OF THE CITY OF THE COLONY, TEXAS
HELD ON
JUNE 17, 1985
The REGULAR SESSION Of the City Council of the City of The Colony, Texas
was called to order at 7:30 p.m. with the following members present:
Larry D. Sample Mayor
Rick Harris Councilman
Tom Arrambide "
Helen Gray "
Don Amick "
Charles Dodds "
and with Marlene Poole absent due to an illness in her family, however,
a quorum was established.
1. PLEDGE OF ALLEGIANCE
Mayor Sample led the Council and members of the audience in the
pledge of allegiance to the United States flag.
2. CITIZEN INPUT
Councilman Gray jokingly presented Police Chief Ristagno with $80.00
in shreaded money to use for the purchase of a shredder.
Mr. Dick Weaver spoke about his discontent with the recent Denton
County Appraisal Districts tax estimates. He asked why they are
permitted to estimate our taxes and asked the Council to protest
the estimates. Mayor Sample advised him that the key word on the
recent statementes is "estimate". He went on to say the figures
used are not accurate and the Council has not intention of charging
that sort of tax rate.
Mrs. Wright, Gibson Street, said she is still upset about her neighbor
doing business out of a portable building behind his home. Eric
Stanton, City Building Official, said he has been to the residence
and spoke with the man about the laws of the City and explained
what is and is not allowed. He will make periodic checks on the
residence to insure that no laws are being broken.
3. CONSIDERATION OF A REQUEST FROM THE COLONY ROTARY CLUB TO INSTALL
AN EXERCISE TRAIL AT BRIDGES PARK
Mr. Tom Reese gave an indepth presentation regarding the Rotary
Clubs request and the Gamefield Company program. He said the
Gamefield Company provides grant monies to install excercise equip-
ment in city parks. He went on to say that St. Paul Hospital also
may allow some grant monies for this project since they often
prescribe the use of such equipment to their patients. He asked
if the City would assist in clearing the area around Bridges Park?
City Manager, Janice Carroll advised everyone present that this
idea fits in with the Master Park Plan.
With no further discussion, Councilman Dodds moved to approve this
request with thanks to the Rotary Club. Seconded by Councilman
Arrambide, the motion carried with a unanimous roll call vote.
4. CONSIDERATION OF A RESOLUTION REQUESTING THE DENTON COUNTY CLERK
TO USE FM423 AS THE DIVIDING LINE WHEN DIVIDING COUNTY PRECINCT

Mayor Sample read the Resolution aloud. The caption reads as follows:
RESOLUTION #85-10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS,
REQUESTING THE DENTON COUNTY CLERK TO USE FM423 AS THE DIVIDING
LINE WHEN DIVIDING COUNTY PRECINCT 2N AND USING THE STEWARTS CREEK
ELEMENTARY SCHOOL AS A POLLING PLACE FOR THE NEWLY CREATED PRECINCT.
Councilman Amick moved to adopt the resolution as written. Seconded

by Councilman Gray, the motion carried with a unanimous roll call
vote.
5. CONSIDERATION OF A RESOLUTION REQUESTING THE COLONY MUNICIPAL UTILITY
DISTRICT TO STOP THE POLICY OF SUBSIDIZING DEVELOPERS IN THE CONSTRUCTION
OF WATER AND SEWER LINES
Councilman Amcik explained the reasoning behind the resolution.
He said at this time, it is in the best interest of the City and
the taxpayers to have the developers carry the burden of the expense
of construction such as this. He went on to add, the City/M.U.D.
Feasibility Committee recommends passage.

A RESOLUTION URGING AND DIRECTING THE COLONY MUNICIPAL UTILITY
DISTRICT NO. 1 TO CEASE ITS EXISTING POLICIES OF FINANCING EITHER
ALL OR UP TO 70% OF THE CAPITAL IMPROVEMENT REQUIREMENTS FOR DEVELOPERS
AND TO ADOPT RULES, REGULATIONS, GUIDELINES AND POLICIES SIMILAR
AND COMPATIBLE WITH THE ORDINANCES, RULES, REGULATIONS, GUILDELINES
AND POLICIES OF MUNICIPALITIES LOCATED WITHIN DENTON, COLLIN, DALLAS
AND TARRANT COUNTY AND IN CLOSE PROXIMITY TO THE BOUNDARIES OF
THE COLONY MUNICIPAL UTILITY DISTRICT NO. I WHICH ORDINANCES, RULES,
REGULATIONS AND POLICIES REQUIRE THE DEVELOPER TO FINANCE 100%
OF THE COST OF NECESSARY PUBLIC IMPROVEMENTS CUSTOMARILY DESIGNATED
AS TRADITIONAL DEVELOPERS COSTS WHICH ORDINANCES, RULES, REGULATIONS
AND GUILDELINES ARE GENERALLY REFERRED TO AS IMPACT FEE ORDINANCES.
Councilman Amick moved to adopt the resolution as written. Seconded
by Councilman Dodds, the motion carried with a unanimous roll call
vote.
6. CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 10, SECTIONS 10-
82, 83, 84, & 10-86 OF THE CITY CODE RELATING TO WEEDS, TRASH &
RUBBISH --
Mr. Eric Stanton, Chief Building Official, said this ordinance
w~ll make the following amendments to Ordinance #239:
1. The ability to declare unlawful any condition deemed un-
sightly or unsanitary on any lot (not just high weeds
and grass), by using one ordinance instead of several
2. The ability to hold nonresident owners or property managers
responsible for unlawful conditions. It also reinforces
the ability to enforce the trash in the alley problems
we're having.
3. The ability of the city to preform work and attach liens
without having to publish notice in the newspaper if the
owner cannot be located.
Councilman Gray wants an ordinance that completely prohibits weeds.
Councilman Amick responded by saying the City can not legislate
what is grown but we can legislate the height.

