MINUTES OF THE CITY COUNCIL MEETING
HELD ON
SEPTEMBER 22, 1986
The SPECIAL SESSION of the City Council was called to order at 7:00 p.m. on the
22nd day of September, 1986 by Mayor Pro-rem Amick. Following was the Council
roll call:
Larry D. Sample Mayor - Absent due to personal business
Rick Harris Councilman - Present
Tom Arrambide Councilman - Present
David W. Dye, III Councilman - Present
Don Amick Mayor Pro-rem - Present
Harvey Bradley Councilman - Present
Marlene Poole Councilman - Absent due to personal
business
and with 5 members present a quorum was established and the following items of business
were addressed:
1. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17, V.A.C.S., SECTION
2G, REGARDING PERSONNEL, TO WIT:
A. MAYOR'S VACANCY
Upon reconvening in open session, and with no action taken as a result of the Closed
Door, the Council addressed the following:
EMERGENCY AGENDA ITEM
1. RECEIVE REPORT REGARDING THE LEGAL OPINION OF FILLING A VACANCY IN
OFFICE, ACCORDING TO THE HOME RULE CHARTER, SECTION 2.06
Janice Carroll, City Manager referred to a letter received from John Boyle, City
Attorney, in which he stated that a written letter of resignation may be accepted
by the Council today to be effective on October 2, 1986 at a certain time, creating
a vacancy, and then an appointment can be made today to be effective October
2, 1986 at the same time, which will then create another vacancy and that vacancy
should be filled by appointment within 30 days. Mr. Boyle stated that the Mayor
and Councilmember are two separate positions and referred to Chapter 2 of the
Charter. There;-wasbrief discussion and a few questions from the audience, one
being from Scott North questioning Mr. Boyle's opinion that he Mayor and the
Councilman are separate positions. Mayor Pro-rem Amick stated that Council would
ask Mr. Boyle to look into this matter further and get back with them. Janice
Carroll pointed out in the Charter the sections to which Mr. Boyle referred.
2. CONSIDERATON OF ACCEPTANCE OF THE RESIGNATION OF THE MAYOR
Councilman Harris moved to accept the resignation of Mayor Larry Sample, effec-
tive October 2, 1986 at 11:59 p.m. Councilman Bradley seconded the motion which
carried with a unanimous roll call vote.
3. CONSIDERATION OF THE APPOINTMENT OF THE MAYOR TO SERVE UNTIL THE
NEXT REGULAR ELECTION IN APRIL 1987.
Councilman Harris moved to appoint Don Amick as Mayor to be effective at 11:59
p.m. on October 2, 1986. Councilman Dye seconded the motion which carried
with four Ayes and Councilman Ai~iick abstaining.
Scott North stated that Councilman Amick would have to resign his Council place
to serve as Mayor and then asked if Amick would be running in April for Mayor.
Mayor Pro-rem Amick stated he would, going on to say that per the Charter a
replacement for Councilman Place 4 would be made by appointment of a citizen
from.that district.
At that time, with no further business to address Mayor Pro-tem called agenda item
#1 back to the table.

B. CITY MANAGER AND ASSISTANT CITY MANAGER POSITIONS
Upon reconvening in open session and with no action to be taken as a result of the
Closed Door, Councilman Harris moved to adjourn the meeting and Councilman Dye
seconded the motion, which carried with all members voting Aye.
Mayor Pro-tem Amick adjourned the meeting at 10:30 p.m.
