HomeMy WebLinkAbout08/04/2003 City Council-SS August 4, 2003 MINUTES OF REGULAR SESSION OF COUNCIL HELD ON AUGUST 4, 2003 The Regular Session of the City Council of the City of The Colony, Texas, was called to order at 7:00 p.m. on the 4th day of August 2003, at City Hall, 6800 Main Street, The Colony, Texas, with the following roll call: Allen Harris Councilmember Present Scott Ward Councilmember Present Joe McCourry Mayor Pro-tem Present Lynda Bayliss Councilmember Present Perry Schrag Councilmember Present Joel Marks Councilmember Present And with six present a quorum was established and the following items were addressed: ROUTINE ANNOUNCEMENTS, RECOGNITIONS AND PROCLAMATIONS: Call to Order Invocation - Allen Harris Pledge of Allegiance to the United States Flag Salute to the Texas Flag Citizen Input Linda Adams, 6069 Dooley spoke regarding the need for more police presence and code enforcement in her neighborhood. Maria Solis, 6071 Dooley, spoke through interpreter Tony Johnston regarding the need for more police presence and code enforcement in her neighborhood. Bemetta Henville-Shannon, 4156 Ballard Trail, spoke of National Night Out on August 5, 2003, and reminded everyone of the upcoming election on August 16, 2003. Mel Sparks, 5649 Painter, asked questions of the council regarding the need for continuing with the election, and also asked about using electronic equipment for early voting. 12,0 I CONSENT AGENDA 2.1 Consideration of approval of the minutes of the council meeting held July 21, 2003 (Hicks) Motion to approve as presented- Schrag; second- Marks; motion passed with all ayes. 2.2 Consideration of appointment of a representative and alternate to the North Texas Regional Library System for the 2003-2005 term (Sveinsson) Motion to approve as presented- Schrag; second- Marks; motion passed with all ayes. 2.3 Consideration of approval of an updated street lighting agreement with Oncor Electric (Leverich) August 4, 2003 Council member Penny Schrag pulled this item from the consent agenda. Discussion of the bases of the new street lights followed with Public Works Director Ken Leverich who advised possibly they could be painted to match. __ Council member Joel Marks questioned various maintenance aspects of the street lights and the contract with Oncor, to include whether or not Oncor would trim the trees around the lights. Cheryl Way with Oncor advised that was not part of the contract. Council member Harris asked whether or not a system could be set up for citizens to report burned out lights, etc. He also expressed concern over a 10 year contract and was advised by Bob Sparkman, Purchasing Agent, that this is a standard contract. Council member Schrag asked if in future contracts of this sort, the specification for matching lights be included. Motion to approve as presented- Schrag; second- Bayliss; motion passed with all ayes. 2.4 Consideration of approval of a resolution to pursue a settlement with Texas Commission on Environmental Quality regarding a supplemental environmental project and incorporating a two year time period (Johnston) Motion to approve as presented- Schrag; second- Marks; motion passed with all ayes. Mayor Pro-tem McCourry announced at this time that there will be no executive session as posted for this meeting. ~ REGULAR AGENDA ITEMS ] 3.1 Consideration of approval of a resolution directing publication of "Notice of -- Intention to Issue Certificates of Obligation" (Koo) Rebecca Koo, Finance Director, gave an overview of this item regarding the dollar amounts and the timing of the sale. Ms. Koo advised that the dollar amounts proposed won't necessarily stay the same. Council member Schrag asked if other items could be added to the list and was advised they could not. Motion to approve as presented- Harris; second- Schrag; motion passes with all ayes. 3.2 Presentation of preliminary municipal budget for 2003-2004 (Koo) Rebecca Koo advised the council that the preliminary budget was ready for their review and asked them to please bring their copies to the work session scheduled for August 5, 2003. 3.3 Consideration of approval of an ordinance scheduling a public hearing on August 18, 2003 regarding the proposed municipal budget for 2003-2004 (Koo) Council member Schrag asked Ms. Koo if the public hearing will set the tax rate. She advised there will be another hearing for the tax rate. __ Motion to approve as presented- Bayliss; second- Marks; motion passes with all ayes. 0078!L: August 4, 2003 3.4 Continuation of public hearing from July 21, 2003 and consideration of approval of an ordinance updating the land use assumptions, capital improvements p lan, a nd modification o f impact f ecs relative t o water a nd server facilities, and adopting a capital improvements plan and impact fees for roadway facilities (Persaud) Harry Persaud gave a brief history of this item. Mayor Pro-tem McCourry opened the public hearing at 7:45. Citizen Mel Sparks of 5649 Painter asked the council to explain in laymen terms what this all meant, and if it meant a tax burden to the citizens. Mr. Persaud explained impact fees and how they affect current property owners, as well as new owners and commercial properties. Mr. Harris asked if Austin Ranch has separate impact fees and Mr. Persaud explained that the infrastructure there is paid 100% by the developer. Council member Bayliss asked if this ordinance has any changes since first presented and Mr. Persaud advised there are none since June 2003. Public hearing was closed at 7:55 p.m. Motion to approve as presented- Harris; second-Bayliss; motion passes with all ayes. 8:00 15 minute break 8:15 Reconvene 3.5 Work session to discuss Storm Water Management and how it will affect the city (Scruggs) City Engineer Gordon Scrnggs provided a handout of this presentation to council members (see Exhibit A) and explained the Storm Water Management program and requirements. He explained the effect this will have on The Colony and noted the need for a n ordinance with enforcement authority. He suggested neighborhood g coups t hat might be enlisted to help monitor the residential areas. Discussion followed regarding the costs of such a program and possible funding, educating the public and developers, and public participation in such a program. Dale Cheatham suggested staff come back to council with costs to the citizens if the city does only a study this year, and the costs of a study along with implementing the program. Council members agreed. SUPPLEMENTAL AGENDA for August 4, 2003 1. EXECUTIVE SESSION: The City Council of the City of The Colony, Texas shall convene into executive session pursuant to §§ 551.071(1) (a) and 551.071(1)(b) of the TEXAS GOVERNMENT CODE concerning pending litigation and to seek legal advice from the City Attorney on a matter in which it is the duty of the attorney to advise its client regarding candidate eligibility and run-off election, as provided under the TEXAS DISCIPLINARY RULES OF CONDUCT, as follows: August 4, 2003 A.
