MINUTES OF THE CITY COUNCIL HELD ON JUNE 24, 1985 The Special Session of the City Council of the City of the Colony, Texas was called to order with all members present as follows: Larry D. Sample Mayor Rick Harris Councilman Thomas Arrambide Councilman Helen Gray Councilman Don Amick Councilman Charles Dodds Councilman Marlene Poole Councilman With all members present, a quorum was established. 1. PLEDGE OF ALLEGIANCE Mayor Sample led the Council and members of the audience in the pledge of allegiance. 2. PUBLIC HEARING REGARDING AMENDING THE COMPREHENSIVE ZONING ORDINANCE TO GIVE THE PROPERTY AT 4916 MAIN STREET (STOP N GO) A SPECIF~ USE CLASSIFICATION FOR THE SALE OF BEER AND WINE FOR OFF-PREMISE CONSUMPTION Councilman Dodds moved to open the public hearing. Seconded by Councilman Poole, the motion carried with a unanimous vote. City Manager, Janice Carroll, said the original store was selling beer and wine prior to the establishment of the SP zoning. Harvey Bradley, a member of the Planning and Zoning Commission said he would like to see an ordinance that restricts distances of establishments like this from schools, churches, etc. He felt the City was getting to many of these businesses. Councilman Poole moved to close the public hearing. Seconded by Councilman Dodds, the motion carried with a unanimous vote. 3. CONSIDERATION OF AN ORDINANCE GRANTING A CHANGE OF ZONING ON PROPERTY LOCATED AT 4916 MAIN STREET ( STOP N GO ) FROM GENERAL RETAIL TO A SPECIFIC USE CALSSIFICATION TO ALLOW FOR THE SALE OF BEER AND WINE FOR OFF PREMISE CONSUMPTION Mayor Sample read the ordinance caption: Ordinance # 352 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONIGN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ORDINANCE NO. 61, AS AMENDED, PASSED AND APPROVED ON JUNE 4, 1979, THE SAME BEING APPENDIX A OF THE CODE FO ORDINANCES OF THE CITY OF THE COLONY, TEXAS, BY GRANTING AND APPROVING A SPECIFIC USE PERMIT FOR THE SALE OF BEER AND WINE ONLY FOR OFF PREMISE CONSUMPTION ONLY IN THE GR, GENERAL RETAIL DISTRICT AND LOCATED WITHIN THE STRUCTURE LOCATED AT 4916 MAIN STREET, CITY OF THE COLONY; PORVIDING FOR CERTAIN CONDITIONS OF APPROVAL; REQUIRING COMPLIANCE WITH THE SITE PLAN ATTACHED HERETO; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE COMPREHENSIVE ZONING ORDINANCE; PROVIDING A SEVER- ABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR NOR MORE THAN ONE THOUSAND DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE Councilman Amcik mvoed to adopt the ordinance as written. Seconded by Councilman Dodds, the motion carried with a unanimous roll call vote. 002032 4. PUBLIC HEARING REGARDING AMENDING SECTION 16 OF THE COMPREHENSIVE ZONIGN ORDINANCE RELATING TO INCREASING THE CURRENT PLAT FEES FOR SUBDIVISIONS Councilman Dodds moved to open the public hearing. Seconded by Councilman Amick, the motion carried with a unanimous vote. City Manager Carroll advised the Council that Eric Stanton had done a study of neighboring cities and the fees he is recommending .... are about average. With no further comments, Councilman Poole moved to close the public hearing. Seconded by Councilman Amick, the motion carried with a unanimous vote. 5. CONSIDERATION OF AN ORDINANCE AMENDING SECTIONS 16 A, B & C OF THE ZONING ORDINANCE RELATING TO INCREASING PLAT FEES FOR SUBDIVISIONS Mayor Sample read aloud the ordinance caption as follows: ORDINANCE # 353 AN ORDINANCE AMENDING APPENDIX B SUBDIVISION OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS BY AMENDING SECTION 16 RELATING TO FEES BY AMENDING SUBSECTIONS 16A, B AND C; DETERMIN- ING THAT THE