A RESOLUTION OF THE CITY OF THE COLONY, TEXAS
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY
AND COIJ.IN COUNTY FOR THE PROVISION OF CONSULTING
SERVICES RELATING TO THE IMPROVEMENTS TO STATE
HIGHWAY 121: PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That the City Manager of the City of The Colony, Texas is hereby
authorized and empowered to execute an Interlocal Cooperation Agreement with Collin
County for the provision of consulting services relating to improvements to State Highway
121.
Section 2. That a true and correct copy of the Interlocal Cooperation Agreement
is attached hereto and incorporated herein.
Section 3. That this resolution shall take effect immediately from and after its
passage.

WwrlEREAS, the City of The Colony and Collin County are among the
fastest growing areas in the United States; and,
x, VItEREAS, much of the projected future growth of these areas will
generate traffic volumes beyond the capacity of normal major thoroughfares; and,
VvTtEREAS, it has been mutually recognized that a controlled access
freeway will be required to accommodate this traffic; and,
~VIIF_JIEAS, it is uniformly recognized that a joint concentrated effort on
behalf of the subject entities is needed to accelerate the approval process of subsequent
construction of State Highway I~1 into a controlled access freeway; and,
~VHFREAS, Collin County, Denton County, and the Cities of .Mien, Piano,
McKinney, Frisco, Lewisville, and The Colony agree that the services of Robert A.
Pope & Associates are needed to assist in the acquisition and negotiation for right-of-
way, and liaison with the State Highway Commission and the State Department of
Highways and Public Transportation respectively, and,
W~qF_.REAS, the Interlocal Cooperation Act, Texas Government Code, Chapter
791, Vernon's Annotated Civil Statutes provides authorization for any local government
to contract with one or more local governments to perform governmental functions
and services under the terms of the Act.
NO~,V, THEREFORE, THIS AGRF~EMEN~F is hereby made and entered into
by Collin County and the City of The Colony for the mutual consideration stated
herein:
~,VIT NESSETH
Col/in County hereby agrees to employ, on behalf of itself and the City of
The Colony, Robert ~ Pope & Associates, as Consultant to assist in right-of-way
acquisition, communication and negotiation with the State Department of IIighways
and Public Transportation; Robert A. Pope & Associates to be compensated Se,000 per
montl~
The City of The Colony agrees to reimburse Co/lin County $944.~0 as the
City of The Colony's share for the employment of Rob6rt A. Pope & Associates,
hereafter referred to as "Consultant~"
III.
Collin County hereby agrees to pay Consultant on a monthly basis and
invoice the City of The Colony based on agreed cost share.
I~F.
As a consideration for agreed cost sharing, the City of The Colony has the
right to provide direction to the Consultant for the portion of State Ilighway 1~1
within the City's jurisdiction.

Further, it is mutually agreed betnveen Col/in County and the City of The
Colony that whenever the Consultant perceives direction given to the Consultant by
the City of The Colony is beyond the agreed-upon scope, the issue will be resolved by a
consensus of al/the entities involved in the S.H. Ig I agreement with Col/in County.
The City of The Colony and Col/in County hereby agree that the term of this
agreement shall be from October 1, I99~ through September $0, 1995.
VII.
The City of The Colony and Collin County hereby agree that this contract may
be renewed for a specified period of time by a letter of agreement between the two
parties.
