C~ 3-/7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS AUTHORIZING THE CITY MANAGER TO SEEK FCC CERTIFICATION TO REGULATE BASIC CABLE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Cable Television Consumer Protection and Competition Act of 1992 ("Cable Act") authorizes regulation of basic cable programming and equipment rates; and WHEREAS, the City must seek certification from the Federal Communications Commission ("FCC") before it can assume responsibility for rate regulation; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the above recitals are hereby found to be true and correct. SECTION 2. That the City Manager is hereby authorized to: (a) prepare, execute and file FCC Form 328, Certification for Local Franchising Authority; (b) prepare, execute and file any other instruments necessary or desirable to obtain FCC certification; and (c) take any other actions deemed necessary or desirable to obtain FCC certification. SECTION 3. That this Resolution shall take effect from and after its adoption and it is so resolved. PASSED AND APPROVED this ~.d~ ~, 1~93. ()~ff' / William W.
