joe McCourry Mayor Present
Kirk Mikulec Councilmember Absent
Richard Boyer Councilmember Present
Jeff Connelly Council member Present (arrived 6:07)

Joel Marks Mayor Pro-Tern Absent
And with four council members present a quorum was established and the following items were
addressed:
A. Call to Order
B. Provide quarterly update of Austin trips (Boyer) Councilmember Boyer stated
that the number of legislative trips have been reduced however he recently met with
Attorney General Abbott 's campaign staff, and also this trip was economic development
related. There is not a need to continue the quarterly updates.
C. Council to provide direction on mobile food vendors (Browder) Iris Browder
and Health Inspector Mary Branch asked council for more clarification on the recent
request to include push-cart (food) street vendors in the ordinances. Currently only
motorized vehicles are included, eycept during special events. Mayor McCourrv
suggested they be allowed in parks, in front of stores, etc. Mary asked whether a
solicitor's permit be required, as is currently for door to door sales. After brief'
discussion Mayor McCourry suggested staff check with other cities/states for their
ordinances, and that the solicitor permit should be required in order to conduct
background checks on vendors.
D. Council to provide direction on temporary closing of Kisor Drive (Miller)
Assistant City Manager Tim Miller stated that a request to close the street had been
received from a resident who lives on Kisor and who is having a family wedding at
the Horizons Church across the street on September 28'x', The closing would be from
2 pm-8pm. The two directly affected neighbors are aware and have no issue with the
street closing in front of their houses. [The closing is not fbr the entire length of the
street; it affects the first three homes on the street, one of which is the requestor's.]

This is not an activity that requires a special eventpermit. If approved the city will
provide barricades to block off the street. Council members indicated this would be
similar to blockparties and should be allowed however did request staff to notify all
the residents on Kisor so they are aware.
E. Council to receive supplemental information from staff or answers to questions
regarding the September 17, 2013 regular agenda items as follows: None.
2.1 Consider approval of minutes of council meetings held September 3 [McCourry,
Mikulec] and September 9, 2013 [Mikulec, Boyer] (City Secretary)
2.2 Consider approving a resolution amending Resolution 2012-062, Master Fee
Schedule 2012-2013, to provide for new and amended fees for fiscal year 2013-2014 with an
effective date of October 1, 2013 (Finance, Cranford)
2.3 Consider approving a budget amendment ordinance for Fiscal Year 2012-2013 for
Utility Fund Facility Maintenance for emergency repairs to the Tribute pump station and
legal services for the Municipal Court (Admin, Shallenburger)
3.1 Discuss and consider approving an ordinance adopting the City of The Colony
budget for the fiscal year beginning October 1, 2013 through September 30, 2014; providing
for intra and inter-department fund transfers; providing for the investment of certain funds;
providing that expenditures for said fiscal year to be made in accordance with said budget
(Finance, Cranford)
3.2 Discuss and consider approving a resolution ratifying the property tax revenue
increase reflected in the City of The Colony budget for fiscal year 2013-2014 in accordance
with House Bill 3195 (Finance, Cranford)
3.3 Discuss and consider approving an ordinance adopting the City of The Colony tax
rate of $.6775 per $100 valuation for fiscal year 2013-2014. Tax Rate is comprised of
$.459022 M&O and $.218748 General Fund Debt Service (Finance, Cranford)
3.4 Discuss and consider making nominations for individuals to serve on the Denton
Central Appraisal District Board of Directors for a term beginning January 1, 2014
(Council))
3.5 Discuss and consider participation in the 2014 All America City Award Competition
(Admin, Perez)
3.6 Discuss and consider for 2013/2014 grant requests for in-kind contributions. (Admin,
Shallenburger)
F. Council to provide direction to staff regarding future agenda items. None
At this time Mayor McCourry addressed the following supplemental item that was posted by
separate notice.
Discuss relocating the city's annual Christmas tree from City Hall to an alternate location due
to construction in and around the City Hall facility (Swain) David Swain of Parks and
Recreation told the council that the usual place for the city's tree in front of city hall will now be

affected by power lines being installed [due to construction related to widening Main St.] He
recommended Perryman Park in order to incorporate a tree lighting into the Holiday in the Park
and Light Show event. It was noted that the proposed location is outside the utility lines at the park.
Councilmember Connelly expressed concern over the shortage of parking at this location.
Councilmember Boyer stated that staff is looking at ways to improve the parking. There was general
agreement that Perryman Park is a good location for the tree.
G. Adjourn
And with no further business to discuss the meeting was adjourned at 6:30 p.m.
