HomeMy WebLinkAboutResolution No. 94-27 ORIGINAL CITY OF THE COLONY, TEXAS RESOLUTION NO. 94-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS COMMITTING TO PROVIDE REQUIRED FUNDING FOR THE DEVELOPMENT AND CONSTRUCTION OF THE NORTH COLONY BOULEVARD AND FARM TO MARKET ROAD 423 (MAIN STREET) INTERSECTION IMPROVEMENT PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION;PROVIDING AN EFFECTIVE DATE WHEREAS, the State and the City desire improvements to the intersection of North Colony Boulevard and Farm to Market Road 423, to be hereinafter identified as the "Project"; and WHEREAS, the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) codified under Title 23 U.S.C. Section 120, establishes that the Federal share of funding for Surface Transportation Programs for urbanized areas will not exceed eighty percent (80%) of the Project cost;; and WHEREAS, the City has offered to participate in the development and construction of the Project; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS: Section 1. That the City of The Colony will provide required funding, prepare the preliminary engineering and design plans, acquire the necessary right-of-way, provide relocation assistance, prepare right-of-way descriptions and value determinations, accomplish the adjustment of utilities, condemn property, provide certifications providing environmental mitigation, and provide other necessary items as required by the State. Section 2. That the City will submit a check or warrant payable to the Texas Department of Transportation in the amount specified by the State equal to $10,760.00 (Ten Thousand Seven Hundred and Sixty Dollars) as stated in the construction agreement, the payment will be made within thirty (30) days of receipt of the State's written notification, which will be sent sixty (60) days prior to the date set by the State for receipt of the construction bids. · Section 3. In the event additional funding is required by the city at anytime during the development of the Project, the City will provide the funds within thirty (30) days from receipt of the State's written notification. Section 4.
