HomeMy WebLinkAbout05/21/1990 City Council MINUTES OF THE CITY COUNCIL MEETING HELD ON MAY 21, 1990 The Regular Session of the City Council of the City of The Colony, Texas was called to order at 7:30 p.m. on the 21st day of May, 1990 at City Hall with the following Council roll call: Don Amick, Mayor Present Bill Manning, Councilman Present Steve Withers, Councilman Present Mike Alianell, Councilman Present Rob Burchard, Councilman Present Dick Weaver, Councilman Present Joel Marks, Councilman Present and with seven present, a quorum was established and the following items were addressed: 1. PLEDGE OF ALLEGIANCE Mayor Amick led the Council and audience in the Pledge of Allegiance to the flag of the United States of America. 2. CITIZEN INPUT None B. CONSIDERATION OF AN ORDINANCE CANVASSING AND DECLARING THE RESULTS OF A RUN-OFF ELECTION HELD IN THE CITY OF THE COLONY ON THE 19TH DAY OF MAY, 1990 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A RUN-OFF ELECTION HELD IN SAID CITY ON THE 19TH DAY OF MAY, 1990, FOR THE PURPOSE OF ELECTING TWO COUNClLMEMBERS FOR SAID CITY; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE I~'HEREAS, the election returns duly and legally made showed that there were cast at said election 484 valid and legal votes, and that each of the candidates in said election received the following votes: FORCOUNCILMAN PLACE 5 Kathy Phillips 131 Lou Gomez 131 FOR COUNCILMAN PLACE 6 Joel Marks 127 00862 Julia Warren 95 WH~AS, pursuant to Section 7.04 of Chapter VII of the Home Rule Charter of the City, in order to be declared elected, a candidate must receive a majority of the legal votes cast for the office or place for which such person is a candidate. ~}ltEII~AS, no one candidate in Place 5 received a majority of the votes cast; pursuant to Section 2.028 of the Texas Election Law; when the candidates in a runoff election tie, they shall cast lots to determine the winner. WHEREAS, the candidates in Place 5 both received One Hundred Thirty-one votes, constituting a tie, the candidates did cast lots, with the Presiding Officer of the final canvassing authority supervising the casting of lots. WHEREAS, this casting of lots was witnessed by personally selected representatives of each candidate, to-wit: Margo Overfelt for candidate Kathy Phillips and Tom Bogan for candidate Lou Gomez; and Staff witnesses being City Secretary, Patti Hicks; City Manager, Bill Hall; Chief of Police, N.C. Ristagno. NOW, THEREFORE' BE IT ORDAINED BY THE CITY COTJNCIL OF THE CITY OF THE COLONY, TEXAS: Section 3. That the duly elected members of the City Council of the City of The Colony, Texas, elected May 19, 1990, for Councilmember Place 5 and Councilmember Place 6, and subject to the taking of the oaths as provided by the laws of the State of Texas, are as follows: Councilmember Place 5 Lou Gomez Councilmember Place 6 Joel Marks Councilman Alianell moved to approve the ordinance as written, and Councilman Manning seconded the motion which carried with a unanimous roll call vote. 4. MAYORAL PROCLAMATION DECLARING THE WEEK OF AS PUBLIC WORKS WEEK IN THE COLONY Mayor Amick read the proclamation in its entirety as follows: '~IERF. AS, public works services provided in our community are an integral part of our citizens' everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works .--. systems and programs such as water, sewers, streets and highways, public buildings; and 003 20 ~#HEREAS, the health, safety, and comfort of this community greatly depends on these facilities and services; and WttEREAS, the quality and effectiveness of these facilities, as well as their planning, design and construction, is vitally dependent upon the efforts and skill of public works officials; and WHEREAS, the efficiency of the qualified and dedicated personnel who staff public works departments is materially influenced by the peoplets attitude and understanding of the importance of the work they perform, NOW, THEREFORE, I, Don Amick, Mayor of the City of The Colony, Texas do hereby proclaim the week of May 20 through May 26, 1990, as: NATIONAL PUBLIC~ORKSWEEK in the City of The Colony and call upon all citizens and civic organizations to acquaint themselves with the problems involved in providing our public works and to recognize the contributions which public works officials make every day to our health, safety, and comfort. Don Amick Mayor ATTEST: Patti A. Hicks City Secretary Ken Leverich and David Drake of the Public Works Department were present and accepted the proclamation. ADDITIONAL AGENDA ITEM 5. CONSIDERATION OF AN ORDINANCE REGARDING THE TEXAS UTILITIES ELECTRIC RATE CASE Mayor Amick read the caption of the ordinance as follows: AN ORDINANCE APPROVING RATE SCHEDULES TO BE CHARGED BY TEXAS UTILITIES ELECTRIC COMPANY IN THE CITY OF THE COLONY, TEXAS, PROVIDING FOR SCHEDULES, CONDITIONS, SEVERABILITY; REPEAL OF CONFLICTING ORDINANCES gill Hall addressed the subject, giving a brief overview of the rate case, stating that a proposal was received in early February for an increase in rates from T.U.E. Mr. Hall reminded Council that we have passed a resolution regarding this matter, suspending rates until May 21, 1990 and joining a steering committee chaired by the City Attorney of Arlington. Councilman Weaver also reviewed the actions taken previously 93626 by Council, noting if we take no action, then we will have to accept the PUC decision and went on to recorrrnend passage of this ordinance. Bill Hall explained the model ordinance which was received from Arlington and after a brief discussion, Councilman Manning moved to approve the ordinance and Councilman Weaver seconded the mot ion. Councilman Marks asked if we would be out any more money and Mr. Hall stated we would not. There followed a brief discussion regarding the money we have paid, if it is reimbursable, etc. John Weinberg, representing T.U.E. briefed the Council on proposed dates for Public Hearings and responded to questions from Council regarding the case. With no further discussion, the motion to approve the ordinance was approved with a unanimous roll call vote. Mayor Amick at this time, directed the Council to give thought to the election of a Mayor Pro-rem and noted that Board liaison appointments would be made soon. With no further business to address, Councilman Alianell moved to adjourn and Councilman Manning seconded the motion which carried with all members voting Aye.
