HomeMy WebLinkAboutResolution No. 93-32,- ORIGINAL CITY OF THE COLONY, TEXAS RESOLUTION NO. 93-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS ESTABLISHING PROCEDURES AND GUIDELINES FOR THE USE OF STEWART CREEK PARK FOR SPECIAL EVENTS; DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of The Colony, Texas recognizes the importance of promotion of the city by supporting special city wide events; and WHEREAS, the use of City parks and facilities is encouraged for those events; and WHEREAS, there have been several events of this type held at Stewart Creek Park for all citizens of The Colony; and WHEREAS, the City Council believes it is important to establish procedures and guidelines for the use of Stewart Creek Park for Special Events; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: 1. That the following events held at Stewart Creek Park be granted "Special Events" status: A. The Annual Chili Cook-off B. Sail Fair C. One Open Event 2. That a "Special Event" will have the option of charging an entry or admission fee to off-set the cost of promotion, reimbursement of special performers or participants or exhibitors. 3. That the Stewart Creek Park Season passes shall be marked "Not Valid for Special Events", providing, however, that there shall be no "Special Events" allowed on holiday weekends, including, but not limited to, July 4th, Labor Day, or Memorial Day. 4. That if, in the event a "day pass" to Stewart Creek Park is purchased through a source other than the Gate Attendant at the park, during the time a "Special Event" is occurring, the City shall refund the cost of that pass to the purchaser. 5. That the following requirements shall be met by "Special Events": A. Have a goal consisting of one or both of the following: * Promotion of the City of The Colony * Raising funds for other civic ventures B. Notification of the event, by those named "Special Events", shall be submitted to the Parks and Recreation Department at least ninety (90) days prior to the scheduled date of the events. C. Request for "Special Events" status by the promoters of the one open event shall be submitted to the Parks and Recreation Board at least ninety (90) days prior to the schedule date of the event. Such request will consist of the groups' goals and plans for the use of Stewart Creek Park. The Parks and Recreation Board shall review the request and subsequently make recommendation to the City Council regarding approval or denial of the request. D. If a "Special Event" chooses to charge an entry or admission fee, ten percent (10%) of that entry or admission fee shall be paid to the City of The Colony to be deposited into the Stewart Creek Park Fund to off-set lost revenues. Payment of the ten percent (10%) surcharge and an accounting of ticket sales and attendance will be made to the City within five (5) days after the event's conclusion. If, due to extenuating circumstances, the event is unable to pay the ten percent (10%) surcharge within five (5) days, an extension, not to exceed thirty (30) days may be granted by the City. It is understood that volunteers and certain participants of a particular event may be granted special passes into the park and that there will be no ten percent (10%) surcharge assessed for those passes. An accounting of those passes shall be made available to the City. E. During "Special Events", the boat ramp will be open and available for public use. F. The use of City assets will be limited to public safety, operation and maintenance of Stewart Creek Park. 6. That this resolution shall be effective from and after it's passage.
