MINUTES OF REGULAR SESSION OF COUNCIL
HELD ON
OCTOBER 5, 2010
The Regular Session of the City Council of the City of The Colony, Texas, was called
to order at 7:05 p.m. on the 5th day of November 2010, at City Hall, 6800 Main
Street, The Colony, Texas, with the following roll call:

And with five council members present a quorum was established and the following
items were addressed:
1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS AND
PROCLAMATIONS:
Call to Order
Invocation - Christ Community Church
Pledge of Allegiance to the United States Flag
Salute to the Texas Flag
Citizen Input- Lynda Reed stated that a burned house on her block is a danger to
the children in the neighborhood and asked that it be secured.
Announcement of upcoming civic events and activities 1- Councilmember Boyer
reminded everyone of Pirate Days coming up on October 16-17 at Stewart Creek
Park. Mayor McCourry said that Councilmember Harris is out celebrating this
25th wedding anniversary and Councilmember Marks is out on family business.
2.0 CONSENT AGENDA
2.1 Consider approval of minutes of council meetings held September 21, 2010

2.2 Consider approving a resolution designating The Colony Courier-Leader as
the official newspaper of the city for legal publications for fiscal year 2010-
2011 (City Secretary)
2.3 Second reading and consider approving an ordinance amending the Code of
Ordinances regarding proposed changes to Chapter 6 (Buildings,
Construction and related activities) and Chapter 10 (Health and Sanitation);
changes include moving all of Chapter 10 into Chapter 6 and adding sections
of the International Property Maintenance Code (Planning, SI10-0002)
I These items are strictly public service announcements. No action will be taken and no direction will be given
regarding these items.

Motion to approve above consent agenda items- Schrag; second by Boyer; motion
passed with all ayes.
Councilmember Connelly requested item 2.4 be addressed separately.
2.4 Second reading and consider approving an ordinance amending the Code of
Ordinances, Appendix A Zoning, Section 10 (Use of Land and Buildings) and
Chapter 6, Article VI Food and Food Establishments relating to the use of
temporary or permanent seasonal snow cone establishments (Planning, SI10-
0006)
Councilmember Connelly questioned the term "temporary" within the scope of
this item. Development Services Director Mike Joyce responded by saying that
permanent sales are covered under other ordinances.
Motion to approve-Connelly, second by Mikulec; motion passed with all ayes.
3.0 REGULAR AGENDA ITEMS
3.1 Discuss and consider approving a resolution authorizing the city manager to
execute a construction services contract for the widening of North Colony
Boulevard (Engineering)
City Engineer Gordon Scruggs told the council that bids were opened for this
project on September 21St with Tiseo Paving being the low bidder. The base bid
is $5,923,022.05, which includes an alternate for stone storm drain headwalls at
$18,500. This project is entirely funded by Denton County and the Texas
Department of Transportation. Discussion followed as to the advantages and
disadvantages of having such projects bid by line item.
Motion to approve- Schrag; second by Mikulec, motion passed with all ayes.
And with no further business to discuss the meeting was adjourned at 7:21 p.m.
