HomeMy WebLinkAbout03/20/1989 City Council MINUTES OF THE CITY COUNCIL MEETING HELD ON MARCH 20, 1989 The Regular Session of the City Council of the City of The Colony, Texas was called to order at 7:30 p.m. on the 20th day of March, 1989 at City Hall with the following Council roll call: Don Amick, Mayor Absent Rick Harris, Mayor Pro-tem Present Johnny Spears, Councilman Present Noretta Sipe, Councilman Present Steve Glazener, Councilman Present Dick Weaver, Councilman Present Joel Marks, Councilman Present and with six present, a quorum was established and the following items were addressed: 1. PLEDGE OF ALLEGIANCE Mayor Pro-tem Harris led the audience and the Council in the Pledge of Allegiance to the flag of the United States of America. 2. CITIZEN INPUT There were citizens signed up to speak at this time. 3. MAYORAL PROCLAMATION DECLARING APRIL 9 - 15, 1989 TEXAS ARCHEOLOGICAL AWARENESS WEEK Mayor Pro-tem Harris read the proclamation in its entirety as follows: W~EREAS, Texas' heritage is rich in cultural diversity as represented by the numerous archeological and historic sites within our State; and WHEREAS, preservation of Texas' prehistoric and historic archeological sites offer significant cultural, educational and economic benefits to all citizens; and WHEREAS, each archeological and historic site is a unique and irreplaceable part of Texas history; and WHEREAS, many professional and avocational archeologists and other citizens and organizations strive to preserve and protect Texas' archeological and historic sites; and WHEREAS, the Texas Historical Commission, Texas Archeological Society, Council of Texas Archeologists and the Texas Historical Foundation have joined with museums, local archeological societies, county historical commissions and other preservation groups to promote public awareness and involvement in protecting these significant cultural resources; and WHEREAS, Archeology Awareness Week offers an opportunity for all citizens to reflect on Texas' unique legacy and the contributions archeological investigations offer in interpreting and understanding the past; NOW, THEREFORE, I, Rick Harris, Mayor Pro-tem of the City of The Colony, Texas, do hereby proclaim April 9 - 15, 1989 as TEXAS ARCHEOLOGY AWARENESS WEEK SIGNED AND SEALED this 20th day of March, 1989. CONSENT AGENDA Mayor Pro-tem Harris summarized the items on the Consent Agenda for the Council and those present in the audience. A. CONSIDERATION OF APPROVAL OF MINUTES FOR THE COUNCIL MEETING HELD MARCH 6, 1989 Councilman Spears moved to approve the minutes as written and Councilman Glazener seconded the motion which carried with a unanimous roll call vote. B. CONSIDERATION OF A JOINT USE AGREEMENT WITH LEWISVILLE INDEPENDENT SCHOOL DISTRICT Bill Hall, City Manager explained that the B.B. Owens Elementary P.T.A. had purchased playground equipment for the school but did not have the manpower to install the equipment. This agreement is an interlocal agreement between the City and L.I.S.D. whereby the City furnishes the necessary manpower to install and maintain the equipment and the school district will leave the playground open for public use as a pocket park for that area. Councilman Spears moved to approve the agreement and Councilman Glazener seconded the motion which carried with a unanimous roll call vote. 5. CONSIDERATION OF A RESOLUTION PETITIONING DENTON COUNTY COMMISSIONERS COURT TO IMPLEMENT A JOINT MEDICAL EXAMINER DISTRICT Mayor Pro-tem Harris read the resolution in its entirety as follows: W~EREA$, Denton County's population is in excess of 250,000 and is one of the most rapidly growing counties in the nation; and WHEREAS, the growing number of violent deaths in Denton County need greater investigative resources than are currently available through the seven Justice courts, and WHEREAS, a standardized investigation of deaths will provide a safer, more crime-free community; and WHEREAS, Denton County already budgets $100,000 for autopsies, alone, and a Joint-Medical Examiner District would only cost an additional $100,000 to $150,000 for full medical- examiner services NOW, ~{EREFORE, BE I? RESOLVED, that the City Council of the City of the Colony, Texas, hereby petitions the Commissioners Court of Denton County to implement a Joint-Medical Examiner District into the 1989-1990 budget. Hicks, City Secretary Mr. Bill Hall explained that Judge Jeff Mosely, the Justice of the Peace in our city currently acts as medical examiner in this precinct and is sometimes uncomfortable with making a determination in some deaths. Mr. Hall went on to say that other precincts have the same problem, since none of them are physicians, and that all the precincts are urging Denton County Commissioners Court to establish a joint medical examiner 00322o district, noting that funds are already allocated by the County through the various justice precincts. Councilman Weaver asked if one man would be handing all 7- 8 justice precincts or would there be more than one, noting it would be impossible for one man to handle the entire county. Mr. Hall said he was unsure of the number of doctors to be available, but there would be one medical examiner and a staff, reminding everyone that a medical examiner is not required in all deaths. Mayor Pro-tem Harris said this is only a resolution supporting the concept, not the method in which it will be accomplished. Councilman Glazener moved to approve the resolution and Councilman Spears seconded the motion which carried with a unanimous roll call vote. 6. CONSIDERATION OF APPROVAL OF A SITE PLAN AS PRESENTED BY BRAUM'S ICE CREAM STORE, INC. TO BE LOCATED AT THE INTERSECTION OF MAIN STREET AND CHOWNING CIRCLE Mayor Pro-tem Harris advised the Council and the audience that the site plan has been sent to the main office in Oklahoma and that it had not received in time for tonight's meeting. Councilman Spears moved to table this item to the April 3, 1989 meeting and Councilman Marks seconded the motion which carried with a unanimous roll call vote. 7. CITY MANAGER'S REPORT Mr. Bill Hall reported to Council on the recent FEMA seminar attended by himself, Fire Chief Van Morrison, and Captain Mike Carroll of the Police Dept. Mr. Hall said the seminar was very informative, touching on railroad and lake emergencies as well as tornadoes. The City Manager said the City does have an emergency management plan, however, he would like to get with the council and conduct a mock hazard. Councilman Marks asked why the pool was to be closed during Spring Break. Mr. Hall said the pool was kept open last year and was not very busy. Councilman Marks asked if it could be opened, and Mr. Hall said he would look into it, noting that no requests to staff had been made for that and reminded everyone that the indoor pool is open. EMERGENCY AGENDA ITEM 1. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17, V.A.C.S., SECTION 2E, REGARDING LITIGATION, TO-WIT: A. EXTENDED AREA SERVICE Upon reconvening in open session, and with no business to address as a result of the closed door session, Councilman Marks moved to adjourn.
