CITY OF THE COLONY, TEXAS RESOLUTION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE SUBMISSION OF A GRANT
APPLICATION TO THE TEXAS DEPARTMENT OF TRANSPORTATION
FOR PARTICIPATION IN THE TRANSPORTATION ENHANCEMENT
PROGRAM; DESIGNATING CERTAIN OFFICIALS AS BEING
RESPONSIBLE FOR ACTING FOR AND ON BEHALF OF THE CITY OF
THE COLONY IN DEALING WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION; PLEDGING PAYMENT OF THE LOCAL SHARE OF
THE COST OF THIS PROGRAM; AND DECLARING AN EFFECTIVE
DATE
WHEREAS, the United States Congress has passed the Intermodal Surface
Transportation Efficiency Act of 1991 authorizing the Federal Highway Administration to
provide financial assistance to states, and political subdivisions thereof, for transportation
enhancement programs; and
WHEREAS, the Texas Transportation Commission has adopted rules for the
Statewide Transportation Enhancement Program for the purpose of allowing the State of
Texas, and its political subdivisions, to participate in the Federal program; and
WHEREAS, the City Council of the City of The Colony is desirous of participating
in the Transportation Enhancement Program of the Texas Department of Transportation
and pledges its proportionate share of the cost of this project, as required, if a grant is
obtained;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the City Council of the City of The Colony hereby certifies that
the City of The Colony is eligible to receive assistance under the Transportation
Enhancement Program.
SECTION 2. That the City Council hereby authorizes and directs the City Manager
or his designee to represent and act for the City of The Colony in dealing with the Texas
Department of Transportation for the purpose of this program. The City Manager or his
designee is hereby officially designated as the City's representative to enter into an interlocal
agreement between the City of The Colony and the Texas Department of Transportation
for the purposes of this program.
SECTION 3. That the City Council hereby specifically authorizes the City to make
application to the Texas Department of Transportation concerning the beautification of FM
423 at SH 121. And that the City of The Colony commits twenty percent (20%) to the
project cost as required under the program rules as a local match for the project, if a grant
is obtained.
SECTION 4. That the City Council on recommendation of The Colony Parks and
Recreation Board, and having found that this project is consistent with the North Central
Texas long range transportation plan, supports the application for the beautification of park
land on Farm to Market Road 423 at State Highway 121 and recommends this park project
be funded.
SECTION 6. That this resolution shall take effect from and after its passage.
