HomeMy WebLinkAbout09/14/1987 City Council MINUTES OF THE CITY COUNCIL MEETING HELD ON SEPTEMBER 14, 1987 The Special Session of the City Council of the City of The Colony, Texas was called to order t 7:30 p.m. on the 14th day of September, 1987 at City Hall with the following Council Roll call: Don Amick, Mayor Absent Rick Harris, Mayor Pro-tem Present Johnny Spears,Councilman Present Mike Robinson,Councilman Absent Steve Glazener,Councilman Present Harvey Bradley,Councilman Present Marlene Poole,Councilman Absent and with four members present a quorum was established and the following items were addressed: Mayor Pro-tem Harris opened the meeting by leading the audience and the Council in the Pledge of Allegiance to the flag of the United States of America. 1. PUBLIC HEARING CONTINUED FROM AUGUST 31, 1987 ON APPLICATION OF FIGANO'S RESTAURANT AND CLUB FOR A CHANGE OF ZONING ON PROPERTY PRESENTLY ZONED SHOPPING CENTER, SEEKING TO HAVE THE COMPREHENSIVE ZONING ORDINANCE AND ZONING MAP OF THE CITY AMENDED SO AS TO GIVE THE FOLLOWING DESCRIBED PROPERTY A SPECIFIC USE CLASSIFICATION FOR THE SALE OF LIQUOR, INCLUDING BEER AND WINE FOR ON-PREMISE CONSUMPTION 6700 NORTH MAIN STREET Councilman Spears moved to re-open the Public Hearing and Councilman Glazener seconded the motion which carried with all members voting Aye. Councilman Spears asked the owner, Ron Johnson when the restaurant would be opened, to which Mr. Johnson replied, about October 12th. Councilman Spears also asked if this had been to P & Z and if they recommended approval. Mr. Van Til said it had and that P & Z as well as staff recommend approval. Mr. Johnson said he hopes to have a nice facility. Councilman Bradley asked if they would be open for breakfast and how many persons the restaurant would seat. Mr. Johnson said they would be open for breakfast and he believes they can accommodate approximately 200 persons. Mr. Johnson said he has restaurants in Plano and Allen and stated that this restaurant would not have a band at first and that he hopes this will be a nice, fun place for all the family. Mayor Pro-rem Harris reminded Mr. Johnson that he will have to go to the Police Dept. to obtain permits for the pool tables and coin-operated amusement devices. Mr. Ken Wood asked if there were adequate fire exits. Mr. Johnson replied there are 5. Councilman Bradley moved to close the Public Hearing and Councilman Spears seconded the motion which carried with all members voting Aye. 2. CONSIDERATION OF AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY GRANTING AND APPROVING A SPECIFIC USE PERMIT FOR FOLLOWING DESCRIBED PROPERTY IN THE SC, SHOPPING CENTER DISTRICT FOR THE SALE OF LIQUOR, INCLUDING BEER AND WINE FOR ON-PREMISE CONSUMPTION 6700 NORTH MAIN STREET Mayor Pro-tem Harris read the caption of the Ordinance as 00276 follows: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ORDINANCE NO. 61, AS AMENDED, PASSED AND APPROVED ON JUNE 4, 1979, THE SAME BEING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS, BY GRANTING AND APPROVING A SPECIFIC USE PERMIT FOR A RETAIL STORE IN THE SC, SHOPPING CENTER DISTRICT AND LOCATED WITHIN THE AREA OF THE STRUCTURE DESIGNATED ON THE SITE PLAN ATTACHED AS EXHIBIT "A" AS APPROXIMATELY SIXTY FOUR FEET (64)' BY ONE HUNDRED FORTY FEET (140') AREA: LOCATED AT 6700 NORTH MAIN STREET (FM 423)SUITE 126; PROVIDING FOR CERTAIN CONDITIONS OF APPROVAL; REQUIRING COMPLIANCE WITH THE SITE PLAN; CORRECTING THE OFFICIAL COMPREHENSIVE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR NOR MORE THAN ONE THOUSAND DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE Councilman Spears moved to approve the ordinance as written and Councilman Bradley seconded the motion which carried with a unanimous roll call vote. With no further business to address Councilman Glazener moved adjourn the meeting and Councilman Bradley seconded the motion which carried with all members voting Aye.
