HomeMy WebLinkAbout01/16/1984 City Council MINUTES OF THE CITY COUNCIL OF THE CITY OF THE COLONY HELD ON JANUARY 16, 1984 A REGULAR SESSION of the City Council of the City of The Colony, Texas, was called to order at 7:30 p.m. at City Hall with the following members present: Larry D. Sample Mayor Scott North Councilman Norman Adeler Councilman Charles Dodds Councilman Marlene Poole Councilman and with Councilmen Long and Amick absent, however; a quorum was established. 1. PLEDGE OF ALLEGIANCE Mayor Sample led the Council and members of the audience in the pledge to the United States flag. 2. CITIZEN INPUT There was no citizen input. 3. APPROVAL OF MINUTES Councilman North moved and Councilman Poole seconded the motion to approve the minutes of the December 14, 1983 and the January 4, 1984 meetings as presented. The motion passed with the following roll call vote: Ayes: Ail members present voted aye Noes: None 4. CONSIDERATION OF APPROVAL OF THE PRELIMINARY AND FINAL PLAT OF THE PAIGE MEDICAL PLAZA TO BE LOCATED GENERALLY AT PAIGE AND KISOR ROADS; MORE SPECIFICALLY LOCATED AT 6600 PAIGE ROAD City Manager, Janice Carroll, advised the Council that DrJ. Kevin Seidler and his representatives were present along with Mr. I. R. Bradbury, representing the Planning and Zoning Commission (P & Z). She went on to say the P & Z had approved the preliminary and final plats in one motion. She then turned the floor over to Dr. Seidler and his representatives. Mr. A1 Williams, a representative of the planners of the facility, showed the council the archetectural rendering of the proposed building. Mrs. Carroll said the first question the Council had brought before her was whether or not the exterior would be brick. Mr. Williams replied the exterior would be constructed of a pre-cast concrete, also known as agregate Councilman Poole wanted to know why a brick finish was not chosen that would blend in with the rest of the residential area. She went on to add that in the past, the citizens have been very out-spoken about wanting brick exteriors within this City. She expressed concern for the residents surrounding this site that live in brick homes and having a agregate building come in and be an eye-sore. Mr. Williams said that based on cost estimates, the brick veneer was to expensive. He went on to say that the agregrate would not be an eye-sore and gave the Council the location of a building they just completed at the corner of Dallas Parkway and Beltline Road in Addison. He said the agregate structure would make this building affordable for the doctors to rent at $13 to $13.50 per square foot. Dr. Seidler made the comment that the struc- ture needs to look like a medical building yet blend in with the neighborhood. Mrs. Carroll asked if they were locked into the square footage. Dr. Seidlers reply was yes, they presently have six doctors and St. Paul Hospital ready to move in. The hospital will occupy 6,000 square feet. The doctors will be in addition to the ones presently in The Colony. When asked what they O0104,< would do if St. Paul didn't move in, Mr. Williams said their decision was if St. Paul wouldn't move in, then the building wouldn't be built now. He went on to say that they have a signed lease from St. Paul for five (5) years with two (2) five (5) year options for the proposed structure in The Colony as well as a structure just like it in Coppell. They Mayor expressed his concern over whether or not the police department could properly patrol the facility if the back of the building faced Paige Road. He also asked what the building would look like from Paige Road. Mr. Williams said it would simply look like a two story office building. He went on to say that he would have a line drawing available for the Council to review at their February 6th meeting detailing the rear of the building. Councilman Poole moved to table this matter, contingent on seeing the building at the northeast corner of Beltline Road and Dallas Parkway and viewing the line drawing at the February 6th meeting. Seconded by Councilman Adeler, the motion passed by the following roll call vote: Ayes: All members present voted aye Noes: None 5. CONSIDERATION OF AN ORDINANCE FOR THE CHANGE OF ZONING FROM MULTI-FAMILY TO A SHOPPING CENTER CLASSIFICATION ON A 13.606 ACRE LAND TRACT LOCATED WEST AND SOUTH OF THE INTERSECTION OF FM 423 and SOUTH COLONY BOULEVARD Mayor Sample read the following Ordinance caption: AN ORDINANCE AMENDING ORDINANCE NO. 61, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AS AMENDED, PASSED AND APPROVED ON JUNE 4, 1979, GRANTING A ZONING CHANGE ON A TRACT OF LAND WHICH IS WITHIN THE CITY OF THE COLONY, TEXAS, AND MORE FULLY DESCRIBED HEREIN; ORDERING A CHANGE IN THE USE OF SAID PROPERTY FROM MF-1, MULTIPLE FAMILY DWELLING DISTRICT TO SC, SHOPPING CENTER DISTRICT; REQUIRING SITE PLAN APPROVAL PRIOR TO ISSUANCE OF A BUILDING PERMIT; REQUIRING DEVELOP- MENT OF THE SHOPPING CENTER TO BE IN ACCORDANCE WITH SC, SHOPPING CENTER DISTRICT REGULATIONS PROVIDED BY THE COMPREHENSIVE ZONING ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR NOR MORE THAN TOW HUNDRED DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. Councilman Dodds moved