HomeMy WebLinkAbout11/26/1984 City Council 001904 Minutes of the City Council of the City of The Colony, Texas Held on November 26, 1984 The SPECIAL SESSION of the City Council of the City of The Colony, Texas was called to order at 7:00 p.m. with the following members present: Larry D. Sample Mayor Rick Harris Councilman Noel Long Councilman Helen Gray Councilman Don Amick Councilman Charles Dodds Councilman Marlene Poole Councilman With all members present, a quorum was established. Also present at the meeting were Mr. John Boyle, City Attorney, and Mr. Eric Stanton, Building Official. 1. PLEDGE OF ALLEGIANCE Mayor Sample led the Council and members of the audience in the pledge of the United States flag. 2. CONTINUATION OF A PUBLIC HEARING TO CONSIDER AMENDMENTS TO THE COMPREHENSIVE ZONING ORDINANCE Councilman Poole made a motion to continue the Public Hearing. Seconded by Councilman Harris, the motion carried with a unanimous vote. There was no one present in the audience that wished to speak for or against the amendments. Councilman Am]ck made a motion to close the Public Hearing. Seconded by Councilman Poo]e, the motion carried w~th a unanimous vote. 3. CONSIDERATION OF AN ORDINANCE AMENDING SECTIONS 3,4, 10, 12, 13 & 14 OF THE COMPREHENSIVE ZONING ORDINACE #61 City Manager, Janice Carroll, briefly reviewed the ordinance aloud noting the changes. Councilman Poole expressed her feelings for the need of a modular home classification. Planning & Zoning Board members present at the meeting agreed with Councilman Poole and sa~d they would pursue her request. There was a lengthy discussion on the schedule of uses followed by a discussion on day nursery vs. day care. Planning and Zoning Member, John Warmack, and Council- man Long both had some concern over the 1000 feet limit mentioned in the location factor. Member Warmack said it is ~mportant to have the ordinance flexible enough to accomodate future growth if the need arises. Council- man Long feels the C~ty needs a better definition of Planned Development. Following another lengthy discussion, Mayor Sample read the Ordinance caption aloud as follows: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, SAME BEING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY BY ADDING A NEW ZONING DISTRICT TO THE LIST OF ZONING DISTRICTS; AMENDING EXISTING DEFINITIONS AND ADDING A NEW DEFINITION FOR 001905 BUSINESS PARK DISTRICT; BY AMENDING THE SCHEDULE · i OF USES TO INCORPORATE THE BUSINESS PARK ZONING DISTRICT AND TO ELIMINATE THE CUMULATIVE CONCEPT OF ALLWOABLE PRINCIPAL AND ACCESSORY USES IN ZONING DISTRICTS PROVIDING FOR THE DEFINITION OF FLOOR AREA RATIO; PROVIDING FOR THE APPLICABILITY OF FLOOR AREA RATIO TO THE BUSINESS PARK ZONING DISTRICT; AND FOR THE APPLICATION OF A LOCATION FACTOR; PROVIDING SETBACK REGULATIONS; PROVIDING FOR DENSITY BONUS APPLICATION; PROVIDING PARKING REGULATION AMENDMENTS; PROVIDING SPECIAL OFF STREET LOADING FOR LANDSCAPTED OPEN SPACE; PRO- VIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EMERGENCY CLAUSE. With no further discussion, Councilman Dodds made a motion to approve the ordinance with changes as noted in the discussions. Seconded by Councilman Long, the motion carried by a unanimous roll call vote. The Council took a brief recess at this point. Upon recon- vening in open session, Mayor Sample addressed the remaining agenda items as follows. 4. ESTABLISH A MEETING SCHEDULE FOR THE MONTH OF DECEMBER 1984 After a brief discussion, the Council agreed to meet on December 3rd, 10th, and 17th. 5. CLOSED DOOR SESSION AS AUTHORIZED BY ARTICLE 6252-17 OF V.A.C.S. SECTION 2G, REGARDING PERSONNEL, PLANNING AND ZONING COMMISSION APPOINTMENTS Upon reconvening in open session, and with no further action to be taken by the Council at this time, Councilman Dodds moved to adjourn the meeting. Seconded by Councilman Poole, the motion carried with a unanimous vote. Mayor Sample formally adjourned the meeting at 11:15 p.m. Approved: Attest: J~City Secreta y (SEAL)
