Minutes of the City Council
of the City of The Colony, Texas
held on
December 3, 1984
The REGULAR SESSION of the City Council of the City of
The Colony, Texas was called to order at 7:30 p.m. with
the following members present:
Larry D. Sample Mayor
Rick Harris Councilman
Noel Long Councilman
Helen Gray Councilman
Charles Dodds Councilman
Marlene Poole Councilman
and with Couniclman Amick absent; however, a quourm
was established.
1. PLEDGE OF ALLEGIANCE
Mayor Sample led the Council and members of the
audience Jn the pledge to the Un~ted States flag.
2. CITIZEN INPUT
Councilman Poole used this time to commend Fire Chief
Gothard as well as the residents of th~s City for all
the Christmas decorations this year. She also spoke
briefly regarding the annual Beta Sigma Phi Christmas
Tree lighting ceremony. It will be held Friday,
December 9th at L~ons Club Park at 7:30 p.m.
City Manager, Janice Carroll reminded everyone about
the City's Annual Christmas Parade to be held at 10:00
a.m. Saturday December 8th.
Councilman Gray took a moment to commend the inspection
department for the looks of Pa~ge Road. She sa~d it
looked really nice without all the garage sale s~gns
everywhere.
EMERGENCY AGENA ITEM NOTICE
1. CLARIFICATION OF APPOINTMENTS OF ELECTION OFFICERS
Councilman Poole made a motion to appoint Sherri
Campbell as presiding judge and Jill--Spears as alternate
judge for precincts 2N & 2D and further to appoint
Kay Einig as judge and Dee Cole as her alternate for
precincts 2B & 2C, for the Bond Election to be held
December 15, 1984. Seconded by Councilman Long,
the motion carried with a unanimous roll call vote.

3. PUBLIC HEARING ON THE PROPOSED ANNEXATION OF A 130
ACRE TRACT OF LAND ON THE WESTERN TIP OF STEWART
CREEK PENINSULA ADJACENT TO THE WESTERN CITY LIMIT
BOUNDARY GENERALLY KNOWN AS STEWART CREEK PARK
Councilman Dodds made a motion to open the public hearing.
Seconded by Councilman Harris, the motion carried with
a unanimous vote.
City Manager Carroll presented the Service Plan for
the area. She pointed out road conditions entering
the park and referenced the proposed County maintenance
agreement which would enable the City to jointly main-
tain the road.
Mayor Sample said this annexation would not count on
the City's land allotment because it ~s government
owned.
With no further comments from Council or the audience,
Councilman Dodds moved to close the public hearing and
direct the City staff to prepare the annexation ordin-
ance. Seconded by Councilman Harris, the motion
carried with a unanimous roll call vote.
4. RECEIVE PRESENTATION FROM THE FEDERAL EMERGENCY
MANAGEMENT AGENCY (FEMA) REGARDING THE FLOOD INSURANCE
PROGRAM
Mr. Don Ellison a representative of FEMA was present
to show the Council how to read the flood hazard
maps and to answer any questions. He explained how
the program works and said FEMA would publish twice ,
the flood elevations in the local newspapers. This
would begin the appeal process. He reviewed the appeal
process and said it would last for 90 days.
Mr. Bob Petite, a representative of Fox & Jacobs was
present and explained that his company was aware of
the flood hazard areas when they were building homes
in this City and did the necessary rechannelization
and elevating necessary to bring hazard areas out of
the flood zones. He indicated that he would supply
FEMA and the City with the necessary information to
have the flood hazard maps corrected.
5. CONSIDERATION OF AN ORDINANCE CONSENTING TO THE SALE
OF COMMUNICATIONS SERVICES, INC. TO CSI ASSOCIATES, INC.
Mayor Sample read the following ordinance caption:
AN ORDINANCE OF THE CITY OOUNCIL OF THE CITY
OF THE COLONY, TEXAS, CONSENTING TO THE SALE
OF THE VOTING STOCK OF COMMUNICATIONS SERVICES ,
INC., GRANTEE OF THE CABLE TELEVISION FRANCHISE --
PURSUANT TO ORDINANCE NO. 123 PASSED AND APPROVED
BY THE CITY COUNCIL ON OCTOBER 20, 1980; PROVIDING
A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE.
Councilman Dodds made the motion to approve the ordinance
as written. Seconded by Councilman Long, the motion
carried with a unanimous roll call vote.
6. CONSIDERATION OF STREET NAME RECOMMENDATIONS AS PRE-
SENTED BY THE HOLY CROSS CATHOLIC CHURCH
Following a brief discussion of the recommentions from
the church, Councilman Long made a motion to name the
street Morning Star Lane. Seconded by Councilman Dodds,
the motion carried with a unanimous roll call vote.
Mayor Sample added, the name would become effective
only when the existing street is rerouted.
7. CONSIDERATION OF AN ORDINANCE AUTHORIZING THE CITY
MANAGER TO ENTER INTO A CONTRACT WITH RAY ASSOCIATES ,
INC. TO CONDUCT A FEASIBILITY STUDY REGARDING THE
CITY AND THE MUNICIPAL UTILITY DISTRICT
Mayor Sample read the ordinance caption as follows:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS
AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH THE FIRM OF JAMES RAY ASSOCIATES
IN THE AMOUNT OF $22,026.00 FOR THE PURPOSE OF
CONDUCTING A FEASIBILITY STUDY REGARDING THE
CITY OF THE COLONY AND THE COLONY MUNICIPAL
UTILITY DISTRICT #1; ATTACHING THE APPROVED
FORM OF THE CONTRACT AS EXHIBIT "A"; AND PRO-
VIDING AN EFFECTIVE DATE.

Councilman Dodds made the motion to approve the
ordinance. Seconded by Councilman Harris, the
motion carried w~th a unanimous roll call vote.
8. CLOSED DOOR SESSION, AS AUTHORIZED BY ARTICLE
6252-17 OF V.A.C.S., SECTION 2G, REGARDING BOARD
AND COMMITTEE APPOINTMENTS
Mayor Sample advised everyone present that the
Council would reconvene in open session later in
the evening to consider the appointments
Upon reconvening in open session, Mayor Sample addressed
the remainder of the agenda as follows:
9. CONSIDERATION OF APPOINTMENTS TO PLACES 5 & 6 OF
THE PLANNING AND ZONING COMMISSION
Councilman Dodds made a motion to table. Seconded
by Councilman Poole, the motion carried with a
unanimous roll call vote.
10. CONSIDERATION OF AN APPOINTMENT TO THE DENTON COUNTY
APPRAISAL DISTRICT STERRING COMMITTEE
Councilman Dodds made a motion to appoint Harold
VanAlstyne. Seconded by CouncJlman Harris, the
motion carried w~th a unanimous roll call vote.
11. CONSIDERATION OF AN APPOINTMENT TO THE DENTON COUNTY
APPRAISAL DISTRICT APPRAISAL REVIEW BOARD
Councilman Dodds moved to reappoint George Lindquist.
Seconded by Councilman Harris, the motion carried
with a unanimous roll call vote.
With no further action to be taken by the Council at this
time, Councilman Dodds made the motion to adjourn. Seconded
by Councilman Harris, the motion carried with a unanimous
vote.
Mayor Sample formally adjourned the meeting at 10:00 p.m.
