HomeMy WebLinkAbout06/09/1986 City Council MINUTES OF THE CITY COUNCIL MEETING HELD ON JUNE 9, 1986 The SPECIAL SESSION of the City Council of the City Council was called to order at 7:30 p.m. at City Hall on the 9th day of June, 1986. Attendance of the Council members was as follows: Larry D. Sample, Mayor Present Rick Harris, Councilman Present Tom Arrambide, Councilman Present David W. Dye, III, Councilman Present Don Amick, Councilman Present Harvey Bradley, Councilman Present Marlene Poole, Councilman Absent due to illness with Councilman Poole absent a quorum was established and the following items were addressed. EMERGENCY AGENDA ITEM 1. CONSIDERATION OF AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AUTHORIZING THE MAYOR OF THE CITY TO ENTER INTO A CONTRACT AND MUTUAL AGREEMENT TO EFFECTUATE CONSOLIDATION OF THE COLONY MUNICIPAL DISTRICT NO. 1 OF DENTON COUNTY, TEXAS INTO THE CITY OF THE COLONY; AUTHORIZING THE MAYOR TO ENTER INTO A SUPPLEMENTAL CONTRACT AND MUTUAL AGREEMENT TO EFFECTUATE CONSOLIDATION OF THE COLONY MUNICIPAL UTILITY DISTRICT NO. 1 OF DENTON COUNTY, TEXAS INTO THE CITY OF THE COLONY; AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT AND MUTUAL AGREEMENT TO DISSOLVE THE COLONY MUNICIPAL UTILITY DISTRICT NO. 1 OF DENTON COUNTY, TEXAS; RATIFYING, APPROVING AND AFFIRMING ALL PREVIOUS ACTS OF THE CITY COUNCIL AND THE MAYOR RELATING TO EXECUTING THE ABOVE LISTED CONTRACTS AND MUTUAL AGREEMENTS; PROVIDING A SEVERABILITY CLAUSE;DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. Mayor read the caption of the ordinance as written above in the agenda item, noting that this ordinance ratifies any and all previous acts of the Council regarding the City/MUD merger and declaratory judgment. Councilman Amick moved to approve the Ordinance as written, and Councilman Bradley seconded the motion which carried with all members voting Aye. REGULAR AGENDA ITEMS: 1. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6251-17, VACS, SECTION-2G, REGARDING: BOARD APPOINTMENTS: PLANNING AND ZONING COMMISSION 2. CONSIDERATION OF APPOINTMENT TO THE: PLANNING AND ZONING COMMITTEE FINE ARTS COMMITTEE 1. WIN CHRISTIANSEN 2. SUSAN PHILLIPS 3. DORIS MILLS Councilman Amick moved to appoint Agnes Foster to serve on the Planning and Zoning Commission. Councilman Harris seconded the motions which carried with all members voting Aye. Councilman Harris moved to appoint Debbra Kurtz, Win Christiansen, Susan Phillips, and Doris Mills to the Fine Arts Committee. Councilman Amick seconded the motion which carried with all members voting Aye. EMERGENCY AGENDA ITEM: 2. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17, V.A.C.S., SECTION 2E, REGARDING LITIGATION, TO WIT: A. Declaratory Judgment for the City of The Colony and The Colony Municipal Utility District No.1 of Denton County, Texas. B. Possible appeal of the P,U,C, decision regarding the moving of utility easement through The Colony. After reconvening in open session with no further business to address, Councilman Amick moved to adjourn teh meeting. Councilman Harris seconded the motion which carried with all members voting Aye.
