MINUTES OF THE CITY COUNCIL MEETING
HELD ON
SEPTEMBER 11, 1985
The WORK SESSION of the City Council of the City of The Colony
was called to order at 7:30 p.m. with the following members present:
Larry D. Sample Mayor
Rick Harris Councilman
Tom Arrambide Councilman
Helen Gray Councilman
Don Amick Councilman
Charles Dodds Councilman
and with Councilman Marlene Poole absent due to being out of town,
however a quorum was established.
1. REVIEW PROPOSED BUDGET FOR 1985/86
Janice Carroll, City Manager opened the discussion by presenting
a report of the September 1985 financial summary. She stated
that the carry over is now at $274,000.00. Carroll went on to
explain that one reason revenue is down this year is due to the
fact that there are fewer rental properties in the City now,
causing the revenue from the Single Family Licensing program to
be down. Mayor Sample stated that this program should be a
break-even program. At this time, Carroll requested Jane Barton,
Financial Assistant to prepare an estimate on those figures.
The Mayor went on to say that if the program is not self-supporting
then the fees should raised. Jane Barton stated that the expendi-
tures per year for this program are $67,000.00 and the revenue from
the programs is estimated to be coming in at $34,000.00. Mayor
Sample requested Janice Carroll to have an analysis done on the
program and check into the possibility of raising the fees.
Councilman Dodds suggested that if the City decides to pass the
new Child Care Ordinance, which is now before the Planning and
Zoning Commission, and'the same person is responsible for licensing
Single Family Residents as would be responsible for licensing
Child Care in the home, then prehaps the programs would be more
cost recovery.
There then followed a lenghty discussion regarding the new
Child Care Ordinance, in which Janice explained where the idea
came from to even propose such an ordinance. She stated that it
was brought out to the Planning and Zoning Commission that as
our Zoning ordinance is written all persons keeping over 4
children in their home should have to come before the Commission
and request a Specific Use Permit at a cost of $100.00. Carroll
said this has never been enforced but that it was generally felt
that perhaps these persons should be required to get a permit
and that that portion of the ordinance be removed from the
Zoning ordinance. She said that this had not been a staff re-
commendation. She went on to say that at this time, if the
city became aware of someone in violation of this ordinance, they
could be ticketed. Mayor Sample said he felt that if we received
a complaint then those persons chould be given a ticket. He said
that is a lot different from licensing child care.
Councilman Dodds stated that he felt the City would overlooking
a problem if they did not address this area. He said that
effective what the City is doing is causing someone who is
doing nothing wrong to be in an illegal status as far as the
zoning requirements go. The Mayor said that the illegality had
nothing to do with whether or not they were doing a good job, but
with the zoning ordinance. Councilman Dodds said he did not think
it was inappropriate for persons to keep children in their home,
and that he felt it is inappropriate to require those persons to
apply for a specific use permit through the Planning and Zoning
Commission. Councilman Amick suggested that Councilman Dodds
be appointed to study this so that the Budget workshop could be
continued.
There was then a discussion regarding the fee for single family

residence building permits. The Council felt that the fee had
just been raised in the last few months to $500.00. Janice
Carroll said that she believed the fee was raised last fall
to $400.00 and had not been raised since that time. The Mayor
requested that be checked into.
Councilman Amick suggested that the City go ahead and inform
the Cable Company that we are going to start charging the
additional 2%. Janice Carroll said Mr. Musser had requested
the City wait until after the first of the year. Councilman
Amick stated that he felt it should be done now because when
it was asked for before the Cable Company had asked us to wait
and now they are asking us to wait again. He went on to suggest
that the City go ahead and request that increase now.
Mayor Sample asked again what the fee is for building permits.
It was determined to be $400.00 and he stated that he felt it
should be raised to $500.00 Janice Carroll said she would have
it studied and analyzed. Carroll then asked if the Council wanted
these changes in the new budget. Mayor said it is not necessary
to put the changes in the budget before finalization but that he
does want to see the changes made, ie.: Cable T.V. franchise raised
2%, Single Family Resident licensing raised, and the Building Permit
fee for a single family residence raised to $500.00. At this
time, Jane Barton stated raising the Cable T.V. franchise by 2%
would add approximately $35,000.00 to the revenue.
In further discussion regarding the revenue, Mayor Sample stated
he wanted the revenue amount shown to come in from Stewart's Creek
Park to be lowered to $35,000.00.
Council then went on to discuss salaries in general. The Mayor
did say that he felt a smaller increase should be looked into
for the Fire Department in regard to the new Federal guidelines.
Management level increases were discussed. Also the Mayor asked
that the Volunteer Fire Department accrual be looked at as far
as being done on a monthly basis, instead of yearly.
Janice Carroll said that the Library Budget needed to be discussed.
After some discussion it was decided that there should be no
increase in hours or servie at the Library this budget year and
that the staff would be one full time and 3 part time, with the
consideration of one of the part time positions possibly becom-
ing fulltime in the future, based on needs.
It was decided to buy two truck for the Public Works department,
one for Jerry Van-Y to drive and one for the fleet.
With no further discussion Councilman Dodds moved to adjourn the
meeting and Councilman Arrambide seconded the motion which carried
with all members voting Aye.
