HomeMy WebLinkAboutResolution No. 91-01 CITY OF THE COLONY, TEXAS RESOLUTION NO. 91-01 RESOLUTION REQUESTING FINANCIAL ASSISTANCE FROM THE TEXAS WATER DEVELOPMENT BOARD, AUTHORIZING THE SUBMISSION OF AN APPLICATION, DESIGNATING AN OFFICIAL REPRESENTATIVE AND MATTERS RELATED THERETO THE STATE OF TEXAS COUNTY OF DENTON CITY OF THE COLONY WHEREAS, the City of The Colony, Texas (the "City") proposes to make additions and improvements to its combined waterworks and sewer system (the "Project") and to issue revenue bonds to finance the Project. WHEREAS, the City cannot reasonably finance the Project without assistance from the Texas Water Development Board in the approximate amount of $1,330,000. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The statements contained in the preamble of this Resolution are true and correct and are adopted as findings of fact. Section 2. By this Resolution, the City requests financial assistance from the Texas Water Development Board Water Development State Revolving Fund and authorizes the submission of an application for financial assistance to the Texas Water Development Board. Section 3. The Mayor of the City is hereby designated as its official representative and is authorized to execute and submit an application with the Texas Water Development Board for financial assistance to make additions and improvements to its waterworks and sewer system. Section 4. The City's Mayor and City Manager, the City's Financial Advisor, First Southwest Company, and the City's Bond Counsel, Hutchison Boyle Brooks & Fisher, a Professional Corporation, are hereby authorized to appear before the Texas Water Development Board on behalf of the City regarding its request for financial assistance. 1122e/2 '~ PASSED and APPROV / · ,. 7' :'- ,~ ' ' / ~ t. The City Council of the City convened in regular Session on Monday, January 21, 1991, at the regular meeting place thereof, and the roll was called of the duly constituted officers and members of the City Council, to-wit: Bill Manning, Mayor Steve Withers, Mayor Pro Tem Mike Lynch, Councilmember Mike Alianell, Councilmember Rob Burchard, Councilmember Lou Gomez, Councilmember Joel Marks, Councilmember and all of said persons were present, except for the following: Bill M~nning ; thus constituting a quorum. Whereupon, among other business, the following was transacted at said meeting: a written Resolution entitled RESOLUTION REQUESTING FINANCIAL ASSISTANCE FROM THE TEXAS WATER DEVELOPMENT BOARD, AUTHORIZING THE SUBMISSION OF AN APPLICATION, DESIGNATING AN OFFICIAL REPRESENTATIVE AND MATTERS RELATED THERETO was duly introduced for consideration of the City Council and read in full. It was then duly moved and seconded that said Resolution be passed; and, after due discussion, said motion, carrying with it the passage of said Resolution, prevailed and carried by the following vote: AYES: Six NOES: None 2. A true, full and correct copy of the aforesaid Resolution passed at the meeting described in the above and foregoing paragraph is attached to and follows this 1122S/4 " Certificate; said Resolution has been duly recorded in the ' official minutes of the City; the above and foregoing paragraph ~is a true, full and correct excerpt from said minutes of said meeting pertaining to the passage of said Resolution; the · persons named in the above and foregoing paragraph, at the time of said meeting and the passage of said Resolution, were the duly chosen, qualified and acting officers and members of the City Council of the City as indicated therein; each of said officers and members was duly and sufficiently notified officially and personally in advance, of the time, place and purpose of the aforesaid meeting and that said Resolution would be introduced and considered for passage at said meeting, and each of said officers and members consented in advance to the holding of said meeting for such purpose; and said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Ann.
