March 19, 2013 Work Session
MINUTES OF WORK SESSION OF COUNCIL
HELD ON
MARCH 19, 2013
The Work Session of the City Council of the City of The Colony, Texas, was called to order at 6:05
p.m. on the 19th day of March 2013, at City Hall, 6800 Main Street, The Colony, Texas, with the
following roll call:
Joe McCourry Mayor Present

Richard Boyer Councilmember Present
Jeff Connelly Councilmember Present
David Terre Councilmember Present
Perry Schrag Councilmember Present
Joel Marks Mayor Pro-Tem Present (6:15)
And with five council members present a quorum was established and the following items were
addressed:
A. Call to Order
B. Provide quarterly overview/update of the Austin trips. (Boyer) Councilmember
Boyer said that since the start of the legislative session he and some city staff have
traveled to Austin to communicate with legislators on matters of importance to the city.
In particular he mentioned transportation issues (South Colony overpass) that Tod
Nlaurina was instruinental in securing funding toward. He said the trips have been
worthwhile and is planning one or two more.
C. Discuss and provide direction regarding parking on grass and/or streets in
Eastvale. (Miller/Browder) Tim. Miller showed council some example photos of
parking along city streets in the Eastvale subdivision. The streets there are not curbed
(cis in the remainder of the city). The width of the streets is too narrotiv for vehicles to
park in the street on either side so residents there have been parking in the grass along
the edge of the street. The police department has been issuing warnings so Tim
requested inputfi°om the council on how they would like the situation to be handled. He
asked i~nhether° the police department should begin enforcing the "no parking on grass"
ordinance, or should an exempting ordinance be drafted. Mayor McCourry advised that
several years ago when the streets were upgraded in that area the residents did not want
curbs. Councilmember Mikulec advised that he has been contacted by solve residents
who want curbs. Discussion regarding storrn water drainage and pipes followed. The
general consensus was to have staff'brirZg back a draft ordinance exempting the streets
in Eastvale.fi°om parking on the grass restrictions, as long as parking is in parallel
fashion and not in the front yards of the hornes.

D. Discuss ban on smoking in restaurants and other public places. (Terre)
Councilrnember Terre said this is the number one issue that residents contact him about.
Jeff Moore explained the Charter sections on Initiatives and Referendums. Several
council members spoke expressing they would not like the city to initiate a ban, but
would rather let the establishments' customers drive changes at the businesses. It was
noted that there is some current proposed legislation (HB 400) restricting smoking in
public places and it was noted that if passed, this would take care of the matter.
E. Council to receive supplemental information from staff or answers to questions
regarding the March 19, 2013 regular agenda items as follows:
2.1 Consider approval of minutes of council meetings held February 19 (Connelly) and
March 5 (Marks WS), 2013 (City Secretary)
3.1 Continue a public hearing and discuss an ordinance amending the Code of
Ordinances, Appendix A Zoning, Section I OA "Gateway Overlay District", by rescinding
the current regulations and replacing them in their entirety with new regulations
(Development Services, Joyce) Councilnember° Schrag asked if this item is being closed
tonight or continued again. Mike Joyce advised that they will ask for another continuance,
adding that a red-lined document is almost ready to distribute to council.
3.2 Conduct a public hearing, discuss and consider approving an ordinance authorizing a
specific use permit to allow a tattoo parlor use, G.U.T. Graf-X Tattoos, located at 4716 E.
Lake Highlands Drive, Suite 101, within a Light Commercial (LC) zoning district
(Development Services, Joyce)
3.3 Discuss and consider approving a resolution authorizing the mayor to execute an
Encroachment / License Agreement with The Neighborhoods of Austin Ranch Association,
Inc. for monument signage in the Arbor Hills Way right-of-way (Engineering, Scruggs)
3.4 Receive presentation from Carollo Engineering, discuss and provide direction to staff
regarding the wastewater treatment plant expansion (Public Works Utilities, Groeschel)
F. Council to provide direction to staff regarding future agenda items.
Councilnember Connelly asked that the city do more at Five Star Complex Veteran's
Memorial to honor those from The Colony whose lives have been lost. He also asked if
the city can do anything regarding the bird population problem.
G. Adjourn
And with no further business to discuss the meeting was adjourned at 6:42 p.m.