CHANGE IN THE SUBDIVISION REGULATIONS HAVE BEEN MADE TO PROMOTE THE HEALTH, SAFETY, MORALS AND WELFARE OF THE COMMUNITY; PRESERVING ALL OTHER PARTS OF APPENDIX B SUBDIVISION; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY Councilman Dodds made the motion to approve the ordinance as written. Seconded by Councilman Amick, the motion carried with a unanimous roll call vote. 6. PUBLIC HEARING REGARDING AMENDING SECTION 6-80 OF THE COMPREHENSIVE ZONING ORDINANCE & ADDING SECTION 6-96 ON REGULATIONS FOR MANUFACTURED HOMES AND HOUSES Councilman Dodds moved to open the public hearing. Seconded by Councilman Arrambide, the motion carried with a unanimous vote. MaYor Sample said the State Legislature approved a bill that regulates manufactured housing. It requires inspections on the building site by inspectors selected by the state. These can be perons within the manufacturing company. Councilman Poole said other cities were disappointed in the legislation as well. Councilman Dodds moved to close the public hearing. Seconded by Councilman Harris, the motion carried with a unanimous vote. 7. CONSIDERATION OF AN ORDINANCE AMENDING SECTION 6-80 OF THE COM- PREHENSIVE ZONING ORDINANCE & ADDING SECTION 6-96 PROVIDING FOR THE PROHIBITION OF MANUFACTURED HOUSING AND MANUFACTURED HOMES Mayor Sample read the ordinance caption aloud as follows: ORDINANCE # 354 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS BY AMENDING CHAPTER 6 RELATING TO BUILDINGS, CONSTRUCTION, AND RELATED ACTIVITIES BY ADDING NEW DEFINITIONS TO SECTION 6- 80 AND BY ADDING NEW SECTION 6-96; PROVIDING FOR THE PROHIBITION OF MANUFACTURED HOUSING AND MANUFACTURED HOMES; PRESERVING ALL OTHER PARTS OF CHAPTER 6 OF THE CODE OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR NOR MORE THAN ONE THOUSAND DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY Councilman Arrambide moved to adopt the ordinance. Seconded by Councilman Poole, the motion carried with a unanimous roll call vote. 8. CONSIDERATION oF AN ORDINANCE CALLING FOR TWO PUBLIC HEARINGS FOR THE PURPOSE OF CONSIDERING THE INSTITUTION OF ANNEXATION PROCEEDINGS TO ANNEX A 500 FOOT WIDE TRACT OF LAND GENERALLY LOCATED DUE NORTH OF THE NORTHWEST CITY LIMIT BOUNDARY Mayor Sample read the Ordinance Caption aloud, summarized as follows: Ordinance # 355 Calls for two public hearings, both to be conducted a City Hall on Monday, July 8, 1985, the first at 7:30 p.m. and the second at 8:00 p.m. Councilman Dodds moved to approve the ordinance. Seconded by Councilman Gray, the motion carried with a unanimous vote. 9. CONSIDERATION OF AN ORDINANCE CALLIGN FOR TWO PUBLIC HEARINGS FOR THE PURPOSE OF CONSIDERING THE INSTITUTION OF ANNEXATION PROCEEDINGS TO ANNEX A 664 ACRE TRACT OF LAND GENERALLY KNOWN AS WYNNEWOOD PARK LOCATED DUE NORTH OF THE NORTH WEST CITY LIMIT BOUNDARY ON WYNNEWOOD PENINSULA Mayor Sample read the ordinance caption alound, summarized as follows: Ordinance # 356 Calls for two public hearings, both to be conducted at City Hall on Monday, July 8, 1985, the first at 7:45 p.m. and the second at 8:15 p.m. Councilman Dodds moved to approve the ordinance. Seconded by Councilman Arrambide, the motion carried with a unanimous vote. 10. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17 OF V.A.C.S. SECTIONS 2E & G, RELATING TO LITIGATION AND BOARD APPOINTMENTS Upon reconvening in open session, and with no further action to be taken by the Council at this time, Councilman Dodds moved to adjourn. Seconded by Councilman Harris, the motion carried with a unanimous vote. Mayor Sample adjourned the meeting at 11:10 p.m. ·
