HomeMy WebLinkAbout05/17/2005 City Council May 17, 2005 Special I MINUTES OF SPECIAL SESSION OF COUNCIL HELD ON MAY 17, 2005 The Special Session of the City Council ofthe City of The Colony, Texas, was called to order at 7:00 p.m. on the 17th day of May 2005, at City Hall, 6800 Main Street, The Colony, Texas, with the following roll call: John Dillard Mayor Present Allen Harris Councilmember Present Scott Ward Councilmember Present Joe McCourry Mayor Pro-tem Present Lynda Bayliss Councilmember Present Perry Schrag Councilmember Present Joel Marks Councilmember Present And with seven council members present a quorum was established and the following items were addressed: 1. Consider approval of an ordinance canvassing and declaring the results of an election held in I the City of The Colony, Texas on May 7, 2005 (Wilson) City Secretary Christie.Wilson read sections of the following canvassing ordinance: CITY OF THE COLONY, TEXAS ORDINANCE NO. 05-1592 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD IN SAID CITY ON THE 7TH DAY OF MAY 2005, FOR THE PURPOSE OF ELECTING TWO COUNCIL MEMBERS FOR SAID CITY; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council caused to be published in accordance with the laws of the State of Texas notice ofthe election held May 7,2005, to elect two Council Members for said City; and WHEREAS, notice of election was actually given as required by law; and WHEREAS, said election was duly and legally held on May 7, 2005 in conformity with the election laws ofthe State of Texas, and the results of said election have been certified and returned I by the proper judges and clerks thereof; and 1 May 17,2005 Special WHEREAS, the election returns duly and legally made showed that there were cast at said election 444 valid and legal votes, and that each of the candidates in said election received the following votes: FOR COUNCILMEMBER PLACE 3 Lloyd Martin 28 Joe McCourry 127 FOR COUNCILMEMBER PLACE 6 Tim DeGrendele 119 Joel Marks 170 WHEREAS, pursuant to Section 7.04 of Chapter VII ofthe Home Rule Charter ofthe City, in order to be declared elected, a candidate must receive a majority of the legal votes cast for the office or place for which such person is a candidate. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That each and every one ofthe recitals, findings and determinations contained in the preamble to this Ordinance are hereby incorporated herein as due, proper and formal fmdings and determinations of the City Council. Section 2. That it is further found and determined that the results ofthe election as canvassed and tabulated in the preamble reflect the expressed desires ofthe resident, qualified electors. Section 3. That the duly elected members of the City Council of the City of The Colony, Texas, elected May 7,2005 for Council Places 3 and 6 and subject to the taking and signing ofthe oaths as provided by the laws of the State of Texas, are as follows: Councilmember Place 3 Joe McCourry Councilmember Place 6 Joel Marks Section 4. That the following members ofthe City Council ofthe City of The Colony, Texas are duly elected by running unopposed for Council Places 4 and 5 and having these two council races cancelled on March 28, 2005, and subject to the taking and signing of the oaths as provided by the laws and State of Texas, are as follows: Councilmember Place 4 Kirk Mikulec Councilmember Place 5 Perry Schrag 2 May 17, 2005 Special I Section 5. That the public importance of this measure and the fact that it is in the best interest ofthe City to declare the duly elected officers ofthe City at the earliest possible date for the immediate preservation of the public peace, property, health and safety ofthe City and its citizens creates an emergency and an imperative public necessity which requires that this Ordinance shall take effect and be in force from and after its final passage and approval, and it is accordingly so ordained. PASSED AND APPROVED this the 17th day of May 2005. Motion to approve- Harris; second by Bayliss; motion passed with all ayes. 2. Administer Oath of Office to newly elected council members (Wilson) City Secretary Christie Wilson administered the oath of office to Joe McCouny, Councilmember Place 3; Kirk Mikulec, Councilmember Place 4; Perry Schrag, Councilmember Place 5; Joel Marks, Councilmember Place 6. They then took their places at the dais. Mayor Dillard congratulated the candidates on a successful election and invited everyone to stay for a reception.
