MINUTES OF SPECIAL SESSION OF COUNCIL
HELD ON AUGUST 16,2006
The Special Session of the City Council of the City of The Colony, Texas, was called to order at
7:06 p.m. on the 16th day of August 2006, at City Hall, 6800 Main Street, The Colony, Texas,
with the following roll call:

And with five council members present a quorum was established and the following items were
addressed. Several members of the Cultural Arts Board were also present.
Mayor Dillard asked the council whether they should accept citizen comments during this session
and they agreed they would. He announced a ribbon cutting ceremony for a new section ofS.H. 121
would be held on August 29th from 9-10:30 a.m.
1. Discuss and consider various issues related to the arts to include facility uses, funding
to include possible uses and distribution of the Hotel Occupancy Tax funds, oversight
of activities and events, and provide direction to staff (Council)
After considerable discussion in regard to the stated agenda topics, the following direction
was gIven.
a. Janitorial services- The city will get an estimate for cleaning services; those
using facilities should clean up after themselves; a deposit for usage should be
required.
b. HOT fund allocation- The Cultural Arts Board (CAB) will screen requests
make recommendations to council for one year.
c. Building use- CAB will make recommendations to council regarding long
term use of the building by other entities but will have the authority to approve
temporary uses.
d. CAB meetings will continue to be held at city hall unless there is a conflict.
e. City will advertise the availability of grant funds and CAB will take
applications.

The Cultural Arts Board will review several questions presented by the city manager (see I
Exhibit A, Points of Discussion, item number 3) and make recommendations.
2. Discuss and consider possible amendments to Code of Ordinances Chapter 2, Article II.
Boards and Commissions, Division 2. Cultural Arts Board as established by Ordinance
02-1407 and provide direction to staff (Council)
It was the consensus of council for the Cultural Arts Board to review the ordinance and make
recommendations to council.
3. Discuss and consider approval of a resolution authorizing the city manager to enter
into a License and Use Agreement with Lakeside Community Theater to utilize the Arts
Center located at 6301 Main Street (Council)
Councilmember Schrag questioned whether the city ever officiaIIy dedicated this building as
an "arts" building. He also questioned whether there were any legal aspects regarding
allowing the Cultural Arts Board control use ofthis building. In addition, he stated he would
like all non-profits to be treated equally in regard to use of city facilities.
No action.

Discuss and consider approval of a resolution authorizing the city manager to enter
into a License and Use Agreement with Dick Ledesma, owner of The Art Zone, to
utilize the Arts Center located at 6301 Main Street (Council)

Dick Ledesma advised the council that he has equipment in the building and voiced concern
over other entities using the area that he currently occupies.
No action.
Citizen James DePiazza agreed that the board should take responsibility for events and
present their recommendations to the council.
And with no further business to discuss the meeting was adjourned at 8:40 p.m.

Points of Discussion - Arts
August 16, 2006

1. What is the role ofthe Cultural Arts Board (CAB) with regard to "The Arts
Center?" Should they be able to approve any arts-related activities even if non-
recurring or should everything come to the Council for approval?
2. What is the role of the CAB as it relates to providing funding for arts related
activities? Does the Council want to set parameters and allow the CAB to make
the decisions concerning funding from Hotel Occupancy Tax (HOT) funds or
does the Council want the CAB to make recommendations to the Council? I
believe at least one Council member prefers the CAB to make recommendations
to the City Council.
3. Regardless of whether the CAB or the Council makes final decisions concerning
funding, it would be prudent to establish parameters. The Council may want to
consider the following:
· Should there be a maximum given to anyone organization or individual
in a given year? If so, what is the maximum? It could be either a
maximum percentage of the total or a maximum dollar amount.
· Does the Council want to allocate certain percentages based on categories
such as performing arts, musical, poetry and literature, historical, and
visual art? If so, what percentages for each? By giving direction to the
CAB concerning dollar amounts and content, a diverse offering of the arts
could be provided.
· Can the Community Center be used for arts-related activities approved by
the CAB or Council? Should this be contingent on non-arts groups using
"The Arts Center?"
· Will funding be limited just to individuals or organizations in The Colony
or will it be open to anyone willing to "perform" in The Colony? How
does the Council want to characterize preference for The Colony
residents? This could be in strict percentage terms or within ranges.

4. Does the Council want to handle non-profits differently than for-profits with
regard to use of The Arts Center? If so, how? This could be done through the fee
schedule.
5. Does the Council want to modify the ordinance governing the Cultural Arts
Board?
6. Does the Council desire the CAB to meet in a specific location?
