ENSURING FUNDING FOR THE REFUND; AND DECLARING AN
EFFECTIVE DATE
WHEREAS, the Cities of The Colony and Plano have heretofore been involved in
litigation concerning land claimed by both cities; and
WHEREAS, the Cities of The Colony and Plano and the other parties to the suit
have settled their litigation and have entered into a Boundary Adjustment Agreement and
Settlement Agreement, resolving the boundary line between The Colony and Plano on what
is referred to as the "White Tract" and is more particularly described in Exhibit "A"; and
WHEREAS, the City Council of the City of The Colony has determined that as a
result of the Boundary Adjustment Agreement and the accompanying Settlement Agreement
a tax refund is due the property owners of the "White Tract"; and
WHEREAS, the "White Tract" was originally annexed into the City of The Colony
on December, 1985; and
WHEREAS, property taxes have been paid to both the City of The Colony and the
City of Plano for the years 1986 through 1992;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1. Property taxes for the years 1986 through 1992 on the property
known as the "White Tract" are hereby authorized to be refunded to the property owners.
The amount of taxes to be refunded will be prorated according to the division of the
property between the cities of The Colony and Plano, as set out in the Boundary Adjustment
Agreement and accompanying Settlement Agreement which are attached hereto and
incorporated herein and labeled Exhibits "B" and "C" respectively.
Section 2. The Denton Central Appraisal District shall be requested to
compute the amount of prorated taxes to be refunded pursuant to Section 26.15(0 of the
Property Tax Code.
Section 3. If it is found that taxes for the year 1992 have not been paid, the
amount of prorated taxes to the city will be deducted from the total refund amount and
recommend that any penalty and interest for the year 1992 shall be eliminated.
Section 4. The portion of the "White Tract" now located in the City of
Plano, according to the Boundary Adjustment Agreement and accompanying Settlement
Agreement shall be removed from the tax rolls of the City of The Colony.
Section 5. The City of The Colony hereby approves payment of the total
refund amount and does have funds available to defray the amount of the refund.
Section 6. This resolution shall become effective from and after its passage.
