HomeMy WebLinkAbout05/15/1986 City Council MINUTES OF THE CITY COUNCIL MEETING HELD ON MAY 15, 1986 The SPECIAL SESSION of the City Council was called to order at7:30 p.m. at the offices of the Municipal Utility District, on the 15th day of May, 1986 with the following members present: CITY COUNCIL Larry D. Sample Mayor Rick Harris Councilman David W. Dye, III Councilman Don Amick Councilman Harvey Bradley Councilman with Councilman Arrambide late and Councilman Poole absent due to business, a quorum was established. (Councilman Arrambide did arrive at approximately 8:20p.m.) M.U.D. BOARD Johnny Spears Dick Weaver Scott North Robert Hauck Earl Hale, Attorney Bill Hall, Director 1. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17, SECTION 2E, REGARDING PENDING LITIGATION, TO WIT: A. Declaratory judgment for the City of The Colony, Denton County, Texas and The Colony Municipal Utility District No.1, of Denton County, Texas Upon reconvening in open session the following items were addressed: 2. RECEIPT AND CONSIDERATION OF APPROVAL OF A REPORT FROM DELOITTE, HASKINS AND SELLS Councilman Amick moved to approve the report from Deloitte, Haskins and Sells as presented. Councilman Harris seconded the motion which carried with all members voting Aye. At this time, Member North of M.U.D. moved that D.H.S. be paid $3500.00 for the report. Member Weaver seconded the motion which carried with all M.U.D. members voting Aye. 3.CONSIDERATION OF AUTHORIZING DELOITTE, HASKINS AND SELLS TO PROCEED TO THE THIRD PHASE. Councilman Amick moved to deny the authorization. Councilman Harris seconded the motion which carried with all members voting Aye. 4. CONSIDERATION OF AUTHORIZING THE MAYOR TO ENTER INTO A MUTUAL AGREEMENT WITH THE CITIES OF EASTVALE AND LEWISVILLE TO DISSOLVE THE COLONY MUNICIPAL UTILITY DISTRICT NO. 1 OF DENTON COUNTY, TEXAS. Councilman Amick moved to approve the authorization and Councilman Bradley seconded the motion which carried with all members voting Aye. At this time the Mayor called the Council back into Closed Door Session. At this time, Councilman ArramBide arrived at the meeting. 5. CONSIDERATION OF AUTHORIZING THE CITY ATTORNEY TO FILE A DECLARATORY JUDGMENT FOR THE CITY OF THE COLONY, DENTON COUNTY, TEXAS AND THE COLONY MUNICIPAL. UTILITY DISTRICT NO. 1 OF DENTON COUNTY TEXAS PURSUANT TO THE AUTHORITY CONTAINED IN AND IN ACCORDANCE WITH ARTICLE 717m-1, TEX. REV. CIV. STAT. ANN. Councilman Harris moved to table this item until the June 2, 1986 meeting. Councilman Amick seconded the motion which carried with all members voting Aye. With no further business to discuss Councilman Bradley moved to adjourn the meeting. Councilman Amick seconded the motion which carried with all members voting Aye.
