MINUTES OF REGULAR SESSION OF COUNCIL
HELD ON
FEBRUARY 2, 2010
The Regular Session of the City Council of the City of The Colony, Texas, was called
to order at 7:03 p.m. on the 2nd day of February 2010, at City Hall, 6800 Main
Street, The Colony, Texas, with the following roll call:
Joe McCourry Mayor Present
Allen Harris Councilmember Present
Richard Boyer Councilmember Present
Jeff Connelly Councilmember Present
Kirk Mikulec Mayor Pro-Tem Present
Perry Schrag Councilmember Present
Joel Marks Councilmember Present
And with seven council members present a quorum was established and the following
items were addressed:
1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS AND
PROCLAMATIONS:
Call to Order
Invocation - Lakeway Baptist
Pledge of Allegiance to the United States Flag
Salute to the Texas Flag
Proclamation- JROTC American Legion Texas State Championship Skills Meet
Day proclamation presented to Col. White of The Colony High School JROTC.
Marine Quest- Ottis Lee provided an update on the marina construction progress
at Hidden Cove Park. He said a grand opening is planned by May 15t''
Citizen Input- none
Announcement of upcoming civic events and activities Presentation from the
Library Director regarding current and upcoming programs, events, and service
improvements. Special Events Coordinator Sree Kolloru provided information on
the upcoming Daddy/Daughter Dance, the Volunteer Day, and the Walk on the
Wild Side of The Colony.
2.0 CONSENT AGENDA
2.1 Consider approval of minutes of council meetings held January 19 [Schrag
and Harris absent] and January 25, 2010 (Wilson)
2.2 Consider approval of a resolution amending the 2009-2010 Master Fee
Schedule daily entry fees for Stewart Creek Park (Nelson)
Motion to approve consent agenda items- Schrag, second by Boyer, motion passed with
all ayes.
These items are strictly public service announcements. No action will be taken and no direction will be given
regarding these items.

3.0 REGULAR AGENDA ITEMS
3.1 Discuss and consider approving an installment plan for Marine Quest's 2010
lease payment schedule for Hidden Cove Park (Nelson)
Mayor McCourry requested an executive session to discuss this item with the city
attorney at 7:25 p.m. Council reconvened open session at 7:37 p.m. City
Attorney Jeff Moore announced that late this afternoon Marine Quest made their
payment to the city, including penalty and interest. Therefore, no action was
required on this item.
3.2 Discuss and consider a review of the city charter and possible related election
to include but not limited to the process, timeline, and review committee, and
provide direction to staff (McCourry)
Mayor McCourry advised that due to some state law changes our current city
charter should be reviewed for updates. He advised he would like to form a
committee that includes himself, two council members (Perry Schrag and Jeff
Connelly), City Manager Tony Johnston and City Secretary Christie Wilson. In
addition, he asked the remaining council members to recommend a member of the
public to serve on this committee. These individuals need to be residents of the
city and registered voters. It is anticipated it will take four to six meetings to
complete the review and formulate wording for ballot propositions. If the process
is complete in time, the council may order an election on the proposed
propositions at the November uniform election date, or if necessary wait until the
May 2011 council election. Jeff Moore recommended a resolution establishing
the committee at an upcoming meeting.
Executive Session was convened at 7:55 .m.
4.0 EXECUTIVE SESSION
4.1 A. Council shall convene into a closed executive session pursuant to
Section 551.071 of the TEXAS GOVERNMENT CODE to seek legal advice from
the city attorney regarding pending litigation between the City of Frisco,
North Texas Municipal Water District and the City of The Colony.
B. Council shall convene into a closed executive session pursuant to
Section 551.071 of the TEXAS GOVERNMENT CODE to seek legal advice from
the city attorney regarding pending litigation between John McDonald and
Cheryl McDonald and the City of The Colony.
C. Council shall convene into a closed executive session pursuant to
Section 551.071 of the TEXAS GOVERNMENT CODE to seek legal advice from
the city attorney regarding issues raised by a recent citizen complaint.
Council recessed the Executive Session in order to take action on Item B. at 9:15
p.m.
B. Any action as a result of executive session regarding pending litigation
between John McDonald and Cheryl McDonald and the City of The Colony.

I move to authorize the City Manager to send a letter to Bob Hager requesting he file
with the court all necessary paperwork to substitute the law firm of Brown and
Hofineister as the attorney of record in the McDonald case- Marks; second by
Connelly; motion passed with all ayes.
Executive Session was reconvened to address Item D. at 9:19.
D. Council shall convene into a closed executive session pursuant to
Section 551.074 of the TEXAS GOVERNMENT CODE regarding personnel
matters to wit: City Secretary annual evaluation.
Reconvened to Open Session at 10:18 p.m.
4.2 A. Any action as a result of executive session regarding pending litigation
between the City of Frisco, North Texas Municipal Water District and the
City of The Colony.
No action
C. Any action as a result of executive session regarding issues raised by a
recent citizen complaint.
No action.
D. Any action as a result of executive session regarding City Secretary
annual evaluation.
No action.
And with no further business to discuss the meeting was adjourned at 10:18 p.m.
