MINUTES OF THE CITY COUNCIL MEETING
HELD ON
OCTOBER 12, 1992
The Special Session of the City Council of the City of The Colony, Texas was called to order
at 7:00 p.m. on the 12th day of October, 1992 at City Hall with the following Council roll
call:
William W. Manning, Mayor Present
Mike Lynch, Councilman Present
Billy Sharp, Councilman Present
Joe Agnew, Councilman Present
Tom Bogan, Councilman Present
John Dillard, Councilman Present
Joel Marks, Mayor Pro-tem Present
and with seven present, a quorum was established and the following items were addressed:
1. PLEDGE OF ALLEGIANCE
2. CONSIDERATION OF AN ORDINANCE OF THE CITY OF THE CITY
LEVYING THE AD VALOREM TAXES FOR THE YEAR 1992
Mayor Manning noted that when the motion is made to adopt this ordinance, it
should include the actual figures to be included in Section 1, paragraph a and b of the
ordinance, for example, if $.80 per $100 is the rate, the motion should so state $.80 per $100
as well as $.45 per $100 in paragraph a and $.35 per $100 in paragraph b.
Councilman Marks asked why the Mayor mentioned $.80 when the ordinance is
blank. Mayor Manning stated that is the amount that has been talked about. Councilman
Marks said all the council wants to balance the budget but $.05 will not do it, noting it
would take $.07 plus and went on to say he has not heard any recommendation to make up
the difference.
Mayor Manning said to the best of his recollection, the council wanted to do the best
they could this year and thought that a $.05 increase was a good step. Going on, Mayor
Manning said he hopes next year will be a better year and we will not have to increase taxes
again.
Councilman Sharp reminded everyone that two councilmembers had suggested an
increase of $.09 or $.10 so no money would be drawn from contingency this year, and went
on to agree that the $.05 increase is a good step.
Councilman Lynch also reminded everyone that the Public Hearing was advertised
for $.80 and to go higher would require another advertisement and public hearing.
Councilman Bogan said he agreed with the $.05 because he felt it would give us a good start
on next year.
Motion to approve the ordinance levying the ad valorem tax rate at $.80 per $100 valuation,

distributed as follows: $.45 for municipal operations and $.35 for debt service - Agnew;
second - Dillard.
Mayor Manning read the caption as follows:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, LEVYING THE AD
VALOREM TAXES FOR THE YEAR 1992 AT A RATE OF $.80 PER ONE HUNDRED
DOLLARS ($100.00) ASSESSED VALUATION OF ALL TAXABLE PROPERTY
WITHIN THE CORPORATE LIMITS OF THE CITY AS OF JANUARY 1, 1992; TO
PROVIDE REVENUES FOR THE PAYMENT OF CURRENT EXPENSES AND TO
PROVIDE AN INTEREST AND SINKING FUND ON ALL OUTSTANDING DEBTS
OF THE CITY; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER
WITH PENALTIES AND INTEREST; AND DECLARING AN EFFECTIVE DATE.
Councilman Marks said he does not think any councilmember should be expected to
have an alternative when that member disagrees with a particular issue. Going on, the
Councilman said a councilmember votes according to how the citizens in his area have
asked him and he said he disagrees totally with the additional $.03 tax increase.
Councilman Marks went on to say he thought the intent was to balance the budget without
drawing from contingency funds and noted this increase does not do that. Councilman
Marks asked if this council and councils in the future will promise to cut the budget to the
bone to keep from raising taxes.
Mayor Manning said he does not understand how Councilman Marks could make
that statement and then disagree with the tax increase. Councilman Sharp said all
elected officials serve the entire city, not just one particular area, stating that not only
citizens in Place 6 are against the tax increase. After a brief discussion, the motion was
made as follows:
Motion carried with the following roll call vote: Lynch - Aye, Sharp - Aye, Agnew - Aye,
Bogan - Aye, Dillard - Aye, Marks - No. Mayor Manning stated that his philosophy is to
abstain on an issue if you did not attend the public hearing, noting that he was not able
to attend the public hearing due to circumstances beyond his control. Mayor Manning, did
state however, that he was able to view the public hearing on television and he therefore
would vote Aye on this issue.
With no further business to address, Mayor Manning adjourned the meeting at 7:15
