HomeMy WebLinkAboutResolution No. 94-36 ORIGINAL A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, REQUF~TING FINANCIAL ASSISTANCE FROM THE TEXAS WATER DEVELOPMENT BOARD; AUTHORIZING THE SUBMISSION OF AN APPLICATION, DESIGNATING AN OFFICIAL REPRESENTATIVE AND RESOLVING MATI~ERS RELATED THERETO; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of The Colony, Texas (the "City") proposes to construct, acquire and install improvements, extensions and additions to the City's sanitary sewer system (the "Project") and to issue revenue bonds to finance the project; and WHEREAS, the City cannot reasonably finance the Project without assistance from the Texas Water Development Board in an amount not to exceed $ 11,000,000.00; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the statements contained in the preamble of this Resolution are true and correct and are adopted as findings of fact. Section 2. That the City requests financial assistance from the Texas Water Development Board State Revolving Fund and authorizes the submission of an application for financial assistance to the Texas Water Development Board. Section 3. The Mayor of the City is hereby designated as its official representative and is authorized to execute and submit an application with the Texas Water Development Board for financial assistance for the Project. Section 4. The appropriate officials of the City, the City's Engineer, the City's Financial Advisor, First Southwest Company, and the City's Bond Counsel, Hutchison Boyle Brooks & Fisher, A Professional Corporation, are hereby authorized to appear before the Texas Water Development Board on behalf of the City regarding its request for financial assistance. Section 5. That this resolution shall be effective at thetime of adoption.
