MINUTES OF SPECIAL SESSION OF COUNCIL
HELD ON
AUGUST 19, 2003
The Special Session of the City Council of the City of The Colony, Texas, was called to order at
7:01 p.m. on the 19t~ day of August 2003, at City Hall, 6800 Main Street, The Colony, Texas,
with the following roll call:
Allen Hams Councilmember Present
Scott Ward Councilmember Present
Joe McCourry Mayor Pro-tem Present
Lynda Bayliss Councilmember Absent
Perry Schrag Councilmember Present
Joel Marks Councilmember Present
And with five present a quorum was established and the following items were addressed:
1. Consideration of approval of an ordinance canvassing and declaring the
results of an election held in the City of The Colony, Texas on August 16,
2003 (ilicks)
The city secretary read portions of the canvassing ordinance as follows:
AN ORDINANCE OF TIlE CITY COUNCIL OF TIlE CITY OF
TIlE COLONY, TEXAS, CANVASSING TIlE RETURNS AND
DECLARING TIlE RESULTS OF A RUN-OFF ELECTION IlELD
IN SAID CITY ON TIlE 16TIl DAY OF AUGUST 2003, FOR TIlE
PURPOSE OF ELECTING A MAYOR FOR SAID CITY;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, said election was duly and legally held on August 16, 2003, in
conformity with the election laws of the State of Texas, and the results of said election
have been certified and returned by the proper judges and clerks thereof;
and
WHEREAS, the election returns duly and legally made showed that there were
cast at said election 2615 valid and legal votes, and that each of the candidates in said
election received the following votes:
FOR MAYOR
Bemetta Henville-Shannon 1153
John Dillard 1462

VOtEREAS, pursuant to Section 7.04 of Chapter VII of the Home Rule Charter __
of the City, in order to be declared elected, a candidate must receive a majority of the
legal votes cast for the office or place for which such person is a candidate.
Section 3. That the duly elected members of the City Council of the City of The
Colony, Texas, elected August 16, 2003, for Mayor and subject to the taking and signing
of the oaths as provided by the laws of the State of Texas, are as follows:
Mayor - John Dillard
Section 4. That the public importance of this measure and the fact that it is in
the best interest of the City to declare the duly elected officers of the City at the earliest
possible date for the immediate preservation of the public peace, property, health and
safety of the City and its citizens creates an emergency and an imperative public
necessity which requires that this Ordinance shall take effect and be in force from and
after its final passage and approval, and it is accordingly so ordained.
Motion to approve the canvassing ordinance as written - Schrag; second- Ward
carried with all ayes.
2. Administer Oath of Office to newly elected Mayor {Hicks)
City Secretary, Patti Hicks administered the Oath of Office to Mr. John Dillard, --
following which; Mayor Dillard took his place on the dais.
Mayor Dillard read a prepared statement, in which he thanked his supporters. He
pledged to heal the riffs in our city and noted that he had a good team to help him do that.
The mayor became emotional and told the audience that this had been a very long road
and thanked them all for their help. He invited everyone to attend the reception in the
lobby and asked that the reception be to honor Councilmembers Harris and Ward, since
they had not been able to have a reception when they were elected in May.