TO WEEDS, TRASH AND RUBBISH BY THE AMENDMENT OF CERTAIN SECTIONS
THEREOF; RELATING TO GROWTH HEIGHT LIMITATIONS IN SPECIFIED AREAS;
RELATING TO FAILURE TO COMPLY WITH REGULATIONS; PROVIDING FOR A
PENALTY; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR SEVERABILITY;
PROVIDING THAT THIS ARTICLE SHALL CONTROL OVER ALL ORDINANCES OR
PARTS OF ORDINNACES INCONSISTENT HEREWITH; PROVIDING THAT THIS
ARTICLE HAS BEEN EXACTED TO PROMOTE THE HEALTH, SAFETY, MORALS
AND GENERAL WELFARE FO THE COMMUNITY; AND DECLARING AN EMERGENCY
Councilman Amick moved to adopt the ordinance as written. Seconded
by Councilman Dodds, the motion carried with ~he following vote: Noes: Councilman Gray

7. CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 6, SECTION 6-3 OF
THE CITY CODE RELATING TO AN AMENDMENT TO THE NATIONAL ELECTRIC
CODE
City Manager Carroll, said this ordinance clarifies a previous
ordinance and prohibits electrical lines from being crossing diagnally
across a persons property. It further makes it a requirement to
put the panel box in the garage rather than on the side of the
house.
Mayor Sample read aloud the ordinance caption as follows:
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF THE
COLONY, TEXAS BY AMENDING CHAPTER 6 RELATING TO BUILDINGS, CONSTRUCTION
AND RELATED ACTIVITIES BY AMENDING SECTION 6-3 RELATING TO AMENDMENTS
TO THE 1984 NATIONAL ELECTRICAL CODE; PROVIDING FOR REP'~AL OF ALL
INCONSISTENT ORDINANCES; PROVIDING A SEVERABILITY CLAUSE~ PROVIDING
AN EFFECTIVE DATE AND DECLARING AN EMERGENCY
Councilman Amick made the motion to approve as written. Seconded
by Councilman Dodds, the motion carried with a unanimous roll call
vote.
8. CONSIDERATION OF AN ORDINANCE AMENDING ORDINANCE #¢1, GRANTING
A CHANGE OF ZONING ON APPROXIMATELY 457.0480 ACRES OF LAND TO
OF-l, OF-2 AND BUSINESS PARK
Councilman Amick moved to table. Seconded by Councilman Dodds,
the motion carried with a unanimous roll call vote.
9. CONSIDERATION OF ACCEPTANCE OF RESIGNATION FROM THE PARK & RECREATION
BOARD
Councilman Amick moved to accept the resignation of Reuben Delgado.
Seconded by Councilman Dodds, the motion carried with a unanimous
roll call vote.
10. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17 OF V.A.C.S.,
SECTION 2E, REGARDING BOARD APPOINTMENTS
Mayor Sample announced the Council would reconvene in open session
later in the evening to consider the remaining agenda items.
11. CONSIDERATION OF APPOINTMENTS TO THE FINE ARTS COMMITTEE
Councilman Dodds moved to table. Seconded by Councilman Arrambide,
the motion carried with a unanimous vote.
12. CONSIDERATION OF APPOINTMENT TO PLACE 4 OF THE PARK & RECREATION
BOARD
Councilman Dodds moved to table. Seconded by Councilman Arrambide,
the motion carried with a unanimous vote.
With no further action to be taken by the Council at this time, Councilman
Dodds made a motion to adjourn. Seconded by Councilman Arrambide, the
motion carried with a unanimous vote.
Mayor Sample adjourned the meeting at 10:10 p.m.
