The Special Session of the City Council of the City of The Colony, Texas was called to order at 7:00 p.m. on the 23rd day of September, ]99] at City Hall with the following Council roll call: William W. Manning, Mayor Present Mike Lynch, Councilman Absent Billy Sharp, Councilman Present Dale Therio, Councilman Present Rob Burchard, Councilman Present Lou Gomez, Councilman Present Joel Marks, Mayor Pro-tem Present and with six present, a quorum was established and the following items were addressed: 1. PLEDGE OF ALLEGIANCE 2. CONSIDERATION OF AN ORDINANCE LEVYING THE AD VALOREM TAXES FOR THE YEAR ]99] Mayor Manning read the caption of the ordinance as follows: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, LEVYING THE AD VALOREM TAXES FOR THE YEAR ]99] AT A RATE OF $,75 PER ONE HUNDRED DOLLARS ($]00.00) ASSESSED VALUATION OF ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY AS OF JANUARY ], ]99]; TO PROVIDE REVENUES FOR THE PAYMENT OF CURRENT EXPENSES AND TO PROVIDE AN INTEREST AND SINKING FUND ON ALL OUTSTANDING DEBTS OF THE CITY; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH PENALTIES AND INTEREST; AND DECLARING AN EFFECTIVE DATE. Motion to approve as written - Gomez; Second - Sharp Councilman Burchard said he has two problems with this increase; ]. all the money will go to current expenses and not debt retirement and 2. the money will help paint the water tower. Mr. Hall explained that the money to paint the water tower will come from the Utility Fund and the project will be held off until mid- year. Councilman Burchard asked if the money is to help fund City services and Mayor Manning said yes, but more, it is to cover the following: ]. DARE officer, 2. full time staff librarian for youth services, and 3. badly needed patrol officer. Mr. Hall advised the 1 cent will raise the contingency to $53,000 next year. Councilman Burchard said he is not sure all possible revenues have been looked into. Question called - Gomez; second - Therio, carried with all members voting Aye, except Councilman Burchard who voted No. Motion to approve carried with all members voting Aye except Councilman Burchard who voted No. 3. CONSIDERATION OF AN ORDINANCE APPROVING AND ADOPTING A BUDGET FOR THE CITY FOR THE FISCAL YEAR ]99]-92 Mayor Manning read the caption as follows: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS APPROVING AND ADOPTING A BUDGET FOR THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER ], ]99], THROUGH SEPTEMBER 30, ]992; PROVIDING FOR THE INTRA AND INTER-DEPARTMENT FUND TRANSFERS; PROVIDING FOR THE INVESTMENT OF CERTAIN FUNDS; PROVIDING THAT EXPENDITURES FOR SAID FISCAL YEAR SHALL BE MADE IN ACCORDANCE WITH SAID BUDGET; AND DECLARING AN EFFECTIVE DATE. Bill Hall said ~ome of the capital projects have been moved into the line item budget, ie, Witt Rd repair and Library irrigation. He said the Capital expenditures are the same as discussed. Councilman Burchard asked if we have increased the taxes to do those projects, then what will we do with the excess money next year, or do we decrease the taxes next year. Mayor Manning said that will have to be looked at next year. Bill Hall said everyone has stressed, not comparing years, but rather to asked for what is needed for this year only. Councilman Burchard said he is afraid if the money is there it will be spent. Mayor Manning said he is confident that staff doesn't work that way. Councilman Marks agreed with the Mayor. Motion to approve as written- Gomez; Second - Therio Motion carried with all members voting Aye,' except Councilman Burchard who voted No. Bill Hall said we had received notification today from the Government Finance Officer's Association that Mr. England had won the Certificate of Excellence for the second year. 7:3] p.m. 5. EXECUTIVE SESSION AS AUTHORIZED BY ARTICLE 6252-]7, V.A.C.S., SECTION 2G REGARDING PERSONNEL, TO-WIT: A. INTERVIEW FOR BOARD APPOINTMENTS 9:]6 p.m. Upon reconvening in open session, the following items were addressed: 4 6. CONSIDERATION OF ANY APPROPRIATE ACTION TO BE TAKEN AS A RESULT OF THE EXECUTIVE SESSION Motion to appoint Rob Bauman to B.O.A. - Gomez; Second - Therio Motion to appoint Cathy Bock-Wood to B.O.A. - Therio; Second - Sharp Motion to re-appoint Gene Poole to B.O.A. - Marks; Second - Burchard Motion to appoint Tim O'Neill to B.O.A. - Marks; Second - Therio Motion to appoint Vivian Preston to B.O.A. - Sharp; Second - Gomez Ail motions voted