to accept the Ordinance as presented. Seconded by Councilman Poole, the motion passed with the following roll call vote: Ayes: All members present voted aye Noes: None 6. CONSIDERATION OF AN ORDINANACE FOR THE CHANGE OF ZONING FROM SINGLE FAMILY TO A SPECIFIC USE PERMIT CLASSIFICATION ON A LAND TRACT LOCATED ON THE SOUTHEAST CORNER OF NORTH COLONY BOULEVARD AND PHELPS STREET FOR THE CONSTRUCTION OF A CATHOLIC CHURCH Mayor Sample read the following Ordinance caption: AN ORDINANCE AMENDING ORDINANCE NO. 61, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AS AMENDED, PASSED AND APPROVED ON JUNE 4, 1979, GRANTING A ZONING CHANGE ON A TRACT OF LAND WHICH IS WHITHIN THE CITY OF THE COLONY, TEXAS, AND MORE FULLY DESCRIBED HEREIN; ORDERING A CHANGE IN THE USE OF SAID PROPERTY FROM SF, SINGLE FAMILY DWELLING DISTRICT TO SPECIFIC USE PERMIT WITH ALLOWABLE USE ONLY OF A CATHOLIC CHURCH; REQUIRING SIT PLAN APPROVAL PRIOR TO ISSUANCE OF A BUILDING PERMIT; REQUIRING DEVELOPMENT OF THE CHURCH TO BE IN ACCORDANCE WITH ALL REGULATIONS RELATIVE TO CHURCHES; CORRECTING THE OFFICILA ZONING MAP; PRESERVING ALL OTHER PROTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMININT THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DAMAND THE ZONING CHANGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR NOR MORE THAN TWO HUNDRED DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFEC- TIVE DATE. Councilman North suggested the word Catholic be struck from the Ordinance in case some time in the future the Catholic Church relocates, any other denomination may use the property. Councilman Dodds moved to accept the Ordinance as presented, provided the word Catholic be deleted. Seconded by Councilman Adeler, the motion passed by the following roll call vote: Ayes: Ail members present voted aye Noes: None 7. CONSIDERATION OF AN ORDINANCE ALTERING THE MAXIMUM SPEED LIMIT ON APPROXIMATELY 1.308 MILES OF SH121 LOCATED WITHIN THE COLONY CITY LIMITS FROM THE. CURRENT 55 MPH SPEED ZONE TO A 45 MPH SPEED ZONE City Manager, Janice Carroll told the Council that the information received from the State Highway De- partment has been reviewed by Mr. Hal Jones, City Traffic Engineer. He said this was a rare but prudent request by the State. They based their request on a speed zone study they conducted which indicates that the normal driver will drive 45 mph under the existing conditions. There was some discussion as to how much of SH121 falls under the jurisdiction of The Colony. Councilman North had serious concerns about the need for the Police to enforce the speed limits as well as the signal lights. He specifically referred to the gravel haulers that consistently abuse the speed limit 'as well as run the red lights. Chief Ristagno, said he basically does nothave the personnel to properly enforce this area during the day. However, he said he could possibly use reserve officers for this area. Councilan Poole suggested notification be sent to the local gravel companies to advise their drivers about the proposed speed zone. She went on to ask how soon the signs would go up. Chief Ristagno said the State has the signs now and would have them up within a week or two after receiving a signed copy of the Ordinance. Mayor Sample then read the following caption from the Or- dinance: AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED OF VEHICLES UNDER THE PRO- VISIONS OF 169 (b) OF ARTICLA 6701 d, VERNON'S TEXAS CIVIL STATUTES, UPON STATE HIGHWAY NO. 121 OR PARTS THEREOF, WITHIN THE INCORPORATED CITY LIMITS OF THE CITY OF THE COLONY, AS SET OUT IN THIS ORDINANCE: AND PROVIDE A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIO- LATION OF THIS ORDINANCE. Councilman North moved to accept the Ordinance as presented. Seconded by Councilman Dodds, the motion passed by the following roll call vote: Ayes: Ail members present voted aye Noes: None 8. CONSIDERATION OF THE RE-APPOINTMENT OF THE RESERVE POLICE OFFICERS FOR THE YEAR 1984 Mayor Sample read the following list of reserve officers: Sgt. Russell Clark Sgt. Stephen Page Officer Carvel (Skip) Cole Officer Debra Cunningham Officer Roger Gill Officer Patti Jones Officer Paul Krajcovic Officer Richard Morales Officer Richard Renfro Officer Joseph Samet Officer John Whitley Chief Ristagno said that this is the finest group of reserve officers the City has ever had and that he is very proud of them. Mayor Sample stated that the Council would like to publicly thank them for their service. Councilman Dodds moved to re-appoint the above mentioned officers. Seconded by Councilman North, the motion passed with the following roll call vote: Ayes: All members present voted aye Noes: None Mayor Sample announced the Council would take a brief recess to celebrate the 7th anniversary of the City. The Bahai Faith , represented by Mr. & Mrs. Dick Rush, presented the Council with a Birthday Cake and the City with a tree. Mr. Rush said the reason for giving a tree was to symbolize growth. Upon reconvening, the Mayor moved to agenda item #9. 9. CLOSED DOOR SESSION AS AUTHORIZED BY ART. 6252-17 OF V.A.C.S. REGARDING PERSONNEL With no further action to be taken by the Council, Councilman Dodds moved to adjourn the meeting.