on together and carried with a unanimous roi1 call vote. Motion to appoint Gene Poole to Place 4 - Gomez; Second - Sharp Motion carried with all members voting Aye except Burchard who voted No. Motion to appoint Vivian Preston as Alternate No. ! - Therio; Second - Gomez. Motion carried with a unanimous roll call vote. 4. CONSIDERATION OF ACCEPTANCE AND AWARD OF BIDS FOR 3ANITORIAL SERVICES FOR THE MUNICIPAL COMPLEX AND APPROVAL OF AN ORDINANCE AUTHORIZING CONTRACT FOR SAME Mr. van Til said three bids were received ranging from $16,199.00 to $19,500.00, noting that the low bidder, Blackmon did not submit a complete bid. Mr. van Til said staff's recommendation is to award to Jani-King of Dallas, the second lowest bidder at $J7,928.00 Motion to accept the bids and award the contract to Jani-ling of Dallas~ and to approve the ordinance authorizing the contract - Gomez; Second - Burchard Motion carried with a unanimous roll call vote. 7. FIRST READING OF AN ORDINANCE PROVIDING A PERMIT OF CERTAIN ALARM SYSTEMS AND PROVIDING A SERVICE CHARGE FOR FALSE ALARMS Mr. Hall said this was addressed by Chief Gibson some time ago and that the fees committee bad recently reviewed this issue. Council was handed a list of false alarms indicating several in one day for some businesses. Mr. Hall said there has never been a false alarm ordinance, noting that S.B. 291 is now effective (9-1- 91) ~ allowing the regulation of burglar alarms by cities. Councilman Burchard said $50.00 permit fee is too high for residential systems and suggested $20.00 for homeowners. The Councilman also said we cannot start charging for false alarms until after the 5th false alarm and this ordinance reads on the 5th alarm the fee can be charged. Councilman Gomez agreed $50.00 a year is unreasonable, but suggested a one time fee of $50.00, with perhaps a smaller yearly maintenance fee. Councilman Marks asked if a section can be added to the 5 ordinance which requires that an alarm company has a permit before installation of the system. Mayor Manning asked if a permit is required for installation and Mr. Hall said no. Councilman Gomez said a requirement for a permit to install an alarm system should be part of the ordinance. Mayor Manning asked if there are standards and Councilman Marks advised there are national codes regarding such. Councilman Burchard said the average citizen will not know they need a permit, so the responsibility must lie with the installing company. Councilman Sharp agreed that $50.00 a year is too high, but thinks a one time fee is O.K. However, the Councilman does not see a need to differentiate between residences and businesses, noting that the response is the same for both. Councilman Sharp went on to say it will be hard to permit everyone, but after the first false alarm, the city will know they have a system and they will then have to permit it. Councilman Therio said most systems include a warning for the owner to check with their city regarding permits. Mayor Manning also agreed that $50.00 annually is to high but said the fee must cover the administrative costs of the program. Councilman Gomez said there should be a penalty for a non- registered alarm. Councilman Sharp agreed. Councilman Burchard asked Chief Gibson how many systems are in the city, what types they are and how many false alarms they generate. The Chief estimated ]00 systems and about 80% are through agencies, but had no idea how many false alarms are generated by which types. City Secretary Patti Hicks, said the ordinance will need to be re-written to include robbery and fire alarms, noting they were left out due to the wording of the legislation. She said, however, after visiting with the Chief, it was decided all types of alarms should be regulated. Councilman Marks said the initial fee should not cover all false alarms. Councilman Burchard said it costs the city more to respond to fire alarms and robbery alarms and therefore the charges should be higher. Motion to postpone and refer to committee - Sharp; Second - Burchard Councilman Gomez said he doesn't think this needs to go to committee. Motion carried with a unanimous roll call vote. 8. CONSIDERATION OF APPROVAL OF EMPLOYEE GONTRACTS Motion to approve contracts as written - Gomez; Second - Therio Motion carried with a unanimous roll call vote. 9:58 p.m. l. EXECUTIVE SESSION AS AUTHORIZED BY ARTICLE 6252-17, V.A.C.S., SECTION 2G, REGARDING PERSONNEL, TO-WIT: B.
